which may be more restrictive than County regulations. The undersigned assumes responsibility for compliance with any
applicable deed restrictions.
UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES: If the owner has hired a contractor or
contractors to undertake work, they may be required to be licensed in accordance with state and local regulations. If the
contractor is not licensed as required by law, both the owner and contractor may be cited for a misdemeanor violation
under state law. If the owner or intended contractor are uncertain as to what licensing requirements may apply for the
intended work, they are advised to contact the Pasco County Building Inspection Division — Licensing Section at 727 -847-
8009. Furthermore, if the owner has hired a contractor or contractors, he is advised to have the contractor(s) sign
portions of the "contractor Block" of this application for which they will be responsible. If you, as the owner sign as the
contractor, that may be an indication that he is not properly licensed and is not entitled to permitting privileges in Pasco
County.
TRANSPORTATION IMPACTIUTILlTIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands
that Transportation Impact Fees an0 Recourse Recovery Fees may apply to the construction of new buildings, change of
use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89 -07 and
90 -07, as amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of
permitting. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receiving a "certificate of occupancy" or final power release. If the project does not involve a certificate of occupancy or
final power release, the fees must be paid prior to permit issuance. Furthermore, if Pasco County Water /Sewer Impact
fees are due, they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances.
CONSTRUCTION LIEN LAW (Chapter 713, Florida Statutes, as amended): If valuation of work is $2,500.00 or more, I
certify that I, the applicant, have been provided with a copy of the "Florida Construction Lien Law — Homeowner's
Protection Guide" prepared by the Florida Department of Agriculture and Consumer Affairs. If the applicant is someone
other than the "owner ", I certify that I have obtained a copy of the above described document and promise in good faith to
deliver it to the "owner" prior to comrnencement.

will be done in compliance with all applicable laws regulating construction, zoning and land development. Application is
hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has
commenced prior to issuance of a permit and that all work will be performed to meet standards of all laws regulating
construction, County and City codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify that I understand that the regulations of other government agencies may apply to the intended work, and that it is

the conditions of the building permit issued under the attached permit application, for lots less than one (1)

If I am the AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in
this affidavit prior to commencing construction. I understand that a separate permit may be required for electrical work,
plumbing, signs, wells, pools, air conditioning, gas, or other installations not specifically included in the application. A
permit issued shall be construed to be a license to proceed with the work and not as authority to, violate, cancel, alter, or
set aside any provisions of the technical codes, nor shall issuance of a permit prevent the Building Official from thereafter
requiring a correction of errors in plans, construction or violations of any codes. Every permit issued shall become invalid
unless the work authorized by such permit is commenced within six months of permit issuance, or if work authorized by
the permit is suspended or abandoned for a period of six (6) months after the time the work is commenced. An extension
may be requested, in writing, from the Building Official for a period not to exceed ninety (90) days and will demonstrate
justifiable cause for the extension. If work ceases for ninety (90) consecutive days, the job is considered abandoned.

Requirements for Compliance: Please refer to the attached Land Development
Code, Section 7.07.02, 7.07.03 and City of Zephyrhills Ordinance 866 -04. Some of the
basic requirements are but are not limited to:
1. New approved materials

4. Clear site triangle to be maintained
5. Water Meters. Shall not be fenced in without prior approval.

Sec. 7.06.04.05 Required Landscaping in Off- Street Parking Area
All off - street parking areas, except single family and duplex structures, shall meet the following
landscape requirements:
A. A permit shall be required for the development or redevelopment of any off - street parking
area to serve an existing use. Such permit is required when the parking area is (re)developed
separately from the existing use, or is part of a development order application process.
B. An off- street parking area which abuts a public right -of -way shall include a landscaped strip
on the perimeter of the parking area adjacent to the right -of -way.

