A. NOTICE OF DEED RESTRICTIONS
The undersigned understand that this permit may be subject to "deed restrictions" which may be more restrictive than County regulations. The
undersigned assumes responsibility for compliance with any applicable deed restrictions.
B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, they may be required to be licensed in accordance with state and local regu-
lations. If the contractor is not licensed as required by law, both the owner and contractor may be cited for a misdemeanor violation under state
law. If the owner or intended contractor are uncertain as to what licensing requirements may apply for the intended work, they are advised to
contact the Pasco County Building Division - Licensing Section at (727) 847-8009.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the contractor(s) sign portions of the "contractor Block" of
this application for which they will be responsible. If you, as th~ owner sign as the contractor, you are indicating that you, rather than the contrac-
tor, are responsible for the work. If the contractor wishes you to sign as contractor, that may be an indication that he is not properly licensed and
is not entitled to permitting privileges in Pasco County.
C. TRANSPORTATION IMPACT/UTILITIES IMPACT AND RESOURCE RECOVERY FEES
The undersigned understand that Transportation impact Fees and Resource Recovery Fees may apply to the construction of new buildings,
change of use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance numbers 89-07 and 90-07, as
amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of permitting. It is further understood
that Transportation Impact Fees and Resource Recovery Fees must be paid prior to receiving a "certificate of occupancy" or final power release.
If the project does not involve a certificate of occupancy or final power release, the fees must be paid prior to permit issuance. Furthermore, if
Pasco County Water/Sewer Impact fees are due, they must be paid prior to permit issuance. In accordance with applicable Pasco County ordi-
nances.
D. CONSTRUCTION LIEN LAW (Chapter 713, Florida Statutes, as amended)
If valuation of work is $2500.00 or more, I certify that I, the applicant, have been provided with a copy of "Florida Construction Lien Law -
Homeowner's Protection guide" prepared by the Florida Department of Agriculture and Consumer Affairs. If the applicant is someone other than
the "owner," I certify that I have obtained a copy of the above described document and promise in good faith to deliver it to the "owner" prior to
commencement.
E. CONTRACTOR'S/OWNER'S AFFIDAVIT
I certify that all the information in this application is accurate and that all work will be done in compliance with all applicable laws regulating con-
struction, zoning and land development.
Application is hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has commended
prior to issuance of a permit and that all work will be performed to meet standards of all laws regulating constriction. County codes, zoning reg-
ulations, and land development regulations in the jurisdiction. I also certify that I understand that the regulations of other government agencies
may apply to the intended work, and that it is my responsibility to identify what actions I must take to be in compliance. Such agencies include
but are not limited to:
. Deoartment of Environmental Protection - Cypress Bayheads, Wetland Areas and Environmentally Sensitive Lands, Water/Wastewater Treatment.
. Southwest Florida Water Manaaement District - Wells, Cypress Bayheads, Wetland Areas, Altering Watercources.
· Army COrDS of Engineers - Seawalls, Docks, Navigable Waterways.
. Deoartment of Health & Rehabilitative Services Environmental Health Unit - Wells, Wastewater Treatment, Septic Tanks.
· US Environmental Protection Aaency - Asbestos abatement.
· Federal Aviation Authoritv - Runways.
I understand that the following restrictions apply to the use of fill:
. Use of fill is not allowed in Flood Zone "V" unless expressly permitted.
. If fill material is to be used in Flood Zone "A", it is understood that a drainage plan addressing a "compensating volume" will be submitted at
time of permitting which is prepared by a professional engineer licensed by the State of Florida.
. If fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall construction, I certify that fill will be used
only to fill the area within the stem wall.
. If fill material is to be used in any area, I certify that use of such fill will not adversely affect adjacent properties. If use of fill is found to
adversely affect adjacent properties, the owner may be cited for violating the conditions of the building permit issued under the attached permit
application, for lots less than one (1) acre which are elevated by fill, an engineered drainage plan is required.
If I am the AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in this affidavit prior to
commencing construction.
I understand that a separate permit may be required for electrical work, plumbing, signs, wells, pools, air conditioning, gas, or other installations
not specifically included in the application.
A permit issued shall be construed to be a license to proceed with the work and not as authority to violate, cancel, alter, or set aside any provi-
sions of the technical codes, nor shall issuance of a permit prevent the Suilding Official from thereafter requiring a correction of errors in plans,
construction, or violations of any codes, Every permit issued shall become invalid unless the work authorized by such permit is commenced
within six months of permit issuance, or if work authorized by the permit is suspended or abandoned for a period of six months after the time
the work is commenced. An extension may be requested, in writing, from the Building Official for a period not to exceed ninety (90) days and
will demonstrate justifiable cause for the extension, If work ceases for ninety (90) consecutive days, the job is considered abandoned.

