A. NOTICE OF DEED RES'l'RIC'l'IONS
The undersigned understands that this permit may be subject to "deed restrictions" which
may be more restrictive than City regulations. The undersigned a~sumes responsibility for
compliance with any, applicable deed restr:i.cti.ons.
B. UNLICE.NSED CONTRAC'l'ORS AND CONTRACTOR RESPONSIBILITIES
If the o~mer has hired a cOlltractor or contractors to undertake work, they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by lavl, both the o~mer and contractor may be cited for a misdemeanor
violation under state la~l. If the o~mer or intended contractor are lUlc""rtain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephy.chills Building Department, 813-788-6611.
Furthermore, if the owner has Iii red a contractor or contractors, he is advised to have the
contractor(s) sign portions of the "Contractor Sectionsll of this application for whicll they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, ratller than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indication that he is not properly licensed and is
not entitled to permitting privileges in the City of ~ephyrhills.

lien LaVJ - Homeowner's Protection Guide" prepared by the b'lorida Department of Agriclllture
and Consumer Affairs. If the applicant is someone other that the "ownel:", I cerify that I
have obtained a copy of the above described document and promise in good faith to deliver
it to the "owner" prior to conmlencement.

I certify that all the information in this application is accurate and that all work will
be done in compliance vdth all applicable laws regulating construction, zoning, and land
development.
Application is hereby made to obtain a permit to do work and installation as indicated. I

all work will be performed to meet standards of all laws regulating construction, City

I al~o certify that, if fill material is to be used in Flood Zone "A" or "A, etc.", it 1s
understood that a dr'ainage plan addressing a "compensating volume" will be submitted which
is prepared by a professional engineer registered in the State of Florida prior to permit
iSl:iuance.
A permit issued shall be construed to be a license to proceed with the work and not as
author1ty to violate, cancel, alter, or iet aside any provisions of tIle technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become 1nvalid unless the work authorized by slIch permit is cOllulIenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for a
pt::riod of six months after the time the work is conunenced. One 90 day extension of time
lnay be allowed for the permit with fee charge of $15.00. The extension shall be requested
in VJri ting to the Bui lding Official. An approved inspection must be logged dllring each six
month period, Or the project will be considered abandoned.

