CONSTRUCTION CONTRACT
This contract entered into this 19th day of July, 1996, between Jack McCartney,
hereinafter referred to as OWNER, and Centre-Mark Corporation" a State Certified
General Contractor (lic, # CGC043354), hereinafter referred to as BUILDER, in
consideration for the promises, covenants, and agreements contained hereafter, hereby
agree to the following:
1,) BUILDER shall be required to construct the addition as per the attached, signed
blueprints and specification list indicate, furnishing labor, material, and services as
described below and/or attached herewith on the following real property located
in Pasco County, Florida, legally described as: E 1/2 of Tract 3, Zephyrhills Colony Co,
Lands commonly called Yingling's Addition, Plat Book 2, Page 16, Pasco County
records,
And to construct said structure in a workmanlike manner for the price and terms set
forth below.
ADDITION PRICE PER A TT ACHED SPECIFICATIONS
$18,354.12
2.) BUILDER shall pay for building permits and government inspections necessary for
the completion of this project.
3,) BUILDER shall strive and diligently seek to complete construction within 150
calendar days from actual ground breaking, Should this time schedule be delayed due to
government authority, weather, vandalism, acts of the owner, or change orders submitted
by same, the time for completion shall be extended by the amount of time caused by
such delay,
4.) BUILDER shall provide liability insurance and workman compensation insurance as
required by law, including injury or death to workman, OWNER shall provide fire and
extended coverage insurance in the amount of the full insurable value of the building
and materials during the construction period,
5,) BUILDER shall have exclusive occupancy of said house until OWNER has accepted
construction, and full payment under the terms of this contract has been made to
BUILDER. If OWNER occupies before acceptance and final payment has been made,
said occupancy by OWNER shall be construed as OWNER acceptance and BUILDER
shall be entitled to full payment.
6,) The contract price of$18,354.12 shall be paid to the BUILDER as follows:
$2,000,00 at contract signing
$2,500.00 at slab pour
$3,000.00 at lintel pour
$3,000.00 at dry-in
$3,000,00 at electrical and mechanical rough-in
$3,000,00 at drywall finish/painting 90% complete
$1,854,12 at Certificate of Occupancy
CHANGES DURING CONSTRUCTION
7,) OWNER shall be allowed during construction to make changes in the plans and
specifications, Said changes MUST be in writing and signed by the BUILDER and
OWNER. An administration charge of $50,00 may be charged by the BUILDER for
each change requested, Any changes requiring additional costs must be paid for at that
time, If the change requires a deletion, the BUILDER shall credit the amount agreed
upon to the contract price.
8,) It is the OWNERS responsibility to review and SIGN a final copy of all plans and
specifications prior to commencement of work by the BUILDER. The BUILDER shall
not be responsible for anything deleted from those plans and specifications IF NOT
SIGNED BY OWNER. This contract contains the ENTIRE AGREEMENT between both
parties, ANY matters discussed during negotiations but not included specifically in these
plans and specifications are EXCLUDED,
9,) The contract price shall remain in effect for a period of 30 days from the date of
contract signing. If commencement of work has not begun within that time there may be
an increase in price, if through no fault of the BUILDER, cost increases are i,ncurred for
labor and/or materials, Any increase shall be determined by the BUILDER at the time of
commencement and shall be submitted to OWNER in writing, Should BUILDER
require a price increase, OWNER shall have the option to cancel contract within 10
calendar days via written notice to BUILDER. Any deposit made to BUILDER shall be
returned to OWNER within 10 calendar days of receipt of written notice,
10,) OWNER shall be personally liable for all amounts due BUILDER per this
contract. Any amounts due shall accrue interest at a rate of 12% per annum from date due
until paid, Should it become necessary for BUILDER to collect said payments through
an attorney, OWNER hereby agrees to pay all reasonable fees associated with such
collections, including, but not limited to attorney fees,
11.) The words "OWNER" and "BUILDER" herein employed shall be construed to be
the plural as well as the singular,
12.) If this contract is not executed by July 20, 1996, this contract shall be come void,
and deposited funds from OWNER shaH be returned. The date of this contract shaH be
the date signed by the BUILDER
13.) This contract shaH be binding upon the heirs, executors, administrators, successors,
and assigns.
