f. Plans not at job site.
g. Work not accessible.
The payment of inspection fees shall be made before any further permits will be issued to the person owning
same.

lawsuit to collect, which would have ~~ceeded the amount in question. In addition, you accused
me of trying to cheat you by colluding with Zephyr Masonry in a kick-back scheme to defraud
you. This is not the case. The invoices submitted by Zephyr Masonry were legitimate and very
reasonable, and they were passed on to you as received. for payment.
I agreed to reduce your invoice by $278. based on your calculation in your office of the above
labor difference being about $200., with the $78. being 10% of the $780. rebate from Zephyr
Masonry, which actually should have nothing to do with your invoice. It should be noted that the
$200. figure is wrong, it should have been $60.14. I agreed to the $200. figure without checking
due to the high emotional content of the discussion at that time.
The amount charged for the vermiculite, $400., was in error. It should have been $ 433.46
including $40. freight. I will include the difference on my next invoice.
Since the costs associated with the block wall collapse were shared between Zephyr Masonry and
Dade Design and Construction, in an effort to fmd a reasonable solution to these costs, after
negotiations we agreed that Zephyr Masonry would absorb approximately $780. of that cost, and
therefore the amount I would pay them for their work would be reduced by $780. None of the
costs of the collapsed wall have been charged to you, directly or indirectly.
I personally have spent many hours on your job and in transit to and from the job, only one hour
of which I have charged you since Feb. 22, 1995.
Because of the number of apparent problems you have stated and as outlined above, and the
fmancial costs to me, it is no longer possible for me to continue to conduct business with you, and
I hereby give notice that I plan to withdraw my men from further work on your premises effective
as of 5 pm on April 26, 1995, and as of that time Dade Design and Construction, Inc., will no
longer accept any responsibility for work done at or on your property.
