ORDINANCE NO.: 1528-26
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS
REPEALING AND REPLACING SECTION 50.40 OF THE ZEPHYRHILLS
CITY CODE TO UPDATE THE RATES AND CHARGES ESTABLISHED
FOR THE CITY OF ZEPHYRHILLS SANITATION DIVISION OF THE
PUBLIC WORKS DEPARTMENT; PROVIDING FOR SEVERABILITY,
AND AN EFFECTIVE DATE.
WHEREAS, the City of Zephyrhills is a duly constituted municipality of the State of
Florida, with all powers granted by Chapter 166, Florida Statutes, and the City Charter, including
the authority to fix rates and charges for municipal utility services;
WHEREAS, providing reliable refuse removal provides for the health and safety of the
City's residents; and
WHEREAS, Kessler Consulting, a consulting firm specializing in sanitation rates, has
studied the City's sanitation operational and financial performance and has recommended that the
city increase its sanitation rates, stated in Exhibit A;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, sitting in regular session that:
Section 1. Recitals. The above recitals are true and correct and are incorporated herein by
this reference.
Section 2. Amended Sanitation Rates. The sanitation rates as outlined in Section 50.40
of the Code of Ordinances of the City of Zephyrhills shall be replead and replaced for utility bills
rendered on or after October 1, 2026, with the rates set forth in Exhibit "A" attached hereto. The
City Council hereby authorizes the full multi -year rate schedule set forth in Exhibit "A," including
annual rate adjustments for Fiscal Years 2027 through 2030, without the need for additional
Council action or public hearing for each annual adjustment. The rates for each subsequent fiscal
year shall become effective automatically on October 1 of that fiscal year.
Section 3. Repealer. All ordinances in conflict herewith are hereby repealed to the extent
of any conflict.
Section 4. Severability. It is declared to be the intent of the City Council of the City of
Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of this ordinance
is held invalid, the remainder of the ordinance shall be construed as not having continued the said
section, subsection, sentence, clause, or provision and shall not be affected by such holding.
Section 5. Inclusion into the Code. It is the intent of the City Council that the provisions
of this Ordinance shall become and be made a part of the City of Zephyrhills code, and that the
sections of this Ordinance may be renumbered or re -lettered and the word "ordinance" may be
changed to "section," "article," "regulation," or such other appropriate word or phrase in order to
accomplish such intentions.
Section 6. Effective Date. This Ordinance shall become effective on October 1, 2026.

EXHIBIT A
GARBAGE AND REFUSE RATE SCHEDULE
The Department is operated as an enterprise fund. There are hereby fixed and prescribed monthly
rates and charges (herein sometimes called the service charges) for the service and facilities
furnished and to be furnished by the department for collection and disposal of solid waste to be
paid by the owner, tenant, or occupant of each premise or parcel of land which shall use or be
served by such services and facilities, which rates and charges shall be payable monthly for
services rendered as follows:

(a) Residential dwellings.
(1) For residential units where solid waste is collected curbside in individual containers
(95 -gallon Z -Carts), twice per week, the monthly rate shall be as set forth in the rate schedule
incorporated herein.
(2) Missing containers / carts or severely damaged beyond repair shall be replaced at the
owner's / occupant's expense. The occupant / owner shall incur a Sixty Dollar ($60.00)
replacement fee to cover the cost of the container, delivery and processing. This applies to both
residential and commercial customers.
(3) Stolen carts shall require the owner to submit a stolen cart form to the Zephyrhills Police
Department for investigation and assignment of a case number. The Zephyrhills Police Department
will then forward the complete form to the sanitation department for cart replacement at the City's
expense. This applies to both residential and commercial customers.
(b) Commercial.
(1) For commercial premises where solid waste is collected curbside in individual
containers (95 -gallon Z -Carts), twice per week, the monthly rate shall be as set forth in the rate
schedule incorporated herein. For commercial premises served by refuse bins or dumpsters, the
monthly rate shall be the greater of the commercial curbside rate per business unit served, or a
monthly rate based on the volume of the refuse bin in cubic yards and the frequency of collection
per week as set forth in the rate schedule incorporated herein.
(2) The City may require the use of dumpsters in lieu of conventional garbage cans for
other than single family residential use.
(3) The number of pickups required by users, together with requirement as to container size
and capacity for dumpsters, shall be determined by the director.
(4) For installation of new containers, it is the responsibility of the customer to provide
adequate access and dumpster enclosure approved by the director, as set forth in Section 50.26(B).
(5) Refunds. There shall be no refund of any service charge prescribed herein on account
of partial vacancy.
(6) There may be a refund of service charges, not to exceed charges assessed for a one-year
period, for total vacancy of the premises provided that the owner of the premises requests the
refund from the department in writing and the department determines that no service has been
rendered from the premises for the period for which the refund is requested. No refunds or credits
are authorized for partial vacancies for sixty (60) days or less.
(7) Free service. There shall be no free services rendered by the department for the
collection, transportation or disposal of solid waste.
(8) Deposit: For commercial accounts, a deposit for solid waste services will be charged
equal to two times the monthly service charge. That deposit level must be maintained at all times.
The deposit amount shall adjust automatically on October 1 of each fiscal year to reflect the then -
current monthly service charge.
(9) Extra trips or pick-ups, or return trips due to over -spillage, shall be charged at a rate of
Fifteen Dollars ($15.00) per cubic yard times the size of the refuse bin for Fiscal Year 2027, with
said rate increasing to Fifteen Dollars and Seventy -Five Cents ($15.75) per cubic yard for Fiscal
Year 2028, Sixteen Dollars and Fourteen Cents ($16.14) per cubic yard for Fiscal Year 2029, and
Sixteen Dollars and Fifty -Four Cents ($16.54) per cubic yard for Fiscal Year 2030.
(10) Turn-on/turn-off fees. A fee shall be charged when residential or commercial service
is initiated or terminated. The turn -on and turn-off fee shall be Eighteen Dollars and Seventy -Five
Cents ($18.75) for Fiscal Year 2027, Nineteen Dollars and Sixty -Nine Cents ($19.69) for Fiscal
Year 2028, Twenty Dollars and Eighteen Cents ($20.18) for Fiscal Year 2029, and Twenty Dollars
and Sixty -Eight Cents ($20.68) for Fiscal Year 2030.

(c) Special Services.
(1) The term "special services" shall include but not be limited to the collection of yard
trash in excess of six (6) cubic yards per month; the collection of junk, bulky waste, white goods,
or rubbish not placed within containers or refuse bins; or the collection of yard trash, junk, bulky
waste, white goods, or rubbish from lots, or property not paying a monthly fee for collection
services.
(2) The additional charge for special services shall be Two Hundred Dollars ($200.00) per
hour, billed in quarter hour increments, plus the actual disposal charge.
