B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, they lay be required to be licensed in accordance with
state and local regulations. If the contractor is not licensed as required by law, both the owner and contractor lay be
cited for a lisdeleanor violation under state law. If the owner or intended contractor are uncertain as to what licensing
requiretents lay apply (or the intended work, they are advised to contact the City of ZephyrhillsBuilding Departlent, (813)
788-6611.
Furtherlore, if the owner has hired a contractor or contractors, he is advised to have the contractor(s) sign portions of the
"Contractor Sections. of this application for which they will be responsible. If you, as the owner sign as the contractor,
you are indicating that you, rather than the contractor, are responsible for the work. If the contractor wishes you to sign
as contractor that lay be an indication that he is not properly licensed and is not entitled to perlitting privileges in the
City of Zephyrhills.

Contractor may cease work without breach pending payment or resolution of any dispute.

The Energy Code compliance permitting process is shown in graphic form on the
chart on page 12.
Properly completed Code compliance calculations for commercial buildings and
multifamily highrise buildings have three required signatures: (1) the
architect, engineer or HVAC contractor (where allowed under Florida law)
certifying that the plans and specifications show the buillding to be in
compliance with the Code, (2) the building's owner, architect or the owner's
officially designated agent certifying that the building will comply with the
Code, and (3) the building official assuring that the compliance forms are
adequate.
o Architects, engineers and others entitled by Florida law
(Sections 481.229 and 471.003, Florida Statutes) to design air
conditioning or 'mechanical systems for a building may sign Forms
500A-91 and 5008-91 and Forms 800A-91 and 8008-91 certifying that
the building, as represented by the plans and specifications for
that building, is in compliance with the Code. Criteria by which
"others" may design mechanical systems under Florida law are
listed below.

Buildings not requiring preparation of calculations by a
registered architect are as follows:
1. Anyone or two family dwelling, townhouse, or domestic
outbuilding appurtenant to anyone or two family dwelling,
regardless of cost;
2. Any building on a farm for the use of any farmer,
regardless of cost; and,
3. Any other type of building whose cost is less than $25,000,
except a school, auditorium or other building intended for
public use.
8uildings not requiring preparation of calculations by a
registered engineer that can be certified by an air conditioning
or ~cha~iC_U_~~!nJractor with a 1 icense issued under Chapter 489
or partt of Chapter--S53, are as fo 11 ows:
1. Where the air conditioning system has a value of
$50,000 or less and does not exceed a 15 ton per system
capacity, or is designed to accommodate 100 or fewer
persons.
2. Is less than 5,000 square feet in floor area and is
designed for public assembly.
o Owners or their "officially designated agent" must sign that
the building will comply with the Florida Energy Code. Most
commonly, this is the project's architect. This does not mean
that the architect must actually perform the Code compliance

Dear David:
To date there are still a few issues that need to be addressed
concerning the above referenced project.
A letter from Towson & Rodgers indicating that the above site will
retain its own storm runoff (swale in right-of-way).
Also trees required on approved site plan shall meet all land
development code requirements, size and location. Trees shall be
minimum 8 to 10 feet tall and 2" diameter and shall not be planted
in City right-of-way.
Please make necessary corrections by November 1, 1997 to avoid any
potential fines and to receive certificate of occupancy.