them, founded. upon a claim or infrinqe~nt of patent rights, and shall rei~'.1rse ~he
Con tr:actor anxi. the owner!'; of the Project, or any of them, for all ex,pen~e$, ~_nolud~ng
rea.sonable counsel fees, incurred by the Cont:r.a.c.t;or, andlor the owners of the Project, or
any of them, in defending any acti_on br(mght for: such alleged infringement. The
Contractor a.ndthe owners of the Project shall each be permi tf:ed to be represented by
thei.r own cou.nsel in any s11ch suit or action should they, or any of them, so desire.
5.04 In the event any action, suit, proceeding, claim or demand is made againstt:he
Contractor which the Subcontraotor has herein agreed to indemnify, then the Contractor may
withhol.d from any payment due or hereafter to become due to the Subcontractor hereunder an
amount sufficien.t in its sole judgment to pr:01:ect and indemnify the indemnified party from
such 8cti.on, suit., pr:oceeding, claim or demand, together with legal fees and
disbursements.
5.05 Subcontractor represents that it is an independent conb:actor '!l.nd ne:i. ther
Subcontracto'!': nor any employees of Subcont.ractor !'l.r!!' employees of Contracto:t:.
Subcontract.or shall, at allti.mea, have complete charge and control of i t.l!!t employees
engaged in the performance of the Subcontract Wot:k. Subcontraotor agreel'! to accept full
and exclusive l.iahili ty fQr the payment of any and all contributions or taxes for:
unemployment insur:ance or old age benefits or annuities nOl'1 and hereafter impQaed by any
governmental authority which may be or become payable by r:eason of the Subcontract Wo~k,
and Suboontractor agrees to indemnify, defend and save harmless CQntractor against any
such liability.
VI. ADDITIONAL OBLIGATIONS OF THE SUBCONTRACTOR
6.01 The Subcontraotor shall:
(a) provide and supply, in the performance of the Subcontra.ct Wor.k, a
sufficiency of properly skilled and other workmen and equipment and an adequacy of
materials of the pr:oper qualitcY as requir:ed by t.he Contractor;
(b) abide by the safety rules and r.egul!\tions establ.ished by the ContractQr
and/or prQmulgated by any li'eder.al, state, or LQcal government bQdy or agency with
appropriate jurisdiction;
(c) provide ~ll1ffi.c.ien t, safe and properfacili ties at all times for the
inspection of the Subcontract Work by the ContractQr and any architect or: their aut.horized
representatives; .
(d) employ on the Project only wQrkrnen of such labor affiliatiQns as ar'!!
satisfactory to the Contractor and approved in writing by the Cont.ractor;
(e) pay prQrnptly any and all sum Qr sums of mQney due for. labor., ma.terie.ls
Qr: equipment supplied in cQnnection with the performance of the Suboontract WQrk. This
parag.r.aph is not intended to create any right in ~ny thir.d party. Additionally, the
SubcQntract agr:ees to pay the prevailing wage .for the area and further agrees tQ partake
in <I.ny affirmative action progr:ams which are in effect in the general ar.ea or specifically
on the Projeot. Further, the Subcont.ractor a.grees to eXeOl.lte l!Iuoh docmmentation as may be
r:equired by the General Contractor, the owner or any gover:nmentaJ. authority confirming his
complia.nce wi th the provisions of this Section;
(f) olean up and remove from the Project site all rubbish and d~.bris
resul ting from the performance of Sllbcontract Work;
(g) comply with, and perfQT.m all of the Qbligations of the Contr:actor under
the P.rilwipal Contraot which a.re applicable or r:elated in any manner to the Subcontract
Work;
(h) be responsible fQr: all materials delivered to the site by the
Subcontractor:, the Contractor r the owner or any other par.ty, which materials are to be
installed as part of its contract; and
(i) be responsible for all perils (insurable or. non-insurable) until the
Project is accepted and cornpl.eted by the owner and arohitect.
6,02 In the event that any mater:ials used by the Subcontractor, whether worked or
unworked, or any Contract Work performed by the Subcontractor is rejected by the
Contract.or, the owner Qf the Project, or the A:rohi teet, as defect.i ve or as in anyway
failing to confQrm to the plans and specifications of the Contract Work, whether such
defective work or mater,iaI.s are disoovered before cQmpletion of the Contract Work or
~-dth.i.n a period Qf one (1) year from date of oompletion of the Contr!\ot Work (or such
longer peri.od as may be generally acoepted wi th.i.n the industry), Subcontractor shall:
(a) withiu twenty-four (24) hours after receiving written notice from the
Contractor to that effeot, proceed to remove from the Project site all such defeotive
materials and tQ take down all portions of such defective Contract WQrk;
(b) make gOQd all wor.k in other trades damaged Qr destroyed ther....by; and
.. (0) promptly correct to the satisfaotion of the Contractor any such
defeotJ.ve w(.)rk or replace any suoh defective materials at his own CQst and at t.he
reasonable convenience of the owner.

. 3.04 The Conb::-actor shall P""V to the Subcontract.or, N\ or about the fifteenth
(15th) day of each ca lenda.r mon I::h f'_,11owing the submissi.on of a Requisi tion, ninety per?<;:mt
(90%) of the amOll.nt to which the ~hlbcont:r.:actor is entitled for \-fOrk done a!'ld. mater:tals

3 ^ 05 Final payment of the S\lbcont:.ract Price shall be pa.id by the Contracbn: to thf!l
Subcontractor upon the expiration of thirty (30) d,aysfrom the date of completion of the
Subcontract Work and the Project and acceptance thereof by the owner of the Project.
3.06 Should it tl_ppear at any time that the Subcontra(Jtor, or anyone perfo.rm.ing any
part of the Subcontract Work, hal!'l not paid any amount due .far labor ( materials, equipment
or services supplied in connecti.()n with .the performance of the Suboontract Work, the
Contractor shall have the right , but not the obligation, to pay such amO'lnt to the partie",
to whom .i t j.s due and to deduct such amount from the Contract Price. If all payments then
due hereunder to Subcontractor are less than the amount paid by the Contraotor to any
third party, the Subcontractor shall refl:md such amounts to t.he Contractor upon demand.
3.07 Payments made herel.1nder shall not be evi,d'!!mce of the perfo:r:tt\a.nce of the
obligations of the Subcontrf\ctor under t:h;.s Subcontract, either wholly or. i.n pa,rt:, and no
payment shall be construed to be an accept.ance of the Subcontract Work, or a.ny part
thereof. The acceptance by the Subcontractor of the final payment hereunder sha.ll be
deemed to be a complete and uncondi.tional rP.llease' of any and all existing or fubu:e claims
or demands by the Suboontraotor against the Contr.actor, known or. l~nknown, herel....nder or in
connection herewith, whatever they may be or howsoever t.hey may aril!lle, a:!l ''fel1 as for
every act and neglect of the Contractor and any person or fi.rm for ~7hom the Contractor
shall or may be deemed respom'dble.
3.08 The Suboontract Pri.ce includes a.1J_ Federal ( state, Murdcipal and Local Taxes
inclucUng but not limi. ted to Sales and/or Use Taxes applicable to the perfor.manoe of the
Subcontract Work, all. of which shall be paid by th__ Subcontractor.
IV. INSURANCE
4.01 The Subcontractor, before beqinning the Subcontract Work, shall procure from
such inl!lurance companies as may be designat,ed by 'the Contractor polici.es with such l.imits
of liability as the Contractor shall defl'.JI\ neoessaryto protect the Contraotor and the
owner of the Project from olai.m under Work~n' s Compensation, Public I.iahi,li ty, Property
Damage, and such other insurance. or cove.rl\qe, as r.equired by the Contraotor or the

