The Contractor and City of ZephyrhUIs as Owner entered into a certain Contract in writing,
for a project known as Groft" U....r I."rove__ts Bid File #11--.17 , (the Project).
Contractor is required to furnish certain labor and materials and to perfonn certain construction in accordance
with the con1ract for the Project which collectively ae hereinafter referred to as the "Construction Contract".
By ibis Contract, the Contractor and Owner set forth the terms and conditions under which the Contractor
is to perform certain of tile work required to be done under the Construction Contract, as itemized below.

1. The Contractor shall provide all insurance's, materials, equipment, services and any other items necessary
to fully complete the work set forth in Paragraph A (the Work). Contractor shall, at its own expense,
secure allliconses, furnish all labor, material, plant, tools, equipment, machinery, scaffolding,.
cartage, and provide all things and personnel necessary for the full and, diligent prosecution
thereof. aU in compliance with applicable statutes, ordinances and regulations and in a first class
workmanlike manner in .strict accordance with the requirements of the Construction Contract as well
as the directions of the Owner, and to the satisfaction oftbe Owner.
2. The Contractor acknowledges that no representations as to the Work have been made by the Owner,
or by anyone on its behalf, except as in this Contract expressly set forth, and the Contractor wammts and
represents that it has visited the site of the proposed work and has familiarized itself with existing conditions
and the charactet of the operations to be carried on under he Construction Contract and that it fully
understands the facilities, difficulties, and restrictions attending the execution of the Work undetthis
contract; the contractor acknowledges that it has examined the Construction Contract, lUld the requirements
of the various governmental agencies, departments and bureaus havingjwisdiction, and from its own
investigations bas satisfied itself as to the nature and locatioo of the work, the general and local conditions,
and all matters which may in any way affect the Work or its performance,. and the Contractor agrees that it
will not make any claim for or have any right to, damages because of any misinterpretation or
misunderstanding of the ConstruCtion Contract or because of any lack of infonnation or because of
any incorrect information or inaccuracies contained or conveyed by any diagraJns, drawings, surveys,
maps or samples, or by reason of any conditions (subsurface or otherwise) at the site which are not
disclosed thereby unless Contnlctor obtains additional compensation from the Owner for such Wark.
3. Contractor shan be responsible for supervision, coordination of its sub-trades, and all actions
reasonably required to complete the Work even if not specifically shown in the plans and specifications
but can be reasonably inferred.
4. Contractor shall provide technical services as required or specified to effect the operation of equipment
and/or mfttenld fllmi!l.herl under thi!l; Agreement, including perfonnance of specific testina. if any, and
shall instruct the Owner's personnel in the operation, maintenance and control of such equipment.
.5- Contractor acknowledges its requirement under this Agreement to coordinate its Work with services,
materials and/or equipment to be furnished by others to ensure a completely compatible system.
Accordingly, the Contractor shall review the existing conditions and the product data of all items
requiring integration's and compatibility with the Work required hereunder.
6. Subcontractor shall be liable for any damages to adjacent surfaces caused by its Work, either
accidentally or through negligence.
7. Contractor shall provide and be responsible for layout. including the accuracy thereof. necessary for
the performance of its Work required..
8. Contractor shall perform all cutting. fitting. patching, sleeving. grouting and sealing oCtile Work that
may be required to fit it to, receive, or be received by the Work of others shown upon, or reasonably
implied by, the Contract Documents.
9. This Agreement if for the construction/installation of a complete functioning system OT systems,
complete with all interfaces, interconnections and coordination required to cause the Work of this
Agreement to function in bannony with all other aspects of the Project.
10. The Contractor may at any time order the teinporary suspension of the work to be performed herein.
Additionally, if the Owner shall at any time order the suspension of the work, the Contractor may order the
Subcontractor to suspend until such time as the Owner orders the Contractor to proceed. The Contractor
shall not be liable and the Subcontractor shall have no claim for damages for any delay, suspension or
interruption of the work caused by any reason. The Subcontractor's sole right and remedy for delay in
the work for any case shall be the right to request an extension of time to complete the work for any

