If the owner has hired a contractor or contractors to undertake work, they may be required
to be licensed in accordance with state and local regulations. If the contractor is not
licensed as required by law, both the owner and contractor may be cited for a misdemeanor
violation under state law. If the owner or intended contractor are uncertain as to what
licensing requirements may apply for the intended work, they are advised to contact the
City of Zephyrhills Building Department, 813-780-0020.
Furthermore, if the owner has hired a contractor or contractors, he is advised to have the
contractor(s) sign po~tions of the nContractor Sections" of this application for which they
will be responsible. If you, as the owner signs as the contractor, you are indicating that
you, rather than the contractor, are responsible for the work. If the contractor wishes
you to sign as contractor that may be an indication that he is not properly licensed and is
not entitled to permitting privileges in the City of Zephyrhills.

be done in compliance with all applicable laws regulating construction, zoning, and land
development.
Appli~ation is hereby made to obtain a permit to do work and installation as indicated. I
certify that no work or installation has commenced prior to issuance of a permit and that
all work will be performed to meet standards of all laws regulating construction, City
codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify that I understand that the regulations of other governmental agencies may apply to
the intended work, and that it is my responsibility to identify what actions I must take to

I also certify that, if fill material is to be used in Flood Zone nA" or nA,etc.", it is
understood that a drainage plan addressing a ncompensating volume" will be submitted which
is prepared by a professional engineer registered in the State of Florida prior to permit
issuance.
A permit issued shall be construed to be a license to proceed with the work and not as
authority to violate, cancel, alter, or set aside any provisions of the technical codes,
nor shall issuance of a permit prevent the Building Official from thereafter requiring a
correction of errors in plans, construction, or violations of any code. Every permit
issued shall become invalid unless the work authorized by such permit is commenced within
six months of issuance, or if work authorized by the permit is suspended or abandoned for la
period of six months after the time the work is commenced. One 90 day extension of time
may be allowed for the permit with fee charge of $15.00. The extension shall b~ requeste~
in writing to the Building Official. An approved inspection must be logged durlng each SlX
month period, or the project will be considered abandoned.

REGULAR COUNCIL MEETING
A Regular Council Meeting was held on November 28, 2005 at 6:00 p.m. in the Robert
H. Johnson Council Chambers of the Municipal Building.
President Compton called the meeting to order. Roll call was taken. Present were
members Clyde Bracknell, Daniel Burgess, Cathi Compton, Elizabeth Geiger, Gina King and
Mayor Cliff McDuffie. City Manager Steve Spina and City Attorney Karla Owens were also
present.
Staff present: Police Captain Randy Belasic, Fire Chief Robert Hartwig, Utilities
Superintendent Louie Sellars, Public Works Director Rick Moore, Building Official Bill
Burgess, Director of Administrative Services Sharry Boldt, Director of Development Todd
Vande Berg, and City Clerk Linda Boan.
A Moment of Silence was observed. The Pledge of Allegiance followed. Clyde
Bracknell moved the minutes ofthe November 14,2005 Regular Meeting and the November 14,
2005 Workshop be approved. Seconded by Daniel Burgess. Motion passed unanimously.
PUBLIC HEARING
I. Third Reading Ordinance #932-05 - Park and Cemetery Changes
Ordinance #932-05 was read by title. Elizabeth Geiger moved Ordinance #932-05 be
passed on the third reading. Seconded by Clyde Bracknell. There were no comments from the
audience or Council. Motion passed 4-1 with Councilwoman King voting against the motion.
A public hearing for a conditional use petition for a duplex unit in an Office Professional zoning
district was requested to be added to the agenda as an emergency item. Mayor McDuffie
approved the request.
Clyde Bracknell moved the item be added to the agenda as emergency item. Seconded
by Gina King. Motion passed unanimously.
A public hearing was advertised and signs were posted on the property for this public
hearing to allow a duplex unit in an office professional zone as a conditional use. There were no
comments from the audience or Council.
Elizabeth Geiger moved the request from Kevin and Tammy Ryman for a duplex in an
office-professional zone be approved. Seconded by Daniel Burgess. Motion passed
unanimously.
Item 4 was moved to this place on the agenda.
4. Noise Study
Mr. Spina provided a copy of the noise study performed by the LP A Group. Richard
Osborne from LPA was present and reviewed the study. The purpose of the study included:
request acceptance of the noise analysis; inform F AA/FDOT of proposed development near the
airport; ensure there is no impact to future development of the airport; determine if proposed
development impacts the ability of the airport to receive future FAA and FDOT grants; and
ensure that the City is well informed prior to taking any action on proposed development near the
airport.
Elizabeth Geiger moved the noise study be forwarded to FAA and FDOT for review.
Seconded by Clyde Bracknell. Motion passed unanimously.
Item 8 was moved to this place on the agenda.
8. First Reading Ordinance #941-05 - Special Basin
Ordinance #941-05 was read by title. Director of Engineering Services in Pasco County
Jim Widman explained the ordinance which provides stricter drainage requirements in basins of
special concern Pasco County previously adopted and encouraged City Council to consider
adopting this ordinance which was modeled after the ordinance from the county.
Gina King moved Ordinance #941-05 be passed on the first reading. Seconded by
Elizabeth Geiger. Motion passed unanimously.

