Re: Badcock Furniture Site Visit

Rick and I visited the above-mentioned site this afternoon and provide the following
comments that will need to be addressed prior to approval:
1.) Letter from engineer stating all construction is in compliance with the
approved site plan;
2.) Area along retention pond in new parking lot is being undermined and needs
to be fixed;
3.) The entryway off 6th Street is supposed to be 24 feet in width with ingress and
egress. The width appears smaller and is marked as ingress only;
4.) Two oak trees along 9th Avenue appear to be dead;
5.) Landscaping beginning at SW comer running north to entrance on 6th Avenue
and a little beyond the entrance has not been planted.
Please let us know when these deficiencies have been completed and Rick and I will sign
off on the DO.

On Juu.ary 14, 2002 our office visited the site of the expanded Badcock: Fu:roi:ture Store
on 6th Street. The parlcing lot and percolation ponds were basicaUy constructed as
designecl It had raiDed a few days prior to the day of the inspection and a portion of the
socl on 1he si4e oftbe ~n pond in the parking lot had slufted into the pond. A small
ponioo otthe ~ in the slope of the basin along the west side of the building bad 11150
sluffed. In the event b&th areas bave been (l()[T'ectc:d the pcoject is herein ~led.
We believe this probleQ1 would DOt bave occurred had the sod had tUne to take foot_

Re: Badcock Addition and Remodeling Project - Zephyrhills
Recently we made a change in the interior wall construction for both the addition and the new walls
in the existing portion of this building. Please let me know if this will meet with your approval.
Per the drawings, sheet A-4, the new walls were to be constructed using 3-1/2" metal studs at 16"
a.c. We are changing the wall construction to standard 2 x 4 wood studs at 16" O.c. This would
be consistent with building Type IV Unprotected Construction and 704.2.3.1
"Partitions dividing portions of stores, offices or similar places occupied by one tenant only,
which do not establish an exit access corridor serving an occupant load of 30 persons or
more, and partial partitions, may be temporary or permanent and constructed in accordance
with 609 without fire resistance, provided that:
1. Their location is restricted by their method of construction or by means of permanent
tracks, guides or other approved methods.
2. Flammability shall be limited to materials having an interior finish classification as set
forth in Table 803.3 for rooms or areas. Per 803.3, interior finish classification for
"Other Spaces" shall be Class c."
The new fire wall between the warehouse and retail spaces will be in accordance with UL Design
U333 (see sketch attached). Thru wall penetrations in this fire wall will be per the attached UL
designated systems No. W-L-1120 and No. W-L-2134.
In accordance with the original drawings, the exterior walls will have %" PT furring strips.

1. Wall Auembly- The fire-rated ~ypsum ~allboanJjstud wa~l. ass~mbly

individual U300 or U400 Series Wall and Partition Designs in the UL Fire
Resistance Directory and shall include the following construction features:
A. Studs-Wall framing may consist of either wood studs or steel
channel studs. Wood studs to consist of nom 2 by 4 in. lumber spaced
16 in. oc. Steel studs to be min 2-1/2 in. wide and spaced max 24 in.
DC. The opening in the wall to accommodate the through penetrant
(Item 2) shall be framed on all sides within the stud cavity using short
lengths of stud installed between the vertical stud members.
B. Wallboard. Gypsum*-One layer of nom 5/8 In. t~i.ck gyp~um
wallboard. as specified in the individual Wall and PartItIon ~eslgn.
Max diam of opening is 22 in. for steel stud walls. Max dlam of
opening is 14-1/2 in. for wood stud walls.
2. Steel Wire Mesh-Cylindrical sleeve fabricated from No.8 steel wire
mesh and having a min 1 in. lap along the longitudinal seam. Length
of steel wire mesh to be 1/2 in. less than thickness of the wall. Steel
wire mesh to be centered and formed to fit periphery of through
opening.
3. Through Penetrants-One metallic pipe. conduit or tubing to be installed
either concentrically or eccentrically within the firestop system. The
annular space between pipe, conduit or tubing and periphery of opening
shall be min 0 in. (point contact) and max 2 in. Pipe, conduit or tub!ng
to be rigidly supported on both sides of wall assembly. The follOWIng
types and sizes of metallic pipes. conduits or tubing may be used:
A. Steel Pipe-Nom 20 in diam (or smaller) Schedule 10 (or heavier)
steel pipe.
B. Iron Pipe-Nom 20 in diam (or smaller) cast or ductile iron pipe.
C. Conduit-Nom 4 in. diam (or smaller) electrical metallic tubing or
steel conduit.
D. Copper Tubing-Nom 2 In. diam (or smaller) Type L (or heavier)
copper tubing.