injury, including dea.th, which f(tay arise fr(lm operations under this Sttbcontra.ct carried on
ei. ther by t..he Subcontractor or by any of its subcontractors. The Subcontractor shall
maintain such policies in full force and effeot until such time as a11 the Subcontract
Work !';:hall have. been entirely completed and accepted Certificates evi.dencing that such
requi.red insurance in e,ffect sha11 be furni.shed by the Suhcontrl!'.ctor to the Contractor
promptly after such insurance has been procured.
4.02 In case of the failure of the Subcontractor to maintain such insuranca and
policies in full force and effect l\S aforesaid, the Subcontractor hereby authorize" and
e-.mpowers the Contractor, l-1ith'':!ut. any not1ce of ;_ b" intf!lnt:i..on so to do, to provide such
required poLicies af insurance and other oovera,ge, on behalf and for the a.ccount of the
Subcontractor and 1:::0 pay any and all. prem.iums due thereon. Subcontractor ~ha11 reimburse
Contractor, on demand, for all .'1ch pr.emiums paid by Contract.Or, l\nd Contraotor may deduct
the aggregate amount o.f such premiml\s So paid by the Contractor from any moneys, which may
be due. or thereafter become due to the. Subcontra.ctor. under this Stlbcontract::.
4.03 The foregoing insurance and cover.age provisions sha11 also be applicable where
t,lle perfo.'l'.1tlan.ce of any of the Subcontract Work involving the use of labor at or on the
site of the Project, shall have been sublet by the Subcontractor. The Subcontractor shall
make no agreement therefor, or ~Tith respect thereto, which does not effectively bi.ndthe
other party thereto to lik__ compliance with the requirements hereof.
4.04 The Subcontractor sha.ll exc1ude a11 Subcontract Work, which m.ay he performed
on or at the site of the Pr.oject, from the coverage of any other insurance, excluding the
inBurance required under 4.01, in force on behalf of the Subcontractor and shall duJ.y
notify such insurers, if any, of the stipu1ation made in this Subcontract.
4.05 The Subcontr3.ctor, by compliance wi.th the foregoing requirements as to the
insur,:,-nce, shall not be relieved from any liab.ili t.y ,.,ha tsoever imposed by the provi.sions
of th.1.s Subcontract or otherwise.

r.ules, regulations and orders of any public authority bearing on the perform::lnce of the
Subcont:r.aot Work. The Subcontracto.r. shal.l seOl1,xe and pay for all permi tl'!' , fees and
licenses necessary for the execution of the g,u,contract Work.
6.09 Subcontracl:oX' a.g.ree~l:;hat perfo:t'mance of the Suboontraot WQr.k shall he suhjeot