The pool will be isolated from access to the home by an enclosure that meets the pool barrier
requirements of Florida Statute 515.29;
The pool will be equipped with an approved safety pool cover that complies with
ASTM F1346-91 (Standard Performance Specifications for Safety Covers for Swimming Pools,
Spas and Hot Tubs);
All doors and windows providing direct access from the home to the pool and located within the
enclosure/fence required by the Pasco County Land Development Code, Section 530.4(D), will
be equipped with an exit alarm that has a minimum sound pressure rating of 65 decibels at 10
feet;

THE TIME OF FINAL INSPECTION, OR WHEN THE POOL IS COMPLETED FOR CONTRACT
PURPOSES, WILL CONSTITUTE A VIOLATION OF CHAPTER 515, F.S, AND WILL BE
CONSIDERED AS COMMIITING A MISDEMEANOR OF THE SECOND DEGREE, PUNISHABLE BY
FINES UP TO $500 AND/OR UP TO 60 DAYS IN JAIL AS ESTABLISHED IN CHAPTER 775, F,S.
I FURTHER UNDERSTAND AND AGREE THAT THE OWNER AND/OR CONTRACTOR WILL
COMPLY WITH THE FOLLOWING REGULATIONS CONCERNING SWIMMING POOL, SPA AND/OR
HOT TUB ENCLOSURES, IMMEDIATELY UPON COMPLETION OF THE SWIMMING POOL; SPA
OR HOT TUB, IN COMPLIANCE WITH SECTION 530.4(0), PASCO COUNTY LAND DEVELOPMENT
CODE:
1. Construct around the swimming pool, spa or hot tub a MINIMUM FOUR FOOT HIGH FENCE with self-
closing, self-latching gates. The fence must not have any gaps, openings, indentations, protrusions, or
structural components that could allow a young child to crawl under, squeeze through, or climb over the
fence. Gates must open outward away from pool area. The releasing mechanism of the latching device'
must be located on the pools ide of the gate and so placed that it cannot be reached by a young child
over the top or through any opening or gap. No opening in the fence may be large enough to admit a
four-inch sphere.
2. Construct a screen enclosure around the swimming pool, spa or hot tub with self-closing, self-latching
screen doors, Latches on exterior screen doors must be minimum 54 inches from the exterior access
standing surface. All screen enclosures require Building Permits.
3. Provide and utilize an approved safety swimming pool, spa or hot tub cover that complies with ASTM
F1346-91 (Standard Performance SpeCifications for Safety Covers for Swimming Pools, Spas and Hot
Tubs). Such cover must be capable of being securely fastened over the swimming pool, spa or hot tub
when not in use,
I FURTHER UNDERSTAND AND AGREE THAT one of the enclosures described above will be completed prior
to final inspection of the pool, spa or hot tub.
ADDITIONALLY, I FURTHER UNDERSTAND AND AGREE THAT the owner will require his/her pool contractor
and his/her screen enclosure contractor (if applicable) to request and successfully pass a final inspection
immediately following the completion/installation of the swimming pool, spa or hot tub.

Under Section 700 of the Pasco County Land Development Code, all new residential construction
or substantial improvement thereto within the 100-year flood zone must have its lowest habitable
floor or, when applicable. its lowest supporting structural member elevated in accordance with
approved construction standards to or above the applicable base flood elevation. All new
nonresidential construction or substantial improvements thereto within the 100-year flood zone
must either have its lowest habitable floor or, when applicable, its lowest supporting structural
member elevated in accordance with approved construction standards to or above the applicable
base flood elevation, or must be flood-proofed in accordance with approved construction
standards.
Prior to constructing a structure on one acre or less, the builder shall be required to provide an
engineered lot grading plan with the Building Permit application that does not create any adverse
impact on adjacent or off.site properties. An engineered lot grading plan (two sealed copies) shall
also be required to be submitted for accessory structures which produce impervious area in excess
of 500 square feet and are located on one acre or less, These permits Include additions, pools,
slabs, etc, In addition, the driveway connection with a site plan shall also be shown and reviewed
as part of the Building Permit application for new residential units.
Prior to release of the Certificate of Occupancy or final inspection where no Certificate of
Occupancy is issued, the developer/owner/builder shall execute an affidavit, provide an as-built
survey prepared by a registered surveyor and mapper in the State of Florida of the lot and the
driveway construction, and return same to the Building Inspections Division. The' as-built survey
shall be in conformance with the approved Stormwater Managemf.lnt Plan and Repcft. Any
deviations from the approved plan must be noted and will be reviewed for compliance with the
County codes and ordinances.
