with all test results. material certifications, design mix numbers and record drawings (AS BUll. TS) sbowing any changes

Waived Requirements for all Categories (FOOT form 850-040-17).

ASSIGNMENT
THIS AGREEM"fiNT is entered into this _ day of . A.D,. 2003 by and
between WILLIAM F. NYE and ANDREA NYE. his wife, hereinafter referred to as "'NYE", and
the CITY OF ZEPHYR HILLS, a Florida municipal corporation, hereinafter referred to as the
"CITY".
WHEREAS, NYE, has constructed a restaurant known as the Gulden Conal on US Highway
301 North, and
WHEREAS, the CITY has required NYE to give to the CITY, as put of iu site plan, a
roadway, which will be ,;onsU1lCted parallel to US Highway 301, and
WRERHAS. as a result of the construction, there are Transportation Impact Fees "TIF" due
and Owing to the CITY, and
WHEREAS, NYE is eager to have a Certificate of Occupancy i&5ucd by 1he CITY, and
WHEREAS. the CITY and the Lessee ofNYE have applied for a monies from a Community
Development Block GTlInt fund, known as CDBG Agreement No.: 03DB-IA-08-61-02-E "the
Grant". in the amount of Seven Hundred Thousand Dollars ($700,000.00), to help defray the cost
of constructing and acquiring the frontage road that runs parallel to US Highway 301, a portion of
which traverses the fron'~ portion ofNYE's property, and
WHEREAS, the CITY wisbes to issue the Certificate of Occupancy to NYE, in return for
a partial assignment by tiYE of their rights in the GIant, providing for acquisition of roadway, which
the CITY hIlS received confinnation of the approval of said Grant
NOW THEREFORE, for the mutual covenants and promises contained herein and other
good and valuable consideration, receipt of which is acknowledged, the parties hereinafter agree
as follows:
1. NYE doe~ hereby;,agree to assign all of their right, title and interest in the proceeds
of the Graut up to the amount of monies due the CITY for the construction project, in particular the
TIF.
2. The CITY agrees to issue to mE and their Lessee, a Certificate of Occupancy to
operate the restaurant knc:rwn as the Golden Coral, and said Certificate of Occupancy shall be issued
upon the execution, by the parties of this Agreement

It may be altered only by a written agreement signed by the party against whom enforcement of any

5. The parti'~'S herein agree that in the event of any litigation concerning the terms or
conditions of this Agrec:ment shall be conducted in the Sixth ludicial Circuit in and for Pasco
County, Dade City, Florida.
6. This Agn:em.ent shall be governed by and construed in accord8l1\;e with the laws of
the State of Florida.

B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES

Dear Todd,
My Golden Corral property had previously been used as a Mobile Home sales lot along with an 8
unit Mobile Home subdivision I have enclosed the diagram eX the sales lot and addition1hat I
think were forwarded to you earlier. At the time eX the tear down, I had the office along with 4
tenants. We had 4 vacant units, as I knew we would ultimately tear everything down. The sheriffs
department can verify some of the units as we had a "shoot out" with some of the occupants. I
can also probably produce some proof on the sales lot 1hat I had leased during my ownership. I
was also collecting rent from the tenants.
I did converse with the comty on their impact fee credits, had the property been in the comty. I
would receive impact fee credits on each of the 8 units 1hat total in excess eX $5,000.00 per unit
(transportation, schools, library, fire, parks, etc.). Then, there would be credits for the office sales
lot. I do not know what the city impact fee credits would be; however, I do not think any
consideration was given to these credits.
I can dig through all my old files to get some eX this proof and you might also contact Nelson (c; 97 - Sf ~ ~
Ryman who worked on this site and developed part eX the foregoing. Please let me know when
we can sit down and address these issues.
