A. NOTICE OF DEED RESTRICTIONS
The undersigned understands that this permit may be subject to ~deed restrictions" which
may be more restrictive than City regulations. The undersigned assumes respo~sibi~ity for
cbmpli~nce with any applicable deed restrictions.
B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by law, both the owner and contractor may be cited for a misdemeanor
violation under state law. If the owner or intended contractor are uncertain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephyrhills Building Department, 813-788-6611.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the
contractor(s) sign portions of the ~Contractor Sections" of this application for which they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, rather than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indication that he is not properly licensed and is
not entitled to permitting privileges in the City of Zephyrhills.

and Consumer Affairs. If the applicant is someone other that the ~owner", I cerify that I
have obtained a copy of the above described document and promise in good faith to deliver
it to the ~owner" prior to commencement.

I certify that all the information in this application is accurate and that all work will
be done in compliance with all applicable laws regulating construction, zoning, and land
development.
Application is hereby made to obtain a permit to do work and installation as indicated. I
certify that no work or installation has commenced prior to issuance of a permit and that
all work will be perfor.med to meet standards of all laws regulating construction, City
codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify that I understand that the regulations of other governmental agencies may apply to
the intended work, and that it is my responsibility to identify what actions I must take to
be in compliance. Such agencies include but are not limited to: *Department of
Environmental Regulation-Cypress Bayheads, Wetland Areas and Environmentally Sensitive
Lands, Water/Wastewater Treatment

I also certify that, if fill material is to be used in Flood Zone ~A" or ~A,etc.", it is
understood that a drainage plan addressing a ~compensating volume" will be submitted which
is prepared by a professional engineer registered in the State of Florida prior to permit
issuance.
A permit issued shall be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any provisions of the technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for a
period of six months after the time the work is commenced. One 90 day extension of time
may be allowed for the permit with fee charge of $15.00. The extension shall be requested
in writing to the Building Official. An approved inspection must be logged during each six
month period, or the project will be considered abandoned.

It has been determined tbat your property does not lie within the lOa-year
flood zone.

It has been determined that your property lies within the 100-year flood zone
as established by the Federal Insurance Rate Maps.
Under Section 700 of the Pasco County Land Development Code, all new residential
construction or substantial improvement thereto within the 100-year flood zone must
have its lowest habitable floor or, when applicable, its lowest supporting struc-
tural member elevated in accordance with approved construction standards to or above
the applicable base flood elevation. All new nonresidential construction or sub-
stantial improvements thereto within the lOa-year flood zone must either have its
lowest habitable floor or, when applicable, its lowest supporting structural member
elevated in accordance with approved construction~standards to or above the appli-
cable base flood elevation, or must be flood-proofed in accordance with approved
construction standards.
All Building Permit applicants receiving building permits for structures located
within the lOa-year flood zone have twenty-one (21) days from establishment of the
lowest habitable floor, or placement of the lowest habitable floor structural
support member, or flood-proofing, whichever is applicable, to submit certification
of compliance with the above-mentioned regulations to the permitting office which
issued the Building Permit.
Further, if fill material is to be utilized to meet the base flood finished floor
criteria, the applicant shall be required to submit, concurrent with the Certificate
of Compliance, an engineer's certificate as required by code. Such certification
shall be prepared and sealed by a registered professional engineer, State of
Florida, and shall attest that the construction will not create an adverse impact
upon adjoining property as a result of stormwater run-off.
Failure to comply with the above-mentioned regulations constitutes a violation of
Section 700 of the Pasco County Land Development Code and may subject the violator
to a fine not exceeding Five Hundred Dollars ($500.00) or imprisonment for a period
not exceeding sixty (60) days, or both, or other appropriate legal action. Certif-
icates of Occupancy and/or final power releases shall be withheld until the above-
mentioned regulations have been fully complied with. Any construction proceeding in
violation of the above-mentioned regulations may be stopped and may not be permitted
to continue until such time as the above-mentioned regulations have been fully
complied with.

