NOTICE OF DEED RESTRICTIONS: The undersigned understands that this permit may be subject to "aeed" restrictions"
which may be more restrictive than County regulations. The undersigned assumes responsibility for compliance with any
applicable deed restrictions.
UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES: If the owner has hired a contractor or
contractors to undertake work, they may be required to be licensed in accordance with state and local regulations. If the
contractor is not licensed as required by law, both the owner and contractor may be cited for a misdemeanor violation
under state law. If the owner or intended contractor are uncertain as to what licensing requirements may apply for the
intended work, they are advised to contact the Pasco County Building Inspection Division-Licensing Section at 727-847-
8009. Furthermore, if the owner has hired a contractor or contractors, he is advised to have the contractor{s) sign
portions of the "contractor Block" of this application for which they will be responsible. If you, as the owner sign as the
contractor, that may be an indication that he is not properly licensed and is not entitled to permitting privileges in Pasco
County.
TRANSPORTATION IMPACT/UTILITIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands
that Transportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings, change of
use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89-07 and
90-07, as amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of
permitting. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receiving a "certificate of occupancy" or final power release. If the project does not involve a certificate of occupancy or
final power release, the fees must be paid prior to permit issuance. Furthermore, if Pasco County Water/Sewer Impact
fees are due, they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances.
CONSTRUCTION LIEN LAW (Chapter 713, Florida Statutes, as amended): If valuation of work is $2,500.00 or more, I
certify that I, the applicant, have been provided with a copy of the "Florida Construction Lien Law-Homeowner's
Protection Guide" prepared by the Florida Department of Agriculture and Consumer Affairs. If the applicant is someone
other than the "owner", I certify that I have obtained a copy of the above described document and promise in good faith to
deliver it to the "owner" prior to commencement.
CONTRACTOR'S/OWNER'S AFFIDAVIT: I certify that all the information in this application is accurate and that all work
will be done in compliance with all applicable laws regulating construction, zoning and land development. Application is
hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has
commenced prior to issuance of a permit and that all work will be performed to meet standards of all laws regulating
construction, County and City codes, zoning regulations, and land development regulations in the jurisdiction. 'also
certify that I understand that the regulations of other government agencies may apply to the intended work, and that it is
my responsibility to identify what actions I must take to be in compliance. Such agencies include but are not limited to:
Department of Environmental Protection-Cypress Bayheads, Wetland Areas and Environmentally Sensitive
Lands, Water/Wastewater Treatment.
Southwest Florida Water Management District-Wells, Cypress Bayheads, Wetland Areas, Altering
Watercourses.
Army Corps of Engineers-Seawalls, Docks, Navigable Waterways.
Department of Health & Rehabilitative Services/Environmental Health Unit-Wells, Wastewater Treatment,
Septic Tanks.
US Environmental Protection Agency-Asbestos abatement.
Federal Aviation Authority-Runways.
I understand that the following restrictions apply to the use of fill:
Use of fill is not allowed in Flood Zone "V" unless expressly permitted.
If the fill material is to be used in Flood Zone "A", it is understood that a drainage plan addressing a
"compensating volume" will be submitted at time of permitting which is prepared by a professional engineer
licensed by the State of Florida.
If the fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall
construction, I certify that fill will be used only to fill the area within the stem wall.
If fill material is to be used in any area, I certify that use of such fill will not adversely affect adjacent
properties. If use of fill is found to adversely affect adjacent properti~s, the. ow~er may be cited for violating
the conditions of the building permit issued under the attached permit appllcatron, for lots less than one (1)
acre which are elevated by fill, an engineered drainage plan is required.
If I am the AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in

Plan Review Comments
I have reviewed and approved the plan for an interior remodel located at 5117 Gall Blvd
under the following conditions. My comments have been placed below. Please contact
me if you have any questions with regards to my comments.
1. Firewall shall be screwed accordingly. Interior layer I" type "s" screw 12" OC in
field and 8" OC along all edges/joint. Second layer 1 5/8" type "S" screw
patterned the same way as the first layer. Firewall shall be fire caulked at roof
deck and down ends of wall. Firewall shall be labeled "FIREWALL DO NOT
PENETRATE".
2. Panic hardware required on rear exit.
3. Fire rated door shall have a fire rating of 1 hr 45 minutes. Certification plate shall
be on door for identification.
4. Smoke detectors shall be installed in all storage related areas, hardwired with
battery backup and tied together.
5. Exit signs in retail area shall be battery backup with emergency lighting. If not
separate emergency light shall be installed in the retail area
6. Set up retail area to have adequate aisle space to accommodate wheel chair
access.
7. Certified fire extinguisher required in retail area and shop area
Inspections required: (call inspections into building department)
1. Firewall inspection. Each layer shall have a screw inspect and 1 overall final.
2. Building final.

