The retaining wall at the above referenced development was designed by
Civil- Tech Consulting Engineers, Inc., and is currently under construction.
We at Civil-Tech Consulting Engineers, Inc. were also, retained to observe the
construction of the retaining wall and subdivision improvements. It has been
brought to my attention, additional building permits for the wall have been
requested by you, The City of Zephyrhills. The contractor has contacted us
regarding the permit, and the questions regarding the footing for the retaining
wall. As the engineer retained to observe the construction of the retaining
wall, we have witnessed the earthwork preparation and steel placement within
the footing, and feel it meets the intent of our design.

(1) The terms. conditions. requirements, limitations and restrictions set forth in this pemlit. arc
Itpemlit conditions" and are binding and enforee:n~le pursuant to Seelions!403.141. 403.727, or 403.859
through 403.861. F.S. The permittee is placed on noliee that the Department will review this permit
periodically and may initiate enforcement action for any violation of these ~onditions" '

(2) This permit is valid only for the specific processes and opcmtiJns applied for and indicated in
the approved drawings or exhibits. Any unauthorized deviation from the approved drawings. exhibits,
specifications. or conditions of this permit may constitute grounds for revckation and enforcement action
by t'he Department. I

(3) As provided in Subsections 403.087(6) and 403.722(5), F.S., thc issuance of this pennit docs

not convey any vested rights or any exclusive privileges. Neither does it authorize any ifljury to public or
private property or any invasion ofpcrsonal rights. nor any infringement oIffedcral, state, or local laws or
regulations. This permit is not 0 waiver of or approval of any other ~partrnent permit that may be
required for o~ aspects of the total project which arc not addressed in \h~ permit.

(4) This permit conveys 'no title to land or water, docs not ~nstitutc State recognition or
aclmow1cdsment of title, and Dot constitute authority for t'he use of submerged lands unless herein
provided and the necessary title or leasehold interests havc been obtained from the State. Only the
Trustees of the Internal Improvement Trust Fund may express State opinio~ as to title.

(5) This permit does not relieve the: permittee from'1iabitity for tJm or injury to human health or
welfare; animal, or p~ant life, or property caused by the construCtion or operation of this permitted source,
, or from penalties therefore; nor does it allow the' permittee to cause pollution in 'contravention. of Florida
St:ltutes and Department rules. unless specifically authorized by an order from the Department.

(6) The permittee shall properly operate and maintain the facilitY and systcms of treatment and
cdnlToJ (and rclaledappurtenances) that are installed and used by 'the permiltee to achieve compliance
with the conditions of \his permit, as required by Department rules. This provision includes the operation
of backup or auxiliary facilities or similar systems when necessary to achieve compliance with the
conditions of the permit and when required by Department rules. !

(7) The permittee, by accepting this pennit, specifically agrees to allow authorized Department
personnel, upon presentation oi credentials or other documents as nmy be req\lired by law and at
reasonable times, access to the pcemiscs where the permitted activity is located or conducted to: '
(a) Have access to and. copy any records that must be kept under Jonditions of tllC pennit;
, (b) Inspect the facility, equipment, practices, or' operationS regulated or required under this
permit; and I' '
(c) Sample or monitor any substances or parameters at any lOcation reasonably necessary to
assure compliance with this permit or Departm!!=l1t rules. I

(8) H, for any reason, the permittee docs not comply with or witl be unable to comply with any
condiLion or limitation specified in this permit. the permittee shall immediately provide the Department

(9) In accepting this pennit, the permittee understands and agrees that all records, notes,
monitoring data and other information relating to Utc construction or o~ration of this permitted Source
which arc submitted to the Depl1rtment nmy be used by the Dcpanment as evidence in any enforccritent
case irrvolvint the permitted source arising under the Florida Statutes or pepartme:nt rules, except where
such use is prescribed by Sections 403.111 ilnd 403.73, P.s. Such evi~cnce shall only be used to thc
extent it is consistent with the Florida Rules of Civil Procedure and appropriate evidentiary rules.

(10) The pennittee agrees 10 comply with changes in Dcparbnenti rules and Florida Statutes after
a reasonable time for compliance; provided. however, the permittee dcks not waive any other rights
granted by Florida Statutes or Department rules. A rcnsonable time :for compliance with a new or
amended surface water quality standard. other than those standards addressed in Rule 62-302.500, shall
include a reasonable time: to obtain or be denied a mixing zone for the neW or amended standard.
(11) This pennit is transferable only upon Department approval in:nccordanee with Rule 62-4.120
and 62-730.300. F .A..c., as applicable. nle permittee shan be liable fpr any non-compliance of the
pemtitted activity until the transfer is approved by the Department. . . .

(14) The permittee shall comply with the following: I
(a) Upon request, the permittee shall fumish all records 'and plans required \U1der Department
rules. During enforcement actions, the retention period {or all records *ill' be extended automatically
unless otherwise stipulated by the Department. I
(b) The permittee shall hold at the facility or other location desi~ated by tIus pennit records of
all monitoting infOnn.,tion (including all calibration and maintenance records and a11 original strip chart
recordings .for continuous monitoriDg'.instnamentation) .required by the! permit, copies of all reports
required by this pcnnit, and records of all data used to complete the application for this permit These
materials shalt be retained at least three )'Cars from the date of the sample, measurement. report, or
Dpplication unless otherwise specified by Department rule. .

permit, including preliminary design report or drawings ~ specifications, if
there are any deviations from said pennit. (Nolc that it is necessary to submit
a copy of only the ponion of record drawings showing deviations and not a

3. Copies of satisfactory bacteriological analysis (a.k.a. Mai~ Clearance), taken
within sixty (60) days of completion of construction, from lOcations within the
distribution system or water main extension to be cleared, land in accordance~
with American Water Works Association (AWWA),Stantlard C 651-92, as

Within 30 days after completion of construction of the permitted actM~, the Permittee Shall submit
to the Tampa Service Office a written statement of completion and certification by a registered
professl,onal engineer or other appropriate IndiVidual as authorIZed byllaw, utiliZing the required

The District win also determine any potential environmental problems that may develap as a msult
of leaving or remOVing tho barriers and other measures during constrUction or after construction of