C. In addition to the landscaping required in B. above, additional landscaping equal to at least
five percent of the total off - street parking area shall be provided in the interior of the parking
area. Perimeter landscaping beyond the minimum required may not be counted as part of the
interior landscaping requirement. Interior landscaping may be in one or more areas to total the
five percent requirement. Interior landscaping shall include at least one tree for each four
hundred square feet, or fraction thereof, of interior landscaped area.
D. Off - street parking areas which abut an area designated, approved, or developed for
residential use shall provide a landscaped strip along the perimeter of the parking area adjacent
to the residential area.
E. All landscaped areas required in this section shall be protected from encroachment by a
barrier such as curbs, wheel stops, or similar devices consistent with parking lot specifications.
PART 7.07.00 FENCES, WALLS AND HEDGES
Sec. 7.07.01 Applicability
This Section shall apply to any man -made barrier or hedge erected for the purpose of
enclosureoexclusion, ^protection, privacy, security, retainment or aesthetics except those owned
and erected by governmental agencies and utility companies.
Sec. 7.07.02 General Standards
1. Fences, walls, or hedges shall not be permitted within any City, County, or State rights-of-
way. Fences, walls or hedges shall not be permitted within an easement granted to the City
except by approval of City Council. Any structures erected or plants planted in violation of
this section are subject to removal by the City, and in no case shall the City be liable for
removal, restoration, or compensation costs. Any damage to a City owned utility caused by
fence or wall installation shall be repaired by the City at the expense of the property owner,
including any sodding that may be necessary.
2. All fences to be build shall comply with the Standard Building Code. The posts of each fence
must be resistant to decay, corrosion, and termite infestation. Each fence or wall erected
pursuant to this section shall be of uniform construction and properly maintained and in no
case shall a fence or wall either be erected or maintained in such a manner as to degrade
neighborhood amenities.or reduce surrounding property values, or maintained in such a
state of disrepair so as to pose a hazard.

Article VII Design Standards and Improvement Requirements
3. All fences and walls must be constructed of new materials. Walls and fences shall not
contain substances such as broken glass, spikes, exposed nails, or similar items designed
to inflict injury or pain. Barbed wire is prohibited in all zoning districts except LI, C -3, C -2,
AP -2 and ER.
4. Fences or hedges may be located in all front, side and rear yard setback areas. Fences
shall not exceed the height of six feet in residential and OP districts, and 8 feet in
commercial and industrial districts. A fence required for safety and protection of hazard by a
public agency is not subject to height limitations. Approval to exceed height standards may
be given by the Director of Development upon receipt of satisfactory evidence of the need to
exceed height standards.
5. In areas where the property faces two roadways, or is located in any other area construed to
be a comer lot, no fence shall be located in the clear sight triangle. A clear sight triangle is
required to maintain a minimum of 200 feet sight distance for motorists at all intersections of
roadways or roadways and railroads. The minimum clear sight triangle area is formed by the
center lines of intersecting roadways and a diagonal line connecting points on the center
lines which are 90 feet from the intersection of center lines. The clear sight triangle must be
free from obstructions such as wails, fences, plants, landscape materials or parked vehicles
in excess of 30 inches above the abutting roadway.
6. The finished side of any fence or wall shall face the adjoining lot or right -of -way.
7. No fence or hedge shall be construed or installed in such a manner as to interfere with
drainage on the site.
8. Any fence, wall, or hedge which becomes dilapidated or unsafe or is damaged in excess of
30% of its total shall be ordered removed by the Building Official.
9. Any nonconforming fence damaged in excess of 30% shall be removed in its entirety, or if
rebuilt such reconstruction shall place the entire fence in conformance with this Code
Sec. 7.07.03 Additional Standards in Residential Districts
1. On residentially zoned property, fences, walls, and hedges may be erected, planted, or
maintained to a height not exceeding six feet in the required side and rear yards, except that
portion of the fence or wall within the required front yard setback shall not exceed four feet.
2. For corner lots located in residentially zoned districts, a six foot fence is permitted on the
property line of the secondary front yard provided the clear sight triangle is maintained.
C. Office /Professional District
1. In the office /professional district a six foot fence shall be permitted provided the clear
sight triangle is maintained.

Sec. 7.07.04 Additional Standards in Commercial /Industrial Districts
1. In commercial and industrial districts an eight foot fence shall be permitted provided the clear
sight triangle is maintained.
2. For security purposes, fences in commercial and industrial districts may be topped with
barbed wire of not more than three strands, provided the lowest strand is not less than 6.5 feet
above grade. Such wire shall riot overhang adjacent property.
Sec. 7.07.05 Permit Required
All persons desiring to construct any fence or wall must first obtain a permit from the Building
Department. All applications shall include a plot plan showing the location of all streets,
easements, property lines, and buildings. Permit fees shall be based on the value of
construction with a minimum fee to be determined by the Building Official.
The property owner, prior to construction of any fence or wall, shall assume the responsibility for
determining by survey the correct boundaries of the property to be fenced and the existence of
any easement or rights -of -way that exist. Failure to provide the Building Department with
complete and accurate information when applying for a permit shall be sufficient cause for the
Building Official to order the removal of any construction not in compliance with this Code.
The procedures for issuance of a permit under this Section are prescribed in Article Xl.