1.1 Frame: The frame jambs consist of finger jointed pine with all comers
coped, butted. and sealed using three 2" long wire staples (.04375").
1.2 Mullion Construction: Where used, each mullion constructed of
laminated lumber with a pine cap and attached to the header and threshold
with three #10 x 3" Philips Flat Head Wood Screws.
1.3 Glazing: Where used. the overall insulated glass was glazed into a rigid
plastic lip-lite frame. Consisted of symmetric monolithic insulated glass

LEASE AGREEMENT with PURCHASE OPTION
This lease/option to purchase agreement was entered into on October 26, 2007,
between Raby D. Williams Jr. and Alan D. Davidson, individuals, residing at 3410 Tally
Court, Tampa, FL 33618, referred to as "lessor," and Richard S. Hawthorne Sr, an
individual, dlb/a Pasco Power Equipment, to have its principal place of business at 5117 '
Gall Boulevard, Zephyrhills, Pasco County, Florida, referred to as "lessee."

DESCRIPTION OF PREMISES
Lessor leases to lessee the premises located at 5117 Gall Boulevard, Zephyrhills,
Pasco County, Florida, and described more particularly as follows:

SECTION TWO
TERM
The term of this lease/Qptionto purchase agreement is two years, beginning on
October 26,2007, and terminating on October 26, 2009.
SECTION THREE
RENT
A. The total rent under this lease/option to purchase agreement is $64,800.
B. Lessee shall pay Lessor's mortgage holder the above-specified amount in
installments of $2,700 each month, beginning on November 1, 2007, with succeeding
payments due on the 5th of each month. Payments received by the mortgage company
after 5:00 PM on the 5th of the month will incur a late fee of $133.77 and Lessee is
responsible for payment of the late fee if one is incurred. A payment for sales tax, in the
amount of $182.59 will be paid by Lessee to Lessor each month, due on the 5lh of each month.

paid to Lessor by Lessee, as down payment to be credited toward the purchase price,
agree to sell to Lessee, at Lessee's option, the following property now owned by Lessor,
namely: 5117 Gall Boulevard, Zephyrhills, Pasco County, Florida. and described more
particularly as follows:

And all buildings, signage, fencing, additions thereon, subject to the following terms
and conditions:
1. This option is to continue for 60 days from the date of lease termination or new-
lease termination.
2. The price to be paid for the property, if this option is exercised, is $385,000, this
amount decreased by the down payment given at the commencement of the
lease, in the amount of $10,000, and decreased by $600 of each monthly lease
payment. Lessee's payments of taxes, insurance, finance fees, late fees,
improvements, permits, will not be deducted from the purchase price.
3. Proof of payment of mortgage and related charges on a monthly basis needs 0 be
supplied from Lessee to Lessor no later than the 26th of each month, proof is a
copy of the check drawn and acopy of a certified receipt provided by the post
office.
4. The $10,000 down payment is not refundable to Lessee if Lessee does not
exercise its option to purchase. The $10,000 is refundable to Lessee if Lessor
violates the lease agreement in a material way.
5. After payment is made in full to Lessor and/or Lessor's mortgage company,
Lessor agrees to execute and deliver to Lessee a bill of sale and deed conveying
the property to Lessee, and to deliver possession of the premises described
herein to Lessee or his assigns, in as good condition as it now is, reasonable wear
and tear excepted, and free of all liens and encwnbrances.

SECTION FIVE
USE OF PREMISES
The demised premises are to be used for the purposes of sales and service of new and
used equipment, recreational vehicles, parts, fixtures, and lawn and garden products.
Lessee shall restrict its use to such purposes, and shall not use or permit the use of the
demised premises for any other purpose without the prior, express, and written consent of
Lessor, or Lessor's authorized agent.
SECTION SIX
RESTRICTIONS ON USE
A. Lessee shall maintain insurance on the premises.
B. Lessee shall not keep, use, or sell anything prohibited by any policy of ftre
insurance covering the demised premises, and shall comply with all requirements of the
insurers applicable to the demised premises necessary to keep in force the tire and
liability insurance.
SECTION SEVEN
WASTE, NUISANCE, OR UNLAWFUL ACTIVITY
Lessee shall not allow any waste or nuisance on the demised premises, or use or allow
the demised premises to be used for any unlawful purpose.
SECTION EIGHT
DELAY IN DELIVERING POSSESSION
This lease/option to purchase agreement shall not be rendered void or voidable by the
inability of Lessor to deliver possession to Lessee on the date set forth in Section Two,
and Lessor shall not be liable to Lessee for any loss or damage suffered by reason of such
a delay; provided, however, that Lessor does deliver possession no later than 10 days
after the date set forth in Section Two. In the event of a delay in delivering possession,
the rent for the period of such delay will be deducted from the total rent due under this
lease/option to purchase agreement. No extension of this lease/option to purchase
agreement shall result from a delay in delivering possession. The lease/option to
purchase agreement may be rendered void at the Lessee's option if the Lessor cannot
deliver possession to Lessee within 10 days after the date set forth in Section Two.