AGREED CONDITIONS
1. Buyer agrees to provide reasonable access to the pool site for all personnel and equipment as well as for the storage of any materials or equipment to complete pool.
2. Buyer agrees to furnish all necessary water and electricity to complete pool.
3. Buyer agrees to pay any additional cost for the removal of any underground obstacles, removing. refilling and compacting filled ground, control of water seepage, well pointing. or
other unusual ground conditions, including rock beyond the capacity of a 12 foot to 14 foot backhoe to remove.
4. Seller shall not be liable or responsible for damage to grass, shrubbery, driveways, walks, trees, patios, etc.
5. All electrical upgrading to meet existing building codes is Buyers responsibility.
6. Attached here to and incorporated with this contract is a drawing showing shape, size and location of pool as well as location of related equipment.
7. In the event completion of the pool is not reasonably feasible for reasons beyond control of Seller, the Buyer shall pay all Seller's actual costs due to cancellation plus
15% thereof for profit.
8. Buyer is responsible for any additional fill dirt.
9. Elevation is to be determined by Buyer before the pool shell is set inground.
10. ENTIRE AGREEMENT: This contract constitutes the entire agreement of the parties and may not be changed orally.
11. All dimensions are approximate.
12. Any change or additions to this contract must be paid in advance or prior to completion of pool.
13. No warrantee implied until seller has been paid in full.

As Owner/Buyer I (We) acknowledge that a new swimming pool, spa or hot
tub will be constructed by Blue Dolphin Fiberglass Pools of Hillsborough

barrier (Fence, Screen Room, Child Safety Fencing) that

than 48" measured from the interior flllished floor at the
pool access level) providing direct access from the home
to the pool will be equipped with an exit alann that has a
minimum sound pressure rating of 85 decibels at 10 feet;

As Owner/Buyer I (We) understand that not having one of the above safety
features installed at the lime of final inspection, and/or when the pool is
completed (or contract purposes,_will constitute a violation of Chapter 515,
F.S. and will be considered as COJDlnitting a misdemeanor of the Secoil(!
degree, pWlishable by fines up to $500.00 and/or up to 60 days in jail as
established in Chapter 775, F.S. I (We) further understand that I (We) will
be liable to pay any fInes, permitting fees, legal fees or other fees that the
contractor (Blue Dolphin Fiberglass Pools of Hillsborough County, Inc.) .
may incur as a result of my/our violation of Chapter 515, F.S. after the
swinuning pool is completed and/or the permit has expired and further
release, remise and relinquish Blue Dolphin Fiberglass Pools of,

Pasco County: Lot Grading Drainage Plans
Construction on Property One Acre or Less
This addendum is to made part of the agreement # () 7'7 ~ signed and dated on
Cf -I.}.. -O:J.. by and between Blue Dolphin Fiberglass Pools,
Inc. (Seller) and M~t.ANJE RyBiCKI (Buyer)
Both Buyer and Seller agree that it is the Buyer's sole responsibility to supply, at
Buyer's cost, any and all additional Surveying and Engineering to comply with
Pasco COlmty Code "SECTION 605.5, STORl\1W A TER MANAGEMENT
PRACTICES MANUAL, LAND DEVELOPMENT CODE; RESOLUTION
NO. 98-153; AND MEMORANDUl\1 CE98-193". This additional surveying and
engineering includes, but may not be limited to the following:
. Survey showing property elevations at fifty (50) foot increments.
. Engineered individual lot grading drainage plans showing the proposed elevation
of the swimming pool signed and sealed by an engineer registered in the State of
Florida (minimum of three (3) copies required).
. Final as-built survey signed and sealed showing the finished swimming pool
elevation.
Both parties also agree that no warranties will be issued or become effective on the
swimming pool until an as-built survey is supplied to the Seller for final inspection
purposes. The Buyer has thirty (30) days from the date of constnlction completion
and final payment to furnish the seller with the as-built survey. Should the Seller not
receive the survey within the allotted time frame a request will be made to the Pasco
County Code Enforcement to take action against the Buyer and/or legal action may
be taken which may result in additional costs, fees, fmes, permitting or other
necessary charges.

THE USE AND SIZING OF AIR VENT LINES AS SAFETY VACUUM
RELEASE SYSTEMS IS FROM YEARS OF MY DESIGNING AND FIELD
TESTING SUCH LINES ON PUBLIC SPAS.
ALTHOUGH AT PRESENT THE CODE FOR SUCTION VELOCITY IS NOW
8 FEET PER SECOND, IT WILL SOON BE 6 FPS WITH THE PRINTING
OF THE NEXT NSPI-5 AND HAS BEEN PUBLIC CODE FOR YEARS,
THEREFORE THE SUCTION ALLOWABLE GPM SHOWN ARE BASED ON
6 FPS.
REFERENCE TO STANDARDS AND CODES ARE TO THE LATEST ADOPTED
EDITION.
THIS MASTER MAY BE USED FOR ALL POOL SHAPES INCLUDING