G. Where tums are required in the exit lane, the minimum distance from any drive -up
station to the beginning point of the curve shall be 34 feet. The minimum inside turning
radius shall be 25 feet.
Sec. 7.03.03.04 Clear Sight
In order to provide a clear view of intersecting streets to the motorist, there shall be a triangular
area of clear visibility formed by two intersecting streets or the intersection of a driveway and a
street. The following standards shall be met:
A. A clear sight triangle is required to maintain a minimum of 200 feet sight distance for
motorists at all intersections of roadways or roadways and driveways.
B. The clear sight triangle must be free from obstruction such as vehicles, walls, fences, plants,
or landscape materials in excess of 30 inches above the abutting roadway.
The above provisions shall not apply to the intersection of an alley and a street. At each
intersection of an alley and street, each landowner must maintain a setback of no less than 10
feet from right -of -way of streets and alleys. The setback area must be maintained free from
sight obstruction by vehicles, walls, fences, plants, landscaping materials, or other opaque
objects in excess of 30 inches above the abutting roadway.
Sec. 7.03.04 Off - Street Parking and Loading
Sec. 7.03.04.01 Intent
It is the intent of these standards to ensure the appropriate location and quantity of off - street
parking and to ensure that all developments provide for adequate and safe storage and
movement of vehicles consistent with good site design principles.
Sec. 7.03.04.02 Applicability
The provisions of this section shall apply to all development approved commencing with the
effective date of this Code. The provisions of this section shall apply to redevelopment, or
amendments to existing development approvals, as follows:
A. All parking lot development shall be done in accordance with this section.
B. For those uses not specifically mentioned herein, off - street parking shall be provided on the
basis of the parking requirements of comparable uses, in the judgment of the Building Official.
C. Where a building has a change in use which requires additional parking, such use shall not
be licensed until requirements for the additional parking have been met.
D. As a result of change in use, or expansion of a business, when an existing unpaved parking
lot is:
1. increased in size by fifty percent, or
2. the number of required parking spaces is increased by twenty -five percent, both the
new portion and remaining unpaved portion shall be improved to the paving standard
stated herein.

WHEREAS, the City of Zephyrhills previously adopted clear site triangle regulations as part of
the Land Development Code; and
WHEREAS, the City has undergone tremendous development and growth over the past decade;
and
WHEREAS, the City Council has determined that the City's clear site triangle requirements
should be updated to include all road types in accordance with the Florida Department of
Transportation's (FDOT) Manual of Minimum Standards for Design, Construction and
Maintenance for Streets and Highways.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, as follows:
SECTION 1.
Section 4234 of the Land Development Code, Clear Site Triangle, is hereby amended as follows:
Section 4234. Clear Site Triangle.
In order to provide a clear view of intersecting streets to the motorist, there shall be a triangular
area of clear visibility formed by two intersecting streets or the intersection of a driveway and a
street. Nothing in excess of 3.5 feet in height including but not limited to fences, buildings,
walls, and vegetation, shall be erected, placed, parked, planted or allowed to grow in such a
manner as to materially impede vision within the clear site triangle area. The following
standards shall be met:
A. On the intersection of local streets with speed limits not exceeding 30 mph with stop-
sign control on all approaches, the clear site triangle shall be determined as beginning
at the intersection of street rights -of -way (edge of pavement), projected where
rounded, then in each direction along adjoining property for a distance of 15 feet, and
then in a straight line across the property. For approaches at intersections without
stop -sign control on all approaches, the minimum required site distance is 200 feet.
B. On the intersection of streets with speed limits exceeding 30 mph, the site distance
requirement established in the Florida Department of Transportation's (FDOT)
Manual of Minimum Standards for Design, Construction and Maintenance for Streets
and Highways (2002), as amended.
The above provisions shall not apply to the intersection of an alley and a street. At each
intersection of an alley and street, each landowner must maintain a setback of no less than 10 feet
from right -of -way of streets and alleys. The setback area must be maintained free from sight
obstruction by vehicles, walls, fences, plants, landscaping materials, or other opaque objects in
excess of 3.5 feet above the abutting roadway.

SECTION 2. Conflicting Ordinances.
This Ordinance shall supersede all ordinances or parts of ordinances in conflict herewith.
SECTION 3. Severability.
If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason
held to be unconstitutional, inoperative, invalid, or void by any court of competent jurisdiction,
such holding shall not affect the remainder of this Ordinance.
SECTION 4. Inclusion in the Land Development Code.
The provisions of this Ordinance shall become and be made a part of the Land Development
Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or
relettered and the word "ordinance" may be changed to "section ", "article" or such other
appropriate word or phrase in order to accomplish such.
SECTION 5. Effective Date. -
This Ordinance shall become effective on P1,4* 14 , 2004.

regular meeting by the Council of the City of Zephyrhills, Florida, on this 23 day of
February, 2004.
