work required by the contract documents to construct, finish,
and deliver to the Owners a residence on land owned by the Own-
ers, said land specifically described as:

Said residence shall be constructed in accordance with the con-
tract plans and specifications, and other conditions that may be
contained within this document. However, if any discrepancies
appear between the plans and the conditions and specifications
as presented here by the Contractor, it is understood that the
Contractors specifications and conditions shall govern.
1. CONTRACT SUM. The Owners promise and agree with the Con-
tractor that they will, In consideration of agreements being ex-
ecuted and performed by the Contractor as specified, payor
cause to be pai d to tile Contractor the sum of$..!()),J..QQ.~QQ............. as
the Contract Sum. Funds will become due and shall be paid to the
Contractor in accordance with typical financial institution con-
struction disbursement schedule. The total Contract Sum shall be
received by the Contractor prior to issuance of a Certificate of
Occupancy.
2. CONSTRUCTION CHANGE ORDERS. Any changes to the agreed docu-
ments, plans, or specifications, requested by the Owners shall
be submitted in writing to the Contractor and may be subject to
cost revisions. Any additional change cost shall be paid to the
Contractor at the time such changes are performed.
'3. It is agreed between Contractor and Owners that if the plans
provided for construction are deficient of any Code requirements
resulting in any additional cost of construction, the Owners
shall bear the additional reasonable cost of the requirements
for Code compliance.
4. Contractor agrees to visible inspect soil conditions at the
time of foundation preparation. However, if any underlying soil
conditions are determined to be unsuitable for foundation sup-
port, the Owners agree not to hold the Contractor responsible.
if soil test boring is required, the Owners shall bear all cost
of such test and additional cost required for corrective founda-
tion work.

5. SITE PREPARATION. There shall be an allowance of$.2?,Q~..Q.,Q
for clearing the property for the building. Upon completion of
construction. the Contractor shall clear the lot of construction
debris and fine grade the construction area to permit the in-
stallation of lawn and shrubs without the necessity of further
work, unless otherwise agreed to on the specification sheet.
6. Contractor shall proceed with construction expeditiously and
with due diligence in a good and workmanlike manner to complete
construction within 150 calendar days. In the event that con-
struction shall be delayed due to changes in plans, specifica-
tions. strikes, non-availability of materials, prolonged incli-
ment weather, or any other cause beyond the Contractors control,
there shall be a reasonable extension of time for completion of
construction and the Contractor shall be held harmless.
7. ALLOWANCES. The following represents cost based on normal
construction techniques utilizing quality materials and labor
and are included in the CONTRACT SUM. Upgrades from these allow-
ances shall be at the direction of the Owners in writing and any
additional cost shall be payable to the Contractor at the time
of installation into the building (change orders).

10. UTILITIES. The Contractor shall pay all utility bills as-
sociated with the construction during the period of construc-
tion. Owners shall assume responsibility of all utility bills
and accounts at the time of issuance of a Final Certificate of
Occupancy.
11. INSURANCE. The Contractor shall furnish Owners proof of
Builders Risk Insurance in the full amount of the Contract Sum,
Public Liability Insurance, and Workmans Compensation Insurance
prior to construction commencement and shall assure that all in-
surances are maintained throughout the construction period.
12. TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION. Subject
to the provisions of this contract, the Contractor agrees to
make all effort to start construction within la-days of con-
struction loan approval and closing, and to deliver the complet-
ed residence as specified herein within 150-days from the start
of construction. This contract is predicated on construction

if Owners have not authorized commencement of construction, this
contract is subject to cost revisions.
13. FINAL PAYMENT AND LIENS. It is agreed that the Owners
shall, prior to occupancy. make final payment, including any ex-
tras, to the Contractor. At the time of final settlement, an af-
fidavit of "NO LIENS" covering all materials and labor will be
tendered to the Owners/Lending Institution from the Contractor.
14. Owners and Contractor agree that this Contract for Con-
struction shall become null and void in the event that the Own-
ers are unable to obtain appropriate construction financing.
Neither party shall be liable to the other for any amount in the
event this Contract is cancelled, with the exception of cost in-
curred by the Contractor for design fees, material deposit, etc.
15. WARRANTY AND CORRECTION OF DEFECTS. The Contractor war-
rants to the Owners that all materials and equipment furnished
under this contract shall be new unless otherwise specified and
agreed, and that all work will be good quality, free from faults
and defects, and in accordance with the Contract documents.
If, within one (1) year after acceptance by the Owners and occu-
pancy of the residence, any of the work is found to be defective
or inoperative, the Contractor shall correct it promptly after
receipt of notice from the Owner. This obligation shall survive
termination of this agreement.
It is understood that the Contractor shall not be obligated be-
yond normal manufacturers warranties in effect at the time of
~aterials purchase.
Further commercial extended warranty programs are available at a
slight charge. (5-yr. and lO-yr. warranty programs).
16. This agreement shall be binding upon Contractor, its suc-
cessors and assigns, and on Owners, their heirs, personal repre-
sentatives and assigns.
By executing this Contract, the Contractor represents that he
has visited the site, familiarized himself with local conditions
under which the work is to be performed, and correlated his ob-
servations with the requirements of the contract plans, specifi-
cations, and documents.
