CONDITIONS OF PERMIT AFFIDAVIT
A. NOTICE OF DEED RESTRICTIONS
,The undersigned understands that this permit may be subject to "deed restrictions" which
may be more restrictive than City regulations. The undersigned assumes responsibility for
compliance with any applicable deed restrictions.
B. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES
If the owner has hired a contractor or contractors to undertake work, they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by law, both the owner and contractor may be cited for a misdemeanor
violation under state law. If the owner or intended contractor are uncertain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephyrhills Building Department, 813-780-0020.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the
contractor(s) sign portions of the "Contractor Sections" of this application for which they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, rather than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indication that he is not properly licensed and is
not entitled to permitting privileges in the City of Zephyrhills.

I certify that I, the applicant, have been provided with a copy of "Florida's Construction
lien Law - Homeowner's Protection Guide" prepared by the Florida Department of Agriculture
and Consumer Affairs. If the applicant is someone other that the "owner", I cerify that I
have obtained a copy of the above described document and promise in good faith to deliver
it to the "owner" prior to commencement.
E. CONTRACTOR'S/OWNER'S AFFIDAVIT
I certify that all the information in this application is accurate and that all work will
be done in compliance with all applicable laws regulating construction, zoning, and land
development.
Application is hereby made to obtain a permit to do work and installation as indicated. I
certify that no work or installation has commenced prior to issuance of a permit and that
all work will be performed to meet standards of all laws regulating construction, City
codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify that I understand that the regulations of other governmental agencies may apply to
the intended work, and that it is my responsibility to identify what actions I must take to
be in compliance. Such agencies include but are not limited to: *Department of
Environmental Regulation-Cypress Bayheads, Wetland Areas and Environmentally Sensitive
Lands, Water/Wastewater Treatment
*Southwest Florida Water Management District-Wells, Cypress Bayheads, Wetland Areas,
Altering Watercourses
*Army Corps of Engineers-Seawalls, Docks, Navigable Waterways
*Department of Health & Rehabilitative Services, Environmental Health Unit-Wells,
Wastewater Treatment, Septic Tanks
*U.S. Environmental Protection Agency-Asbestos abatement
I also certify that, if fill material is to be used in Flood Zone "A" or "A,etc.", it is
understood that a drainage plan addressing a "compensating volume" will be submitted which
is prepared by a professional engineer registered in the State of Florida prior to permit
issuance..
A permit issued shall be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any provisions of the technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for a
period of six months after the time the work is commenced. One 90 day extension of time
may be allowed for the permit with fee charge of $15.00. The extension shall be requested
in writing to the Building Official. An approved inspection must be logged during each six
month period, or the project will be considered abandoned.

This letter is formal notice that Murphy Oil USA, Inc., has agreed to the
following:
1. The Master Lease Agreement, dated August 22, 2005, between
Murphy Oil USA, Inc., and One Point Financial LLC. (Master Lease):
and,
2. All subsequent subleases entered into by One Point Financial LLC
as sub-lessor with sub-tenants who complete the A TM machine
obligations of One Point Financial LLC as provided and
contemplated in the Master Lease.
One Point Financial LLC is entitled to rely on this letter to carry our terms of
the Master Lease and enter into sub-leases One Point Financial LLC
deems necessary to satisfy its obligations under the Master Lease as long
as those obligations follow the intent as well as the letter of the Master
Lease.

Sub ContractinG Aoreement
This agreement is between Tara Construction Co.. Inc..lTCC) located at 422 Tlmbetwood Trail. Oviedo FL
32765 and One Point Financial.LLC. (OPF) beginning on this day of October, 2005. Tile attached e mail
dated September 29"', 2005 from Gregg Fowlkes is to be considered part of this agreement herein. The scope of
this project includes obtaining proper permits and complete the specified Usite workB in the state of Florida for the
installation of A TM machines and kiosks for OPF.
The followina structure is for work and Dermits within the allotted 75 mile radius/realon from Ovieda. as
outlined in the attached email: _

2. -Common/standardB pad- 4' x 6', including installing 2 guard posts......... ...... ................. ..each. $500.00
- To include all materials and specifications as outlined in architectural drawings

- Digital photos to be e mailed to OPF, atb1: Suel Bowen at job completion
3. Bollards/Guard posts to be "extra" cost, to be paid for by OPF @ $55.00 per post
-Purchased locally by TCC, to be reimbursed by OPF, and installed per plans
4. Required painting as per drawing (including painting each Bollard)...... ......................__ ...... .$125.00 per site
NOTE: Yellow "directional- lines must meet specifications. Master stencil supplied by OPF for the necessary
-letters/arrow" .
5. Larger, Alternate/Island drive up pad and curbing, per detailed specification (similar to McDonough, GA plan)
including installation of6 Bollards, curbing, 4' x 6' pad for kiosk, etc... ... ... ... ... ... ,'....... ............ .., @$1,35O.00
NOTE: Obtaining permits for these sites, to be same cost @$500.00

SECURING OF PERMITS OUTSIDE THE INITIAL 75 MILE RADIUS
TCC has agreed to obtain required permits outside the 75 mile area of interest, on a $500.00 per site + travel
expenses basis... ....... Travel expenses are defined as $.15 per mile. meals, and motel, IF NECESSARY.)
The additional travel cost will NOT exceed $200.00 Der sitelD8flllit, outside the 75 mile radius.
NOTE: We suggest that when obtaining pennit8 in "remote" locations (outside the 75 mile radius), multiple
permits are filed for and obtained in order to reduce travel time and expense. (

- TCC will provide receipts for each permit, per site, for reimbursement
- TCC will provide OPF with copies of permits
TCC agrees to allow our sub contractors to complete the necessary Dsite workD. per specifications, for each location
that TCC has obtained a permit TCC will simply be responsible for providing OPF with the permit. (TCC is NOT
responsible for completing any site work, clean up, material costs, labor, etc. at locations that are completed by OPF
subcontractors outside the 75 mile radius... TCC is relieved of any liability for site work.)
ADDITIONAL NOTES:
1. All correspondence should be either faxed to and/or e mailed to the attention of Suel Bowen. (f}770-

2. Terms. 50% prior to start of permit process. 50% balance due upon completion of work.
3. 100% immediate reimbursement for permit costs, upon receipt of permit costs from TeC.
4. Copies of all permits must be submitted to the attention of Suel Bowen.
5. Final payment will be issued immediately upon receipt of a digital photo of the completed site work.
(NOT including electrical work.)
6. TCC agrees to "manageD their electrical sub contractors for each site. and make sure that the specified
power/communication specifications are met, including proper permits for each location.
7. Electrical sub-mntractors will bill OPF directly, and be paid directly by OPF.
8. Electricians are responsible for supplying all permits. etc. directly to OPF.
9. Electrician is responsible for submitting digitaJ photos of completed work, in order to receive final
payment for each site.
10. Any additional expenses, charges, material costs, or variations/deviations from this price structure and
agreement MUST submitted in writing, and approved by OPF officer. All approvals will be in writing, with