SELLARS
2. RFP Utility Rate Study
Mr. Sellars said a request for proposals was advertised for a rate study for water and
sewer and also connection fees. Five companies sent proposals and after reviewing, three were
selected to give a ten minute presentation to City Council. Those firms giving the presentations
were: Burton and Associates, Public Resources Management Group; and Raftelis Financial
Consultants.
Clyde Bracknell moved the firms be ranked 1) Public Resources Management Group; 2)
Raftelis Financial Consultants; and 3) Burton and Associates. Seconded by Gina King. Motion
passed unanimously.

3. Appointment to Planning Commission
Todd Vande Berg said due to the resignation of Norman Ward there is a vacancy on the
Planning Commission for the appointment of Seat 1. He recommended Mike Prilliman move
from the 1 st alternate position to the appointment for Seat 1 and Tracy Sullivan move from the
2nd alternate position to the 1 st alternate fosition. He also recommended John Roeske, 389331
Eucalyptus Drive be appointed to the 2n alternate position.
Elizabeth Geiger moved Mike Prilliman be appointed to Seat 1, Tracy Sullivan the 1 st
alternate and John Roeske the 2nd alternate. Seconded by Daniel Burgess. Motion passed
unanimously.
CITY MANAGER'S REPORT
4. Noise Study
Previously addressed.
5. Request to Cancel December 26 Regular Council Meeting
Mr. Spina requested the December 26 meeting be cancelled.
Clyde Bracknell moved the December 26 regular Council meeting be cancelled.
Seconded by Elizabeth Geiger. Motion passed unanimously.
6. Calendar for Charter Revision TimelinelSchedule of City Council Meetings for 2005
Mr. Spina provided a schedule of meetings for the next three months and requested
Council consider scheduling a couple of workshops for Charter review.
The consensus of Council was to meet December 12 at 4:00 p.m., December 21 at 5:00
p.m. and January 9 at 4:00 p.m.
7. Expiring Terms of Economic Development Committee
Mr. Spina said the terms for the economic development committee expire November 30.
All members have indicated they would like to be reappointed. In August the ordinance was
amended to increase the size of the board giving the Airport Authority a nomination and the
Chamber of Commerce three nominations. At this time the Chamber has one nomination and the
final three names will be provided at the December 12 meeting.
Elizabeth Geiger moved the existing members of the economic development committee
be reappointed and the Chamber's nominee John Scott be appointed. Seconded by Gina King.
Motion passed unanimously.

CITY ATTORNEY'S REPORT
8. First Reading Ordinance #941-05 - Special Basin
Previously addressed.
9. First Reading Ordinance #943-05 - Special Event Permit
Ordinance #943-05 was read by title. A draft special event application was also provided
for future evaluation. The limits of liability regarding the use/serving/sale of alcohol will be
changed from two million to one million per the City's insurance carrier. Sharry Boldt advised
the City of Zephyrhills will be named as additional insured on an insurance certificate provided
to the City. The following persons spoke from the floor voicing their concerns how the
ordinance will affect their organization: Representing Mainstreet - Terry Linville, 5215
Bernadette Drive; Sheri Schwab, 5301 Bernadette Drive; Representing the Chamber of
Commerce - Donna French, 35811 Brisa Drive.
Clyde Braclrnell moved Ordinance #943-05 be passed on the first reading with the noted
changes. Seconded by Gina King. Motion passed unanimously.
10. First Reading Ordinance #944-05 - Street Naming Policy - Code Amendment
Ordinance #944-05 was read by title. Clyde Bracknell moved Ordinance #944-05 be
passed on the first reading. Seconded by Daniel Burgess. Councilman Braclrnell said he would

memorial/honorarium signs would be a different color. Councilwoman Geiger questioned page
1, section B2 suggesting "and" be changed to "or". Councilman Braclrnell amended his motion
to include the suggested change. Councilman Burgess amended the second. Vote was taken on
the amendment and passed 4-1 with Councilwoman King voting against the amendment.
Vote was taken on passage of the ordinance as amended and passed 3-2 with
Councilwomen Geiger and King voting against the motion.

Ordinance #945-05 was read by title. Daniel Burgess moved Ordinance #945-05 be
passed on the first reading. Seconded by Clyde Braclrnell. Motion passed 3-2 with