4. Flrestop System-The firestop system shall consist of the following:
A. Packing Material-Min 3-1/4 in. thickness of min 4.5 pcf mineral
wool batt insulation firmly packed into opening as a permanent form.
Packing material to be recessed from both surfaces of wall as required
to accommodate the required thickness of fill material.
B. Fill. Void or Cavity Material*-Caulk-Min 1/4 in. thickness of fill
material applied within the annulus. flush with both surfaces of wall.
At the point contact location between pipe and wall, a Olin 1/4 in.
diam bead of fill material shall be applied at the wall/pipe interface
on both surfaces of wall.

A permit issued shall be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any provisions of the technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for a
period of six months after the time the work is commenced. One 90 day extension of time
may be allowed for the permit with fee charge of $15.00. The extension shall be requested
in writing to the Building Official. An approved inspection must be logged during each six
month period, or the project will be considered abandoned.

1. If the ownership of the project area covered by the subject permit is divided, with someone other
than the Permittee becoming the owner of part of the project area, this permit shall terminate,
pursuant to Section 40D-1.61 05, FAC. In such situations, each land owner shall obtain a permit

3. Unless specified otherwise herein, two copies of all information and reports required by this permit
shall be submitted to:

The permit number, title of report or information and event (for recurring report or information
submittal) shall be identified on all information and reports submitted.
4. The Permittee shall retain the design engineer, or other professional engineer registered in Florida,
to conduct on-site observations of construction and assist with the as-built certification requirements
of this project. The Permittee shall inform the District in writing of the name, address and phone
number of the professional engineer so employed. This information shall be submitted prior to
construction.
5. Within 30 days after completion of construction of the permitted activity, the Permittee shall submit
to the Brooksville Service Office a written statement of completion and certification by a registered
professional engineer or other appropriate individual as authorized by law, utilizing the required
Statement of Completion and Request for Transfer to Operation Entity form identified in Chapter
40D-1, FAC., and signed, dated, and sealed as-built drawings. The as-built drawings shall identify
any deviations from the approved construction drawings.
6. The District reserves the right, upon prior notice to the Permittee, to conduct on-site research to
assess the pollutant removal efficiency of the surface water management system. The Permittee
may be required to cooperate in this regard by allowing on-site access by District representatives,
by allowing the installation and operation of testing and monitoring equipment, and by allowing other
assistance measures as needed on site.
7. For dry bottom retention systems, the retention area(s) shall become dry within 72 hours after a
rainfall event. If a retention area is regularly wet, this situation shall be deemed to be a violation of
this permit.
8. The operation and maintenance entity shall submit inspection reports in the form required by the
District, in accordance with the following schedule.
For systems utilizing retention or wet detention, the inspections shall be performed two (2) years
after operation is authorized and every two (2) years thereafter.
9. If limestone bedrock is encountered during construction of the surface water management system,
the District must be notified and construction in the affected area shall cease.
10. The Permittee shall notify the District of any sinkhole development in the surface water management
system within 48 hours of discovery and must submit a detailed sinkhole evaluation and repair plan
for approval by the District within 30 days of discovery.

ARTICLE 1 THE CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement, Conditions 01 the Contract (General,
Supplementary and other Conditions), Drawings. Specifications, Addenda issued prior to
execution of this Agreement, other documents listed in this Agreement and Modifications issued
after execution of this Agreement; these form the Contract, and are as fully a part of the Contract
as if attached to this Agreement or repeated herein. The Contract represents the entire and
integrated agreement between the parties hereto and supersedes prior negotiations, representa-
tions or agreements, either written or oral. An enumeration of the Contract Documents, other
than Modifications, appears in Article 8.
ARTICLE 2 THE WORK OF THIS CONTRACT
The Contractor shall fully execute the Work described in the Contract DOCuments, except to the
extent specifically indicated in the Contract Documents to be the responsibility of others.
ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION
3.1 The date of commencement of the Work shall be the date of this Agreement unless a
different date is stated below or provision is made for the date to be fixed in a notice to proceed
issued by the Owner.

