Transportation Impact Fee Review

Dear Bill,
Pursuant to your request, I have reviewed the customer count and sales
information provided for the above referenced project and offer the following
comments regarding the transportation impact fee for the Quiznos and the
proposed reduction in impact fees based upon an internal capture percentage.
1. Based upon ITE Trip Generation, the Quiznos would be defined as a
fast-food restaurant without a drive-through window. According to the
City of Zephyrhills current Impact Fee Schedule, this land use category
is not listed on the table. Since this land use is not listed in the table, the
Ordinance allows that a similar land use category may be chosen or the
option to provide trip characteristic information specific to a Quiznos or
a similar fast-food restaurant without a drive-through window for use in
a revised impact fee rate. See the attached Table 1 for the rates
associated for a quality restaurant, high-turnover sit-down restaurant,
fast-food restaurant with drive through window and fast-food restaurant
without drive-through window. The rate for the fast-food restaurant
without drive-through window was calculated based upon the trip
generation rate from ITE, th Edition for LUC 933: fast-food restaurant
without drive-through window. The trip length and trip type variables
utilized were those used for the fast-food restaurant with drive-through
window land use.
2. The applicant is proposing that 30% of the trips are net new trips and that
70% of the trips are internal capture trips from the other uses existing in
the Merchant Square Center. Based upon ITE, the overall internal
capture percentage for the development is determined to be closer to
29 % by utilizing the square footages of the Merchant Square Center and
the proposed Quiznos (provided by the City). If an internal capture
percentage greater than 29% is requested to be used, then additional
information should be provided to support their assumption. Attached is
the ITE internal capture matrix detailing the internal capture percentage
determined for the development. In addition, Table 2 (attached) is a
comparison of the transportation impact fees based upon the current
Zephyrhills Ordinance and the revised transportation impact fees
applying the 29% internal capture rate.

3. Due to the fast food restaurant type land use, a portion of the trips
generated by the Quiznos will be pass-by trips. Based upon the
Ordinance, the fast-food restaurant land use category already utilizes a
59.5% net-new percentage, thereby the Ordinance takes into account
approximately 40.5% of pass-by or diverted trips in the equation.
4. Since there is no fast food restaurant without a drive-through window
land use category in the Impact Fee Ordinance, the customer count
information provided by the applicant could be used to determine an
alternative trip generation rate for the proposed Quiznos. This could be
calculated by taking the average number of customers for a typical
weekday and equating that number to vehicle trips (trip generation) to be
utilized in a revised impact fee rate.

Th~ undersigned understands that this permit may be subject to "deed restrictions" which
may be more restrictive than city regulations. The undersigned assumes responsibility for
compliance with any applicable deed restrictions.
B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, 'they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by law, both the owner and contractor may' be cited for a misdemeanor
violation under state law. If the owner or intended contractor are uncertain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephyrhills Building Department, 813-780-0020.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the
contractor(s) sign po~tions of the "Contractor Sections" of this application for which they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, rather than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indica~ion that he is not properly licensed and is
not entitled to permitting privileges in the City of Zephyrhills.

I certify that I, the applicant, have been provided with a copy 'of "Florida's Construction
lien Law - Homeowner's ,Protection Guide" prepared by the Florida Department of Agriculture
and Consumer Affairs. If the applicant is someone other that the "owner", I cerify that I
have obtained a copy of the above described document and promise in good faith to deliver
it to the "owner" prior to commencement.
E. CONTRACTOR'S/OWNER'S AFFIDAVIT
I certify that all the information in this application is accurate and that all work will
be done in compliance with all applicable laws regulating construction; zoning, and land
development.
Appli~ation is hereby made to obtain a permit to do work and installation as indicated. I
certify that no work or installation has commenced prior to issuance of a permit and that
all work will be performed to meet standards of all laws regulating construction, City
codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify that I understand that the regulations of other governmental agencies may apply to
the intended work, and that it is my responsibility to identify what actions I must take to

is prepared by a professional engineer registered in the State of Florida prior to permit
issuance.
A permit issued shall ,be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any p:ovisions of the technical.c~des,
nor shall issuance of a permit prevent the Building Off1cial from thereafter reqU1r1ng a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or a~andoned.for ~a
period of six months after the time,the work is commenced. One 90 d~y extens10n of t1me
may be allowed for the permit with fee charge of $~5.00. ,The extens10n shall b7 requeste~
in writing to 'the Building Official. An approved 1nspect1on must be logged dur1ng each S1X
month period, or the project will be considered abandoned. ,
