NOTICE OF DEED RESTRICTIONS: The undersigned understands that this permit may be subject to "deed" restrictions`
which may be more restrictive than County regulations. The undersigned assumes responsibility for compliance with any
applicable deed restrictions.
UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES: If the owner has hired a contractor or
contractors to undertake work, they may be required to be licensed in accordance with state and local regulations. If the
contractor is not licensed as required by law, both the owner and contractor may be cited for a misdemeanor violation
under state law. If the owner or intended contractor are uncertain as to what licensing requirements may apply for the
intended work, they are advised to contact the Pasco County Building Inspection Division — Licensing Section at 727-847-
8009. Furthermore. if the owner has hired a contractor or contractors, he is advised to have the contractor(s) sign
portions of the "contractor Block "' of this application for which they will be responsible. If you, as the owner sign as the
contractor, that may be an indication that he is not properly licensed and is not entitled to permitting privileges in Pasco
County.
TRANSPORTATION IMPACTIUTILtTIES IMPACT AND RESOURCE RECOVERY' FEES: The undersigned understands
that Transportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings. change of
use in existing buildings, or expansion of existing buildings, as specined in Pasco County Ordinance number 89-07 and
90-07, as amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of
permitting. It Is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receiving a "certificate of occupancy' or final power release. If the project does not involve a certificate of occupancy or
final power release, the fees must be paid prior to permit issuance. Furthermore. if Pasco County Water /Sewer Impact
fees are due, they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances.
CONSTRUCTION LIEN LAW (Chapter 713, Florida Statutes, as amended): if valuation of work is $2,500.00 or more, I
certify that I, the applicant have been provided with a copy of the "Florida Construction Lien Law — Homeowner's
Protection Guide" prepared by the Florida Department of Agriculture and Consumer Affairs. tf the applicant is someone

CONTRACTOR'S/OWNER'S AFFIDAVIT: I certify that all the information in this application is accurate and that all work
will be done in compliance with all applicable laws regulating construction, zoning and land development. Application is
hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has
commenced prior to issuance of a permit and that all work will be performed to meet standards of all laws regulating
construction, County and City codes, zoning regulations, and land development regulations in the jurisdiction. t also
certify that t understand that the regulations of other government agencies may apply to the intended work, and that it is
my responsibility to identify what actions I must take to be in compliance. Such agencies include but are not limited to:

- Use of fill is not allovred in Flood Zone "V" unless expressly permitted.
- If the fill material is to be used in Flood Zone A ", it is understood that a drainage plan addressing a
"compensating volume" will be submitted at time of permitting which is prepared by a professional engineer
licensed by the State of Florida.
- If the fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall
construction, t certify that fill will be used only to fill the area within the stem wall.
- If fill material is to be used in any area, I certify that use of such fill will not adversely affect adjacent
properties. If use of fill is found to adversely affect adjacent properties, the owner may be cited for violating
the conditions of the building permit issued under the attached permit application. for lots less than one (1)
acre which are elevated by 511, an engineered drainage plan is required.
111 am the AGENT FOR THE OWNER. I promise in good faith to inform the owner of the permitting conditions set forth in
this affidavit prior to commencing construction. 1 understand that a separate permit may be required for electrical work,
plumbing, signs, wells, pools, air conditioning, gas, or other installations not specifically included in the application. A
permit issued shall be construed to be a license to proceed with the work and not as authority to violate, cancel, alter, or
set aside any provisions of the technical codes, nor shall issuance of a permit prevent the Building Official from thereafter
requiring a correction of errors in plans, construction or violations of any codes. Every permit issued shall become invalid
unless the work authorized by such permit is commenced within six months of permit issuance, or if work authorized by
the permit is suspended or abandoned for a period of six (6) months after the time the work is commenced. An extension
may be requested, in writing. from the Building Official for a period not to exceed ninety (90) days and will demonstrate
justable cause for the extension. If work ceases for ninety (90) consecutive days, the job is considered abandoned.

Dear Ms. Slaughter:
Environmental Compliance Services, Inc. (ECS) has completed work related to the Pre - Demolition
Asbestos Survey conducted at the Whataburger property located at 7809 Gall Boulevard in
Zephyrhills, Florida. This survey was conducted using "destructive sampling methods ".
HISTORY
On June 16 and October 27, 2010, ECS representative Mr. Aaron Hallam conducted a Pre- Demolition
Asbestos Survey of the restaurant property. The purpose of our services was to characterize the type,
content, accessibility, location, condition, quantity, and friability of asbestos - containing materials
(ACM) within the referenced building.
The sampling and analysis included the collection and analyses of bulk samples of suspect ACM and
was conducted according to the Asbestos Hazard Emergency Response Act (AHERA) Section
763.86. The samples were analyzed in accordance with Asbestos Hazard Emergency Response Act
( AHERA) "first positive analysis" protocol recommended by the USEPA. Additionally, the
Occupational Safety and Health (OSHA) asbestos survey standards (29 CFR 1926.1101) and the
publication "Asbestos in Buildings: Simplified Sampling Scheme for Friable Surfacing Materials"
(EPA 560/5- 85 -030a, October 1985) were adhered to while conducting the survey.
SAMPLING METHODS
The term "non- destructive sampling method" refers to a method of collecting samples that does not
significantly impact interior or exterior finishes of the building. Evaluations for the presence of ACM
are therefore limited to those materials accessible by non - destructive sampling methods. ACM may
therefore be present in materials not accessible by this sampling methodology, and may be
encountered during significant renovation or demolition of the structure.
The term "destructive sampling method" refers to the method of collecting samples that would
require destruction of various building surfaces (Le. wall cavities, wood flooring, plaster ceilings) for
the purpose of locating hidden heating, plumbing, or other building components that may contain

