Dear Mr. Bingham:
This letter constitutes notice of Final Agency Action for approval of the permit application
referenced above. Final approval is col')tingent upon no objection to the District's action
being received by th~ District within the time frames described below.
You or any person whose substantial interests are affected by the District's action
regarding a permit may request an administrative hearing in accordance with Sections
120.569 and 120.57, Florida Statute (F,S.), and Chapter 28-'06, Florida Administrative
Code (FAC.), of the Uniform Rules of Procedure. A request for hearing must: (1) explain
haw the substantial interests of each person requesting the hearing will be affected by the
District's action, or proposed action, (2) state all material facts disputed by the person
requesting the hearing or state that there are no disputed facts, and (3) otherwise comply
with Chapter 28-106, F.A.C. Copies of Sections 28-106.201 and 28-106.301, F.A.C. are
enclosed for your reference. A request for hearing must be filed with (received by) the
Agency Clerk of the District at the District's Brooksville address within 21 days of receipt
of this notice. Receipt is deemed to be the fifth day after the date on which this notice is
deposited in the United States mail. Failure to file a request for hearing within this tlme
period shall constitute a waiver of any right you or such person may have to request a
hearing under Sections 120.569 and 120.57, F.S. Mediation pursuant to Section '20.573,
F.S., to settle an administrative dispute regarding the District's action in this matter is not
available prior to the filing of a request for hearing.
Enclosed is a "Noticing Packet" that provides information regarding the District Rule
40D-1.1010, FAC., which addresses the notification of persons whose substantial
interests may be affected by the District's action in this matter. The packet contains
guidelines on how to provide notice of the District's action, and a notice that you may use.

Compliance with water quality requirements is assured, as the on~Jjne retention ponds will retain the entire
volume of the 1aO-year, 24-hour rainfall event with no discharge (except for that associated with the
bJeed~down device discharging to the Lowe's site, which will accommodate water quality and quantity from
the North Town Center's western watershed area). Flood Insurance Rate Map Community Panel
120230-02900 indicates the project does not lie within a floodplain. There are no wetlands within the
project area.
The Engineer of Record, Robert J. Lochrane, Florida P.E. No. 32299, has submitted design calculations
and construction drawings indicating no adverse impacts are expected to result from this delielopment.
The surface water management system will be owned and operated by the Permittee. The required legal
documents are part of the file of record for this project.

SPECIFIC CONDITIONS
1, If the ownership of the project area covered by the subject permit is divided, with someone other
than the Permittee becoming 1he owner of pan: of the project area, this permit shall terminate,
pursuant to Section 40D-1.61 05, F.A.C, In such situations, each land owner shall obtain a perm it
(which may be a modification of this permit) for the land owned by that person. This condition shall
not apply to the division and sale of lots or units in residential subdivisions or condominiums.
2. Unless specified otherwise herein, two copies of all information and reports required by this permit
shall be submitted to:

The permit number, title of report or information and event (for recurring report or information
submittal) shall be identified on all information and r"ports submitted.
3. . The Permittee shall retain the design engineer, or other profeSSional engineer registered in
Florida, to conduct on-site observations of construction and assist with the as-built certification
requirements of this project. The Permittee shall inform the District in writing of the name, address
and phone number of the professional engineer so employed. This information shall be submitted
prior to construction.

4. Within 30 days after completion of construction of the permitted activity, the Permittee shall submit
to the Brooksville Service Office a written statement of completion and certification by a registered
professional engineer or other appropriate individual as authorized by faw, utilizing the required
Statement of Completion and Request for Transfer to Operation Entity form identified in Chapter
400-1, F.A.C.. and signed, dated and sealed as-built drawings. The as-built drawings shall identify
any deviations from the approved construction drawings.
5, The District reserves the right, upon prior notice to the Permittee, to conduct on-site research to
assess the pollutant removal efficiency of the surface water management system. The Permittee
may be required to Cooperate in this regard by allowing on-site access by District representatives,
by allowing the installation and operation of testing and monitoring equipment. and by allowing
other assistance measures as needed on site.
6, The operation and maintenance entity shall submit inspection reports in the form required by the
District, in accordance with the following schedule.
For systems utilizing retention or wet detention, the inspections shall be performed two (2) years
after operation is authorized and every two (2) years thereafter.
7_ If limestone bedrock is encountered during construction of the surface water management
system, the District must be notified and construCTion in the affected area shall cease.
8. The Permittee shall notify the District of any sinkhole development in the surface water
management system within 48 hours of discovery and must submit a detailed sinkhole evaluation
and repair plan for approval by the District within 30 days of discovery.
9. The District, upon prior notice to the Permittee, may conduct on-site inspections to assess the
effectiveness of the erosion control barriers and .other measures em ployed to prevent violations of
state water quality standards and,avoid downstream impacts. Such barriers or other measures
should control discharges. erosion, and sediment transport during construction and thereafter.
The District will also determine any potential environmental problems that may develop as a result
01 leaving or removing the barriers and other measures during construction or after construction of
the project has been completed. The Permittee must provide any remedial measures that are
needed.

proceed with the construction of a surface water management system in accordance with the information
outlined herein and shown by the application, approved drawings, plans, specificatIons, and other
documents, attached hereto and kept on file at the Southwest Florida Water Management District
(District). Unless otherwise stated by permit specific, permit issuance constitutes certification of
compliance with state Water quality standards under Section 401 of the Clean Water Act, 33 V.S.C. 1341.
All construction, operation and maintenance of the surface water management system authorized by this

ABSTRACT: This permit authorizes construction of a new surface water management system serving a
7.46-acre commercial development known as North Town Center. The project is located off US 301 ,one
mile north of Zephyrhllls, in Pasco County. Adjacent properties include Wal-Mart Store 706
(Environmental Resource Permit [ERP] No. 44021487.000) to the south and Lowe's of Zephyrhills (ERP
application No. 44025468.000) to the north. This project was originally permitted as ERP No.
44024630.000. This modification authorizes a reduction in project and tota/land area due to an
acquisition of an as-foot wide strip by the adjacent property owner to the north, as well as several m inar
building, site and drainage retention area recontigurations. This permit replaces ERP No. 44024630.000.
The project is situated within a hydrologically closed drainage basin. The stormwater management
system is designed for a 100-year, 24-hour rainfall of 12.00 inches. The project engineer used the Soil
Conservation Service Type II Florida-modified rainfall distributIon and a unit hydrograph shape factor of
484 to compute runoff hydrographs. The proposed surface water management system is comprised of
two dry retention ponds to accommodate the proposed commercial development, including two outparcels
with an assumed build-out impervious area percentage of 80 percent. The drainage calculations Indicate
the ponds are sized to retain the entire runoff resulting from the 1 DO-year post-development rainfall without
discharge. However, when the Lowe's of Zephyrhills site (ERP application No. 44025468.000) is
constructed, a proposed retaining wall will be constructed north of the North Town Center's western
drainage retention pond (Pond 1), This wall will effectively sever Pond 1's connection to the surficial
aquifer above the subsurface clay layer, thus impeding the pond's ability to recover. A provision has been
made for this change, in that the North Town Center applicant has proposed a control structure with a
bleeddown orifice that will slowly discharge water from Pond 1 into the western pond to be constructed on
the Lowe's of Zephyrhills site, When the Lowe's suriace water management system is constructed under
ERP No. 44025468.000, the pipe discharging from the orifice control structure will be connected to the
Lowe's western pond, which has been sized to accommodate this runoff.