Notwithstanding and in no wa.y 1imi ting any provision to the contrary set forth in this
Suboontraot, no payment on aocount of the Suboontr.act Prioe shall be d~.le and payable
unless and until the Requisi.tion .for such payment has been approved by the A:r.chitect.
VII. MECHANICS' LIENS AND CIJ\IMS
7.01. As a oondition preoedent to the making of any payment to the Suhcontractor. on
aooount of the Suboontraot Prioe, the Subcontraot shall serve all notiC1'!s that may be
requi:r.ed by law. Without li~iting the for.egoinq, Suboontractor shall, at the same time,
send a copy of suoh noti.ce to the Contrao.tor via postage p.r.epaid, certified maLl, return
receipt requested.
7.02 As a condition precedent to the making of the first disbursement or payment to
the Subcontraotor on account of the Suboontract Price, the Subcontraotor shall furnish to
the Contractor a fully executed Affidavit:., in such form a", the Cont.ractor shall req\ti_re,
list.ing the names and addresses of aLl suppliers; ma ter.is.lmen, labore:r.l!I and mechanios whQ
ha.ve supplied materials or performed wor.k in <:lonnecti9n with the SubcontracT, Work to the
date of the A.f.fidavit and all necessary bond.l'!: and ins\1ran(~e certificat.el'!.
7.03 A,s a condition precedent: t.o making any di.shu.rse:ment. or payment to the
Subcontraotor on account. of the Suboontract Prioe, the Subcontractor shall furnish to the
Contraotor a fully executed and reoo%dable partial r.elease of lien, in suoh form as the
Contraotor shall require, f.rom the Sttboontracto:r:, its suhcont:r.actors, each supplier,
materi.alman, laborer. and mechanic who has supplied materials Qr performed work in
conneotion with the Subcont%aot Work. Pu:r:Sl.lant to said rel~ase, eaoh lJaid Sl~bcontractor,
i t:s subcon traotors, supplier, ma ter..:i.alman , laborer and mechanic shall waive and relinquish
all right to file a mechanic's lien, claim or notice of intent to file any lien or claim
arisinq Ollt of or relating to any work or materials furnished on the Project prior to the
date of the last preoeding payment to the Suboontraotor.
7.04 As a conditi.on precedent to the making of fi.nal payment he:r.eunder, the
Subcontraotor. shall fur.n.i.!dl to the Contractor fl:tll and complete reoordable releases and
discharge~ , i.n forms I!ul!.tisfa.ctory tot:he Contraotor, of ail liens, claims, a.nd demands
arising out of or relating-to the Subcontraot Work and any and all materials furnished,
work done and equipment used in connection therewith from the Subcontract.o:r., it. suppliers,
materialmen, labor.ers and mechani.clS. In addition, the S1.1.bcont:r:acto:r. shal_l fl,,:r.nish to the
Contracto:r: a final aff.idavit, .:i.n s1:tch .fo:r.:m a9 the Contractor shall. require, stating that
all suppliers, materialmen, labor.e:r:l!I, and meohanics have been pai.d in full, or listing the
names and addxesses of all 1.1npai.d accounts and the a11\Qunts r~ain:i.ng due. If the
Subcontraotor'lS final affidav,i. t shows lmpaid accounts, and the Snbcont:raotor il!l unable to
furnish the Contractor with final releases from all suppliers, mate:r:;.al~n, labo.:r:e:r:s and
mechanios, the ContT-aotor shall have the right to withhold 115% Qf the amount T.emaininq
due on all suoh unpaid aOOOl;mts until such time as the Subcontra.ctor. delivers to the
Contractor all said fin,,1.l :r.eleases.
7.05 Suboontraotor., for itself and anyone else aoting or claiming through or under
i_ t, does hereby waive and .relinql1.ish al.1 :r:ight to f.:i.le a mechanic's lien, claim or notice
o.f intention to file any lien. or claim, and does hereby coven.a.nt, promise and agree t.hat
nQ mechanic's lien or claim or other. lien or cla.im of any ki.nd whatsoever shall he filed
or be ma,intained against: I::hePr.o:ject or the estate Qr t.:i tIe of the o~mer.s in the Project
by or in the name of Subcontractor, or any subcontractor, materialmen or labor.ers for work
done or ma.terials furnished under this Subcontraot or by any other par.t.y acting thr.ouqh or

thereof, and that al.l subcontractors, materialmen, and laborers on the Suboontract Work
shall look to and hold Suboontractor personally liable for all suboontracts, materials
furnished and wor.k and labor done, so that there shall not be any leqal or lawful olaim of
any kind '!f7hatsoever against Contractor or the owners of the pr.oject for any work done or.
labor or materials furnished under this SUboontraot, or any contract for any extra work or

7.06 Subcontractor agrees, upon the request of Contractor, to execute and deliver

w'Ork being done on the Project as its relates to the Subcontract Work or the
Subc'Ontract'Or's perf'Ormance of the Suboontract Work, the Contract'Or shall. qive the
Subcontractor notice there'Of. 'l'hereupon, the Subcontractor shall have the oppornlni.ty to
be represented by its own counsel at is expense in the said pr'Oceeding. Whether or not
the Subc'Ontractor supplies it ONn counsel, it shlll,11 be bound by the outcome of the said
pr'Oceedinq and any judg:men t, verdict, award or. decis.i,'On shall be bi.nding upon the

9.04 This Subcontract is not intended to create any third party beneficiary rights

third parties; and the riqhts and p:r.ivileqes of this Subcontract sha.ll inur.e only to the
benefit 'Of the par-ties hereto and, subject to the restrictions on assiqnment by
Subcontractor stated above, their respective successors and assigns.
