ARTICLE 2 THE WORK The Contractor will perform the entire Work as described in the Contract Documents, except to the extent specifically indicated in the Contract Documents to be the responsibility of others. ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION The date of commencement is the date from which the Contract Time is measured, and will be the Effective Date written above, unless provision is made for the commencement date to be fixed in a notice to proceed issued by the Company. Unless the commencement date is established bv a notice to proceed issued by the Companv, the Contractor must notifv the Company in writing not less than five (5) days before commencing the Work to permit the timely liling of mortgages, mechanic's liens and other security interests. The Contractor mllst achieve Final Completion of the Work not later than thirty (30) days after the date of commencement (the "Contract Time"), subject to adjustments to the Contract Time as provided in the Master Agreement. The Contract Swn will be paid during the Progress Billing Period, upon Contractor's Application for Payment, as follows: 1. Sixty percent (60%) of the Contract Swn will be payable when the Work is approximately f1fty percent (50%) complete. The determination of when the Work is fifty percent (50"/0) complete will be determined by mutual agreement between the Company and the Contractor. 2. Forty percent (40%) of the Contract Swn will be payable upon Final Completion of the Work in accordance with the Contract Documents. Payment of Applications for Payment will be made as provided in the Master Agreement or elsewhere in the Contract Docwnents. Any disputes between Contractor and the Company as to payments to be made or percentage of completion of Work will be resolved as provided in the Master Agreement. Each Application for Payment must be based upon the schedule of values submitted by the Contractor in ac<:oordance with the Contract Documents. The schedule of values must allocate the entire Contract Sum among the various portions of the Work and be prepared in su(;h form and supported by su(;h data to substantiate its au:ura(;y as the Company may require. Equipment cabinets will be installed on the ground to service the antennas. The existing tower was recently purchased by Crown Castle and is located at 702 Avenue "A" Zephyrhills, Florida 33540. Attached for your review are two sets of construction documents sealed January 2, 2001 and a structural certification dated July 17, 2000. Please review the attached documents in anticipation of the issuance of a building permit to perform the co-location work. Sprint intends to select a General Contractor (GC) in the near future. Once the GC is selected, your office will be provided with additional information. The selected GC will be responsible for finalizing the building permit application. Since the load on the anchor bolts is being reduced significantly by removing the unused platforms on the tower, and will be subjected to about 60% of their capacity, the existing foundations are adequate to support the proposed loads for this tower. This conclusion is based on the assumption that the foundations were constructed in accordance with the design drawings prepared for the construction of this tower.
