herein, BUILDER and BUYER agree as follows:
1. BUILDER agrees.to construct a residential dwelling and BUYER agrees
to employ BUILDER to construct the dwelling on property located at

2. THE CONTRACT DOCUMENTS. The General Conditions of the Contract,
the Specifications and the Drawings, together with this Agreement, form the
Contract, and they are fully a part of the Contract as if hereto attached or
herein repeated. The following is an itemization of other essential perti-
nent information:

3. BROKERAGE. BUILDER and BUYER acknowledge that this sale was
brought about solely by the sales personnel of BUILDER and that no outside
Broker or Registered Real Estate Broker, is entitled to a sales commission.
4. The dwelling is to be constructed thereon in accordance with plans
and specifications that have been approved and signed by BUYER and BUILDER,
and attached hereto and made a part hereof as EXHIBITIS "A" thru All
items considered standard by BUILDER except as noted are attached~EXHIBIT

5. PRICE. The purchase price for the dwelling to be paid by BUYER is

6. CONSTRUCTION. The dwelling shall be constructed pursuant to gen-
erally accepted standards of the construction industry and substantially
completed within 120 days of issuance of the building permit, or within a'
reasonable time thereafter, subject to delays and other conditions beyond
the control of BUILDER. BUILDER agrees to pursue construction of the dwell-
ing diligently to completion.
7. INSULATION. Insulation will be installed in the dwelling as follows:
(a) All block walls will be insulated with foam insulation to a thickness of
~ inches, which thickness, according to the manufacturer, will yield an
R-value of 1Y/&; all exterior frame walls be insulated with fiberglass batts,
which thickness, according to the manufacturer, will yield an R-value of ~;
(b) All ceilings, excluding garage, patio, and first floor of two-story home
ceilings will be insulated with blown in SAB insulation to a thickness of
t$ inches, which thickness, according to the manufacturer, will yield an
R-value of 2.<0.
8. LIMITED ONE-YEAR WARRANTY AND LIMITED DAMAGES. BUILDER shall
warrant, in writing, the dwelling construction against defects in workman-
ship and materials for a period of one (1) year from the date of occupancy
or closing, whichever first occurs, except to the extent such defects are
caused by the negligence or improper acts of BUYER OR ANY PERSON OTHER THAN
BUILDER. BUYER shall be obligated to notify BUILDER in writing at its office
in Zephyrhills, Florida, of any defects covered by BUILDER'S express warranty
on the dwelling and BUILDER shall make or authorize repairs as shall be nec-
essary to correct such defects, as promptly as is reasonable possible. ALL
EXPRESS WARRANTIES, ANY IMPLIED WARRANTIES WHETHER ARISING AND REQUIRED
UNDER THE MAGNUSON-MOSS WARRANTY ACT, INCLUDING WARRANTIES OF MERCHANTIBILI-
TY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO A PERIOD
OF ONE YEAR AS ABOVE SPECIFIED, AND BUILDER SHALL NOT BE LIABLE FOR ANY
CONSEQUENTIAL DAMAGES, CORRECTION OF DEFECTS AS SPECIFIED ABOVE SHALL CON-
STITUE FULFILLMENT OF ALL LIABILITIES TO BUYER, WHETHER BASED ON CONTRACT,
TORT, OR OTHERWISE.
9. SOLE AGREEMENT. THIS CONTRACT, TOGETHER WILL ALL ADDENDUMS HERETO,
IF ANY, SHALL CONSTITUTE THE SOLE AND ENTIRE AGREEMENT BETWEEN THE PARTIES.
NO AGREEMENTS, UNLESS EXPRESSED OR INCORPORATED HEREIN, SHALL BE BINDING
UPON AGREEMENTS MADE BY BUILDER, ANY AGENT OF BUILDER OR ANY BROKER OR SALES-
MAN SHALL BIND BUILDER UNLESS EXPRESSED HEREIN. The covenants contained
herein shall bind and the benefits inure to, the respective heirs, succes-
sors and permitted assigns of the parties hereto. BUYER'S obligations here-
under shall be joint and several. No amendment or modification to this
Contract, including without limitation, corrective or extra work, shall
be effective unless signed in writing by BUILDER and BUYER.
A blank copy of accepted "Change Order" is attached as EXHIBIT
10. BUILDER. GARY L. STEVE d/b/a G. L. STEVE CONSTRUCTION, signature
affixed hereon states and represents he is a State Certified Building Contrac-
tor, #CB-C022139, and is currently licensed, insured (including Worker's
Compensation) and is authorized to engage in the profession of a Building
Contractor in the State of Florida, County of Pasco, City of Zephyrhills, and
that he is responsible for obtaining all applicable permits - approvals _
including filing and posting the "Notice of Commencement" as required.
