The undersigned assumes responsibility for compliance with any applicable deed restrictions. UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES: If the owner has hired a contractor or contractors to undertake work, they may be required to be licensed in accordance with state and local regulations. If the contractor is not licensed as required by law, both the owner and contractor may be cited for a misdemeanor violation under state law. If the owner or intended contractor are uncertain as to what licensing requirements may apply for the intended work, they are advised to contact the Pasco County Building Inspection Division—Licensing Section at 727-847- 8009. TRANSPORTATION IMPACT/UTILITIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands that Transportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings, change of use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89-07 and 90-07, as amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of permitting. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to receiving a "certificate of occupancy" or final power release. If the project does not involve a certificate of occupancy or final power release, the fees must be paid prior to permit issuance. Furthermore, if Pasco County Water/Sewer Impact fees are due, they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances. You have already received two (2) letters from Stephen Carle, Esquire and have chosen not to comply with the terms of those letters. In addition, Jim Cuva, the Personal Representative/Executor, contacted you and on February 19 of this year you agreed to complete the pool by March 19, 2008. Again, you have failed to meet that obligation. What is even more troubling, is that you received a draw for future work in the amount of $12,178.75, but have failed to do the work for which those monies were paid. You have not put in the solar panels, the blowers, the generators, etc. and have again, as you have throughout the term of this contract, drug your feet and failed to reply to reasonable requests that you comply with the terms of your contract in good faith. Even of more concern is the fact that you finished five (5) other pools that you entered into agreements for subsequent to entering into this agreement. My client worries that you took the funds provided to you by my client, in contravention of Florida Statute, and co-mingled it with other funds and paid bills for other pools. We sincerely hope this is not the case. All you have done up to May of this year, after your agreement to finish the pool by March, was to acid wash the pool and do some plumbing. Jim Smith JTB Pool Contracting, Inc. August 14, 2008 Page Two The purpose of this letter is simple: You are to contact this office within ten (10) working days from the date of this letter. If you do not contact this office within ten (10) working days, please take this as our notice to you that you have breached the contract and you are no longer allowed on the premises. We will then be having some third party complete this pool, which will include the rock waterfall, safety fence, etc., and will file suit for our damages. Please be also advised that if upon looking into this matter, we believe you have co-mingled the funds, or used our funds for another job or other bills, we will determine at that point whether or not to file a complaint for treble damages for civil theft. It would be a simple matter to finish this pool, and I do not believe there will be a court in the country that would state that failing to finish a pool of this nature in fifteen (15) months is reasonable.