SECTION NINE
UTILITIES
Lessee shall arrange and pay for all utilities furnished to the demised premises for the
term of this lease/option to purchase agreement, including, but not limited to, electricity,
gas, water, sewer, and telephone service.
SECTION TEN
REPAIRS AND MAINTENANCE
Lessee shall maintain the demised premises and keep them in good repair at its
expense. Lessor shall assist Lessee in procuring permits for renovations, costs of
procurement of permits to be borne by Lessee.
SECTION ELEVEN
DELIVERY, ACCEPTANCE, AND SURRENDER OF PREMISES
A.. Prior to entering into this contract and acceptance of the premises, the premises
shall be inspected by the County and/or City Building Department and Fire Marshal. In
the event either or both departments or other government entity with such powers render
the demised premises unfit for use by the Lessee for conducting business as the Lessee
intends to use the premises for, or either or both departments or other government entity
requires repairs, additions or deletions from the existing property, the Lessee will not
accept the property, will not enter into this contract and all other verbal negotiations
related hereto shall be rendered null and void.
B. In the event the Lessee does not exercise its option to purchase, Lessee shall
surrender the demised premises at the end of the lease term, or any renewal of such term,
in the same condition as when Lessee took possession, allowing for improvements and
reasonable use and wear, and damage by acts of God, including fires and storms. Before
delivery, Lessee shall remove all business signs placed on the demised premises by
Lessee and restore the portion of the demised premises on which they were placed in the
same condition as when received. In the event the Lessee does not exercise its op;tion to
purchase, the lease payments and $10,000 down payment is not refundable to the Lessee.
SECTION TWEL VB
ENTRY ON PREMISES BY LESSOR
A. Lessor reserves the right to enter on the demised premises during business hours, at
reasonable times; however, Lessor shall not interfere with Lessee's ability to conduct
business.
B. Lessee may erect scaffolding, fences, and similar structures, post relevant notices,
and place moveable equipment in connection with making alterations, additions, or

repairs, all without incurring liability to Lessor for disturbance of quiet, enjoyment of the
demised premises, or loss of occupation of the demised premises.
SECTION THIRTEEN
SIGNS, AWNINGS, AND MARQUEES INSTALLED BY LESSEE
A. Lessee may construct or place signs, awnings, marquees, or other structures
projecting from the exterior of the demised premises without the prior, express, and
written consent of lessor.
SECTION FOURTEEN
NONLIABILITY OF LESSOR FOR DAMAGES
Lessor shall not be liable for liability or damage claims for injury to persons or
property from any cause relating to the occupancy of the demised premises by Lessee,
including those arising out of damages or losses occurring on sidewalks and other areas
adjacent to the demised premises during the term of this lease/option to purchase
agreement or any extension of such term. Lessee shall indemnify Lessor from any and all
liability, loss, or other damage claims or obligations resulting from any injuries or losses
of this nature.
SECTION FIFTEEN
LIABILITY INSURANCE
A. Lessee shall procure and maintain in force at its expense during the term of this
lease/option to purchase agreement and any extension of such term, public liability
insurance. Such coverage shall be adequate to protect against liability for damage claims
through public use of or arising out of accidents occurring in or around the demised
premises, in a minimwn amount of $5,000 for each person injured, $5,000 for anyone
accident, and $5,000 for property damage. The insurance policies shall provide coverage
for contingent liability of Lessor and/or Lessor's mortgage holder on any claims or
losses. Lessee shall obtain a written obligation from the insurers to notify Lessor in
writing at least 15 days prior to cancellation or refusal to renew any policy.
B. If the. insurance policies required by this section are not kept in force during the
entire term of this lease/option to purchase agreement or any extension of such term,
Lessor may procure the necessary insurance and pay the premiwn for it, and the premiwn
shall be repaid to Lessor as an additional rent installment for the month following the
date on which the premiwns were paid by Lessor.

SECTION THIRTY