ARTICLE 4 CONTRACT SUM
4.1 The Owner shall pay the Contractor the Contract Sum in current funds for the Contractor's
performance of the Contract. The Contract Sum shall be Three hundred Fourty-eight
Thousand, Five hundred Sixty-seven Dollars ($348 ,567 ),
subject to additions and deductions as provided in the Contract Documents.
4.2 The Contract Sum is based upon the following alternates. if any. which are described in the
Contract Documents and are hereby accepted by the Owner:
(State the numbers or other identification of accepted alternates. If decisions on other alternates are to be made
by the Owner subsequent to the execution of this Agreement, attach a schedule of such other alternates showing
the amount for each and the date when that amount expires.)
4.3 Unit prices. if any. are as follows:
An allowance of Five Thousand(S,OOO) dollars is included
in the base bid for Landscape as enumerated in Addendum # 3.
ARTICLE 5 PAYMENTS
5.1 PROGRESS PAYMENTS
5.1.1 Based upon Applications for Payment submitted to the Architect by the Contractor and
Certificates for Payment issued by the Architect. the Owner shall make progress payments on
account of the Contract Sum to the Contractor as provided below and elsewhere in the Contract
Documents.
5.1.2 The period covered by each Application for Payment shall be one calendar month
ending on the last day of the month. or as follows:
5.1.3 Provided that an Application for Payment is received by the Architect not later than the
1 s t day of a month. the Owner shall make payment to the Contractor not
later than the 25th day of the month. If an
Application for Payment is received by the Architect after the application date fixed above, pay-
ment shall be made by the Owner not later than 2 5 days after the Architect
receives the Applicration for Payment.
5.1.4 Each Application for Payment shall be based on the most recent schedule of values submit-
ted by the Contractor in accordance with the Contract Documents. The schedule of values shall
allocate the entire Contract Sum among the various portions of the Work. The schedule of values
shall be prepared in such form and supported by such data to substantiate its accuracy as the
Architect may require. This schedule. unless objected to by the Architect. shall be used as a basis
for reviewing the Contractor's Applications for Payment.

5.1.5 Applications for Payment shall indicate the percentage of completion of each portion of the
Work as of the end of the period covered by the Application for Payment.
5.1.6 Subject to other provisions of the Contract Documents, the amount of each progress pay-
ment shall be computed as follows:
.1 Take that portion of the Contract Sum properly allocable to completed Work as deter-
mined by multiplying the percentage completion of each portion of the Work by the
share of the Contract Sum allocated to that portion of the Work in the schedule of val-
ues, less retainage of Ten percent ( 1 0 %). Pending final determi-
nation of cost to the Owner of changes in the Work, amounts not in dispute shall be
included as provided in Subparagraph 7.3.8 of AlA Document 1\2.01-1997;
.2 Add that portion of the Contract Sum properly allocable to materials and equipment
delivered and suitably stored at the site for subsequent incorporation in the completed
construction (or, if approved in advance by the Owner, suitably stored off the site at a
location agreed upon in writing), less retainage of Ten percent ( 10 %);
3 Subtract the aggregate of previous payments made by the Owner; and
.4 Subtract amounts, if any, for which the Architect has withheld or nullified a Certificate
for Payment as provided in Paragraph 9.5 of AlA Document 1\2.01-1997.
5.1.7 The progress payment an10unt determined in accordance with Subparagraph 5.1.6 shall be
further modified under the following circumstances:
.1 Add, upon Substantial Completion of the Work, a sum sufficient to increase the total pay-
ments to the full amount of the Contract Sum, less such amounts as the Architect shall
determine for incomplete Work, retainage applicable to such work and unsettled claims;
and (Subparagraph 9.8.5 of AlA Document 1\201-1997 requires release of applicable retainage upon
Substantial C;ompletion of Work with consent of surety, if any.)
.2 Add, if final completion of the Work is thereafter materially delayed through no fault of
the Contractor, any additional amounts payable in accordance with Subparagraph 9.10.3
of AlA Document 1\2.01-1997.
5.1.8 Reduction or limitation of retainage, if any, shall be as follows:
(If it is intended, prior to Substantial Completion of the entire Work, to reduce or limit the retainage resulting
from the percentages inserted in Clauses 5.1.6.1 and 5.1.6.2 above, and this is not explained elsewhere in the
Contract Documents, insert here provisions for such reduction Of' limitation.)
5.1.9 Except with the Owner's prior approval, the Contractor shall not make advance payments
to suppliers for materials or equipment which have not been delivered and stored at the site.
5.2 FINAL PAYMENT
5.2.1 Final payment, constituting the entire unpaid balance of the Contract Sum, shall be made
by the Owner to the Contractor when:
.1 the Contractor has fully performed the Contract except for the Contractor's responsibil..
ity to correct Work as provided in Subparagraph 12.2.2 of AlA Document 1\2.01-1997, and
to satisfy other requirements, if any, which extend beyond final payment; and
.2 a final Certificate for Payment has been issued by the Architect.

5.2.2 The Owner's final payment to the Contractor shall be made no later than 30 days after the
issuance of the An.:hitect's final Certificate for Payment, or as follows:
ARTICLE 6 TERMINATION OR SUSPENSION
6.1 The Contract may be terminated by the Owner or the Contractor as provided in Article 14
of ALA Document A201-1997.
6.2 The Work may be suspended by the Owner as provided in Article 14 of AIA Document
A20l-1997.
ARTICLE 7 MISCELLANEOUS PROVISIONS
7.1 Where reference is made in this Agreement to a provision of AlA Document A20l-1997 or
another Contract Document, the reference refers to that provision as amended or supplemented
by other provisions of the Contract Documents.
7.2 Payments due and unpaid under the Contract shall bear interest from the date payment is
due at the rate stated below, or in the absence thereof, at the legal rate prevailing from time to time
at the place where the Project is located.
