REINSPECTION FEES: When extra inspection trips are necessary due to anyone of the following reasons, a
charge of Fifteen and 00/100 Dollars ($15,00) shall be made for each trip for each trade:
a. Wrong Address
b. Condemned work resulting from faulty construction.
c, Repairs or corrections not made when inspection called.
d. Work not ready for inspection when called.
e. Permit not posted on job site.
f. Plans not at job site.
g. Work not accessible.
The payment of inspection fees shall be made before any further permits will be issued to the person owning
same.

referred to as the Contractor, party of the first part, and Dr.
Madhava Pally
Zephyrhills. Florida 33541

WITNESSETH: That for and in consideration of the sum of
S480.00 (Four Hundred Eiqhtv Dollars & no cents) .
paid by the Buyer to the contractor, receipt whereof is hereby
acknowledged, and in further consideration of the mutual promises,
covenants and agreements hereinafter contained, it is covenanted,
stipulated and agreed by and between the parties hereto as follows,
to wit:
FIRST: The Contractor agrees to furnish all material and to
provide all of the labor and services which may be necessary and
required in order to join 2 existinq waitinq rooms

building (hereinafter referred to as "building") for the Buyer on
the premises in
Pasco
County, Florida, ~escribed as:

Zephyrhills, Florida 33541
and to build and construct said building in a workmanlike manner,
and in full and strict compliance with the plans and,specifications
prepared therefore and any general or special conditions attached
to said plans and specifications (all being hereinafter referred to
as plans and specifications) and on file with the signature of the
Contractor and the Buyer and made a part hereof. The Contractor
further agrees to pay for all labor, material or services used,
performed and furnished in connection with the cons~uction of said

building, and upon completion to deliver same to the Buyer freed
and discharged of all claims or liens of whatsoever nature and
description growing out of or in connection with the use,
performance or furnishing of such labor, material or services.
SECOND :
The Contract price for the Construction of said
building in accordance with the agreement is hereby fixed at
$3.200.00 (Three Thousand Two Hundred Dollars & no cents)
which sum will be paid the Contractor as hereinafter provided.
The cost of building permits, preparation of plans, if any have
been included in, the contract price.
THIRD: The balance of $2.720.00 (Two Thousand Seven Hundred
twenty Dollars & no cents)
shall be disbursed to the Contractor as follows:

FOURTH:
No change or alteration in said plans and

specifications and the work to be done thereunder, which shall
increase or decrease the contract price hereinbefore fixed; shall
be made without the joint written consent of the Buyer and the
Contractor.
FIFTH:
The
Contractor agrees that he will commence
construction of said building within
five
days after issuance
of Building Permit and recording of Notice of Commencement.
Contractor shall complete, finish and deliver said building to the
Buyer in accordance with said plans and specifications and the
Agreement, in no event later than thirty
calendar days after

commencing construction, unless such time is extended by mutual
agreement of the Contractor and Buyer. Time for completion shall
be extended according to delays caused by an act of God, inclement
weather, strike or other causes beyond the control of the
Contractor.
SIXTH:
The Contractor agrees in the' construction of said
building to comply with all restrictions and reservations of record
and to comply with and carry out the provisions of any and all
applicable municipal, state or Federal building code or codes, laws
or ordinances.
SEVENTH: Any work done or materials used in construction of
said building not in accordance with plans and spec~ficati~~s shall
be replaced by the Contractor at his own expense upon demand of the
Buyer. Defective materials installed by the Contractor or his Sub-
contractors will'be replaced by the Contractor at his expense for
a period of one year after issuance of the Certificate of
Occupancy.
EIGHTH:
At least five (5) working days prior to the
Contractor Obtaining the Certificate of Occupancy, Contractor shall
notify the Buyer in writing that the premises have been
substantially completed and are ready for Buyer's inspection.
Buyer shall then advise the contractor, ei ther orally . or in
writing, when they shall make their inspection. At the end of the
Buyer's inspection, the Buyer may give the Contractor a list of
alleged defects in the improvements, which shall hereinafter be
referred to as the "punch list". After obtaining certificate of
occupancy and upon issuance of a "punch list" amo~ts equal to 95%
of the contract will be paid to the Contractor. The balance of 5%
shall be retained by the buyer until satisfactory resolution of the
"Punch list". Contractor shall review the "punch list" with the
Buyer, examine the improvements and shall have the option of either

curing any defect, making an allowance for any defect or advise the
Buyer that the Contractor does not consider any given "punch list"
item to be a defect for which it is responsible. In the latter
case, the parties shall attempt, in good faith, to negotiate any
amicable resolution to any disagreement they may have.
If the
parties are unable to reach an amicable resolution, either party
may bring the matter before a Court of competent jurisdiction.
Nothing herein shall be construed to eliminate, modify or in any
way affect any ~egal right or remedy that either 'party may have
under the Laws.of the state of Florida.

B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner hiS hired a contractor or contractors to undertake work, they lay be required to be licensed in accordance with
state and local regulations. If the contractor is not ,licensed as required by law, both the owner and contractor lay be
cited for a lisdeleanor violation under state law. If the owner or intended contractor are uncertain as to what licensing
requireaents aay apply for the intended work, the~ are advised to contact the City of Zephyrhills Building Departlept, (813)
788-6611. '
Furtheraore, if the owner has hired a contractor or contractors, he is advised to have the contractor!s) sign portions of the
"Contractor Sections- of this application for which they will be responsible. If you, as the owner sign as the contractor,
you are indicating that you, rather than the contractor, are responsible for the work. If the contractor wishes you to sign
as contractor that lay be an indication that he is not properly licensed and is not entitled to perlitting privileges in the
City of Zephyrhills.

addressing a -cotpensating volute- will be subtit~ed which is prepared by a professional engineer registered in the State of
Florida prior to peni t issuance. .
A pertit issued shall be construed to be a license to proceed with the work and not as authority to violate, cancel alter, Dr
set aside any provisions of the technical codes, nor shall issuance of a perait prevent the Building Official froa thereafter
requiring a correction of errors in plans, construction, or violations of any code. Every perlit issued shall becole invalid
unless the work authorized by such per.it is cottenced within six tonths of issuance, or if work authorized by the perlit is
suspended Dr abandoned for a period of six lonths after the tite the work is cO.lenced. One 90 day extension of tile, lay be
allowed for the pertit with fee charge of $15.00. The extension shall be requested in writing to the Building Official. An
approved inspection lust be logged during each six tonth period, or the project will be considered abandoned.
