Dear Mr. Bingham;
This letter constitutes notice of Final Agency Action for approval of the permit application
referenced above. Final approval is contingent upon no objection to the District's action
being received by the District within the time frames desoribed below.
You or any person whose substantial interests are affected by the Districfs action
regarding a permit may request an administrative hearing in accordance with Sections
120.569 and 120.57, Florida StatlJte (F.S.), and Chapter 28-108, Florida Administrative
COde (F.A.C.), of the Uniform Rules of ProcedUre. A request for hearing must: (1)
explain how the substantial interests of each person requesting the hearing will be
affected by the District's action, or proposed action, (2) state all material facts disputed by
the person requesting the heanng or state that there are no disputed facts, and (3)
otherwise comply with Chapter 28-106, F.A.C. Copies of Sections 28-106.201 and 2B.
106.301. FAC. are enclosed for your reference. A request for hearing must be filed with
(received by) the Agency Clerk of the District at the District's BrooksVille address within
21 days of receipt of this notice. Receipt is deemed to be the fifth day after the date on
which this notice is deposited In the United States mail. Failure to file a request for

ABSTRACT: This permit modification is for a 5.94-acre phase of previously iSSUed
EnVironmental Resource Permit (ERP) No. 44011484.003, entitled Oak Run Phases 3 and 4, and affects
olllY the project area identified in this modification application submittal. The project site is located off the
west side of Gre&n Slope Lane, just north of the City of ZePhyrhills, in southeastern Pasco County.
Adjacent properties include Grand Hortzons (ERP No. 49014124,000) to the north, Zephyrhills Wal-Marr
(Management and Storage of Surface Water Permit No. 40009659.000) to the east, and Spanish Trails
Mobile Home Park (ERP No. 44018721.000) to the south.
The proposed surface water management system conveys runoff to the master drainage system for the
Oak Run Phases 3 and 4 project. Water quality and quantity requirements will be met in the master
system. No adverse otf-site/on-site water quantity or Quality impacts are el(pected. There are no wetlands
within the project area,
All construction is prohibited within the permitted project area until the correctIons sited in the District
letters regarding the Merchants Squarel Townview Medical Arts, dated December 23, 2002, and Oak Run
Phases 3 and 4, dated July 1, 2003. are successfully completed, Specific Condition No. a addresses this
requirement. The surface water management system will be maintained and operated by the Permittee.

than the Permittee becoming the owner ot part of the project area, this permIt shall terminate,
pursuant to Section 400-1.6105, FAC. In such situations, each fand owner shatf obtain a permit
(which may be a mOdification of this permit) for the land olNned by that person. This condition shall
not apply to the division and sale of lots or units in residential subdivisions or condominiums.
2. The- discharges from this system sharr meet state lNater quality standards as set forth in Chapter
62-302 and Section 62'4.242, FAC" for class waters equivalent to the reCeiving waters,
3. Unless specified otherwise herein, two copies of all information and reports required by this permit

The permit number, title of report or Information and event (for recurring report or information
submittal) shall be identified on all informatIon and reports submitted.
4. The Permittee shall retain the design engineer, or other professional engineer registered in
Florida. to conduct on-site observations of construction and assist with the as-built certification
requirements of this project. The Permittee shall inform the District in writing of the name, address
and phone number of the professional engineer So employed. This information shall be submitted
prior to construction.
5 Within 30 days after completion 01 construction of the permitted activity, the Permittee shall submit
to the Brooksville Service Office a written statement of completion and certification by a registered
professional engineer or other appropriate individual as authoriled by law, utilizing the required
Statement of Completion and Request for Transfer to Operation Entity torm identified in Chapter
400-1, FAC" and signed, dated and sealed as.built drawings. The as-built drawings shall identify
any deviations from the approved construction drawings.
6. The District reserves the right. upon prior notie& to the Perm mee, to conduct on-site research to
assess the pollutant removal efficiency of the surface water management system. The Permittee
may be required to cooperate in this regard by allowing on-site access by District representatives,
by allowing the installation and operation of testing and monitoring equIpment, and by allowing
other assistance measures as needed on site,
7. This modification, Construction Permit No. 44011484.004, is for a phase of previously issued
Construction Permit No. 44011484.003. and affects ~ the project area identified in this
modification application submittal.
a. All construction is prohibited within the permitted project area until the corrections sited in the
District letters regarding the Merchants Square I T ownview Medical Arts, dated December 23,
2002. and Oak Run Phases 3 and 4, dated July 1. 2003. are successfully completed,