be in writing within 10 days of the commencement of the cause of such delay. Such request should
specify the alleged conditions and causes of the delay and indicate the amount of time extension required..
The determination of granting such extension shall be at the sole discretion of the Contractor.
11. The Contractor shall employ only such labor as will not cause delays, stoppages or strikes upon the work
to be performed by any of tile trades working on or about the site.
12. Upon the Owners request. the Contractor shall immediately furnish a bond executed by it with a fidelity OT
surety company authorized to transact business in the State of Florida, in form and amount satisfactory to the
Owner, guaranteeing the faithful perfonnance of this Contract and the prompt payment of all claims of its
laborers and material men.
13. The compensation payable to the Contractor hereunder shall not be increased because of the imposition of any
taxes, or of increases in the price of any labor, material or services.
14. During perfonnance and up to the date of final acceptance of the work by the Contrad:or and Owner, the
ContractOr shall be solely responsible for the protection of the person and property of others on or adjacent to
the site from damage, loss or injwy resulting from the performance of the Work hereunder or the condition of the
site. The Owner shall, in any case, be liable for any damage caused to any property by whomsoever owned, nor
shall the Owner or in part, to any person by the act or omission of the Contractor. its officers, directors. employees,
agents, subcontractors, or invitees whether or not the Conttactor or Owner has itself or themselves been guilty of a
negligent act or omission contributing to the damage or injury. The Contractor shaU indemnify and save hannless
the Owner from any liabilities whatsoever on account of such damage, injwy or dea1h, and shall reimburse the Owner
for the amount of aU reasonable expenses, including attorney's fees, paid or incurred for the defense against any
suite or claim asserted against them on account of any such damage, injwy or death. or incurred in the enforcement
of the indemnity contained herein. The liability of the Contractor hereunder, and the indemnity given in connection
therewith, shall include any damage, injury or death resulting from the use of tile Contractor, its officers, directors,
employees, agents and resulting from the use of the Contractor. its officers, directors, employees, agents and
invitees of any hoist, conveyance, scaffold. derrick or other equipment which is either owned or rented by the
Contractor of for the use of which the Contractor may be liable. regardless of whose employee or agent shan be
operating such equipment; and it shaJl be the Contractor's duty to inspect such equipment and assure the safety
thereof.
15. The Contractor shall indemnify and save bann)ess the Owner nom any patent infringement claim based upon the
manufacture, saJe or use of any material or appliance furnished by the Contractor, and shall defend all actions arising
out of the same and pay all counsel fees and expenses in connection therewith.
16. The Owner shall in no event be liable or responsible for any damage, theft or loss to the Contractor's work, material,
equipment or other things~ and the Contractor shall indemnify and hold the Owner harmless from any liability, loss
or damages arising out of or in connection with such damage. by whomsoever caused. Such indemnity shall include
reimbursement to the Owner of all reasonable expenses and costs including attorney's fees, which they may pay
or incur in order to defend against any claim for such damage, or incurred in the enforcement of the indemnity
contained herein. The liability of the Contractor under this paragraph shall be absolute, notwithstanding any negligent
act or omission on the part of the Owner. Ten Dollars ($10.00) of the sums payable hereunder is specific
consideration for this indemnity.
17. The Contractor shall keep and maintain the site free of all debris and litter caused by its WotIc during the progras
thereof. After final completion and aceeptance of the work, the Contractor shall forthwith remove all surplus material,
scaffolding. apparatus, machinery, tools, and equipment furnished by it and shall remove all liter and debris caused
by its work. In the event the Contractor shall at any time fail to remove litter or debris from the site within three (3)
days after the receipt of notice so to do from the Owner, then the Owner may itself do so and charge the cost thereof
to the Contractor against any sums due or to become due to it.
18. Anything in this Contract to the contrary notwithstanding, if the Owner has not yet awarded. the Construction Contract
to the Contractor, this C;ontraet shall be conditioned upon such award, the execution of the Construction Contract by
the Owner and the Contractor, and the Contractor's perfonnance of all conditions to the effectiveness of the
Construction Contract provided therein. In the event of such award and the execution of the Construction Contract.
the date of such ConstnlCtion Contract shalJ be deemed incorporated in the space provided for that purpose at the
outset of this Contract. 10 the event the Construction Contract is not awarded, executed or no Notice to Proceed is
provided to the Contractor, this Contract shall be null and void and neither of the parties hereto shall have any claim
against the other.
19. The Contnlct constitutes the entire understanding of the parties, and no representations or agreements of
Representations any kind have been made except as specifically berein contained and incorporated. This Contract
may not be canceled, waived or modified. by the Owner ex.cept by an instrument in writing signed by one of its
officers. No waiver by the Contractor or Subcontractor of any provision of this Contract or breach thereof shall
operate or be construed as a waiver of any other subsequent breach or other provision.
20. The Contractor agrees that he will comply with all applicable safety rules and regulations as issued by the State
Industrial Commission, Federal Safety and Health regulations, or other appropriate authority.
21. Time for Completion is 60 working days.

A. NOTICE OF DEED RESTRICTIONS
The undersigned understands that this permit may be subject to udeed restrictions" which
may be more restrictive than City regulations. The undersigned assumes responsibility for
compliance with any applicable deed restrictions.
B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by law, bo~h the owner and contractor may be cited for a misdemeanor
violation under state law. If the owner or intended contractor are uncertain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephyrhills Building Department, 813-788-6611.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the
contractor(s) sign portions of the uContractor Sections" of this application for which they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, rather than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indication that he is not properly licensed and is
not entitled to permitting privileges in the City of Zephyrhills.

Application is hereby made to obtain a permit to do work and installation as indicated. I
certify that no work or installation has commenced prior to issuance of a permit and that
all work will be performed to meet standards of all laws regulating construction, City
codes, zoning regulations, and land development regulations in the jurisdiction. I also

understood that a drainage plan addressing a ucompensating volume" will be submitted which
is prepared by a professional engineer registered in the State of Florida prior to permit
issuance.
A permit issued shall be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any provisions of the technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for a
period of six months after the time the work is commenced. One 90 day extension of time
may be allowed for the permit with fee charge of $15.00. The extension shall be requested
in writing to the Building Official. An approved inspection must be logged during each six
month period, or the project will be considered abandoned.