Further, if fill material is to be utilized to meet the base flood finished floor criteria, the applicant
shall be required to submit, concurrent with the Certificate of Compliance, an engineer's
certificate as required by code. Such certification shall be prepared and sealed by a registered
professional engineer, State of Florida, and shall attest that the construction will not create an
adverse impact upon adjoining property as a result of stormwater run-off.
In accordance with Resolution No. 98-153, failure to comply with the above-mentioned
regulations could constitute a violation of the Pasco County Code or Pasco County Land
Development Code and may subject the violator to a fine not exceeding Five Hundred Dollars
($ 500,00) or imprisonment for a period not exceeding sixty (60) days, or both, or other
appropriate legal action. Certificates of Occupancy and/or final power releases shall be withheld
until the above-mentioned regulations have been fully:, complied with: Any construction
proceeding in violation of the above-mentioned regulations may be stopped and may ,not be
permitted to continue until such time as the above-mentioned regulations have been fully complied
with.

Contractor shall have the right to rely on Owner's representation with respect to information provided by the individual(s) executing this document concerning. among other things, the ownership
of the property. authorization to perform the work as contracted herein, and any other facts or data relating to the project and the property itself. Failure by the owner to provide accurate and
complete information requested by Contractor shall be a material breach of this contract.
The Owner shall be the sole entity responsible for securing all required authorization in order to permit Contractor access to the property. and in order to provide sufficient access to the property
with any and all equipment and materials, Owner shall be responsible for protecting and/or removing any trees, bushes, sod. walls, fences, sprinklers, septic tanks, water or sewer lines, driveways-
and sidewalks, or any other obstruction which is required for the performance of this contract, In the event that Owner fails to secure or provide access as required. the Owner shall be responsible
for any replacement costs or other damage caused as a result of Owner's failure to provide such reasonable and proper access, Contractor shall not be responsible for any damage caused to
any property as a result of Owner's failure to provide adequate and proper access to the work site, The Owner shall be responsible to advise Contractor of any condition or circumstances. which
will prevent or hinder Contractor from accessing the property or a condition which could pose a threat to property or persons.
Owner shall be the sole entity responsible for complying with Florida State Statutes and/or any applicable law requiring proper pool barriers, door alarms, fences and/or screen enclosures. Owner
shall not use the pool until such time that all applicable law requirements wilh respect to fencing or enclosures is in place. inspected and approved by the appropriate governing authorilies. Use
of the pool by anyone prior to final completion by Contractor shall constitute Owner's unconditional acceptance of the pool and all related equipmerd and materials, and shall immediately thereupon
bring about the Owner's obligation to make payment in full pursuant to the contract sum, In the event that an inspection is rejected due to the failure to provide proper barrier protection as required
by Florida law, Owner shall be obligated to pay Contractor any additional fees. fines, or expenses associated with the reinsertion of the property by building officials or those having jurisdictional
responsibility over the project.
Owner shall have the right to cancel this contract, but only within three days from the date of its execution by Ol'fner, Such cancellation must be in writing and submitted to Contractor by the
close of business on the third day from the date of the execution hereof. '
Contractor shall endeavor to complete the placement of the pool shell within five working days of, the completion of ils excavation activities. Contractor shall endeavor to complete all concrete
work associated with the pool's shell within 15 working days from the completion of all excavation activities. The time necessary to complete the foregoing items shall be adjusted for any delays
which are not within the control of Contractor, and which involve, but are not limited to. concrete shortages, personnel shortage. delays in delivery, inclement weather, changes in applicable law,
failed inspections, or any changes made to the terms and conditions of this contract.
The work of this contract shall be deemed substantially completed upon the completion of the concrete decking. Owner agrees that all pool dimensions as noted herein above, or in any other
drawing submitted to the Owner, are approximations, which shall vary. Owner understands that any changes to the terms and conditions of this contract, and/or any changes to the specifications
and locations relating to the pool shall be reviewed and the contract amount and contract time shall be equijably adjusted thereupon. Contractor shall not be obligated to perform any changes.
other than those expressly provided for herein. Any additional costs involving a change order or a modification to this contract must be paid in full at the time that such change is agreed to by
the parties. Contractor shall not be responsible to perform any change work until such time that the Owner has paid for the costs of such change work and has agreed in wriling to the nature
of such change.
OWNER IS RESPONSIBLE FOR READING ALL CONDITIONS OF CONTRACT AS CONTAINED ON THE REVERSE SIDE OF THIS CUSTOMER CONTRACT. IF, FOR WHATEVER REASON,
OWNER DOES NOT RECEIVE A COPY OF THIS CONTRACT CONTAINING SAID CONDITIONS OF CONTRACT, IT SHALL BE THE OWER'S RESPONSIBILITY TO ADVISE CONTRACTOR
