(b) Once labor, services and/or materials are commenced,Permaguard Industries, Inc. will be entitled to actual damages upon Purchaser's breach of the contract. (Actual damages are defined as the actual cost of labor, services, and/or materials 'to the date of the breach of contract, plus 10%). 5. Attorney's Fees. In the event it becomes necessary for Permaguard to enforce any part of this contract and should Permaguard prevail, Purchaser agrees to pay Permaguard's reasonable at1orney's fees and all costs of this action. 6.