ACM. Destructive methods are recommended for facilities slated for significant renovation or
demolition.
Additional limitations may exist for both destructive and non - destructive sampling methods. Certain
portions of the building may be physically inaccessible, as a result of electrical, mechanical,
structural, or other hazards that exist in portions of the structure at the time of the survey.
Some areas that may be deemed inaccessible include:
• Below grade and beneath slab
• Within electrical panels, heating, ventilation, and air conditioning machinery and
associated duct work
• Within fire doors
REVIEW OF PLANS AND SPECIFICATIONS
A survey to locate asbestos - containing materials usually begins with a review of building plans and
specifications to determine the type of construction used and the materials specified. Original
drawings and specifications were not available for review. A previous asbestos report was also not
available for review; therefore, ECS relied on visual observations for the identification of major
classes of suspect materials.
ASBESTOS SURVEY
Mr. Aaron Hallam, a USEPA Certified Asbestos Inspector, conducted the Pre- Demolition Asbestos
Survey of the building on June 16 and October 27, 2010. All sampling and analytical data are
included in this report.
Samples were collected in a statistically random manner using the Asbestos Hazard Emergency
Response Act (AHERA) protocol (40CFR763.86). Samples were placed into plastic bags with an air
tight seal. Labels were affixed to the sample bags with specific nomenclature. Material location,
estimated quantity, and physical assessment were recorded on field sheets and included as Table 1.
BUILDING DESCRIPTION
The structure is a former Whataburger restaurant and is a slab on grade structure with a built -up
roofmg system. The exterior of the structure is concrete block with stucco.
Air conditioning is supplied to the building by forced air. Typical interior building finishes on the
floors included ceramic tile. Typical interior partitions included painted sheetrock. Ceilings consisted
of ceiling tiles. Miscellaneous materials observed that were suspect of containing asbestos:
• Drywall and associated joint compound
• Ceiling tiles
• Wall surfacing material
• Duct insulation
• Building insulation
• Rolled roofing material
• Stucco

BULK SAMPLING METHODOLOGY AND FINDINGS
Bulk samples were analyzed by Polarized Light Microscopy (PLM) using the United States
Environmental Protection Agency USEPA/600/R- 93/116 method. The analysis of samples was
conducted by Air Quality Environmental, Inc., 9325 Seminole Blvd., Seminole, Florida (NVLAP
Accreditation 200759 -0).
There are six minerals grouped into the term "asbestos." Chrysotile, amosite, and crocidolite are the
asbestos minerals most commonly found in building materials. ACM is deemed as a material
containing more than one percent (1 %) asbestos by weight. Materials found to be asbestos containing
are listed below. Exact sample compositions are included in the laboratory reports or chains of
custody found in Attachment I.
Polarized light microscopy (PLM) is the root method used for the identification of ACM. The
USEPA Office of Research and Development (USEPA/ORD) has reviewed data from performance
audits of various laboratories performing PLM. The results of that review indicated an unacceptable
number of false negatives and positives for visual estimation of materials containing less than 10%
asbestos. On the basis of those findings the National Emission Standards Hazardous Air Pollutants
(NESHAP) regulations were amended on November 20, 1990 (Federal Register, V.55, N.224). The
revisions state that if the analyst detects asbestos in the sample and estimates the amount to be less
than 10% by visual estimation, the parties legally responsible (owner or operator) for the building
may (1) elect to assume the amount to be greater than 1% and treat the material as ACM or (2)
require verification of the amount by point counting. Point counting is a technique used to quantify
the amount of asbestos present in a sample on which PLM has already been performed. ECS
recommends point counting re- analysis for asbestos values less than 10 %, and where applicable those
results are reflected in the report. In instances where client authorization is not received for this
reanalysis, PLM visual results indicating a trace or 1% value will be reported as assumed ACM as
required by item (1) above.
A similar situation exists for matrix bound fibers such as those found in floor tiles, mastics, and
asphalt based materials. The inorganic matrix of these bulk samples may interfere with the
identification and quantification of asbestos mineral content. These types of samples are generally
referred to as Non - organically bound (NOB) materials. Transmission Electron Microscopy (TEM-
NOB) is a method that utilizes a combination of special sample preparation techniques and high
magnification to more accurately quantify asbestos content. Although additional cost is involved,
ECS recommends TEM -NOB analysis under certain circumstances, as a state of the art means of
evaluation.
A summary of the materials sampled, their locations, and analytical results are presented in Table 1,
and the Asbestos Analysis Results, with chain -of -custody, are provided in Attachment 1.
CONCLUSIONS AND RECOMMENDATIONS
A total of twenty -four (24) samples of suspect ACM were collected of the eight (8) different
homogeneous building materials identified. Based on "first positive stop" request on analysis, 24 total
analyses were conducted. Analytical results of the samples revealed that none of the homogenous
materials sampled contained asbestos in concentrations >1% by PLM analysis.
ECS recommends that no response action be taken due to the lack of asbestos containing materials
identified at the subject property. However, it should be noted that any areas deemed inaccessible by
this report, or any other building materials not identified herein should be treated as asbestos

containing materials until laboratory testing proves otherwise. Also, although ACM was not identified
in the building surveyed, a 10-day abatement notification is required to be provided to the Florida
Department of Environmental Protection (FDEP) and local agencies prior to asbestos abatement,
renovation and/or building demolition.
INVESTIGATION LIMITATIONS
The inspection, asbestos sampling methods and conclusions employed in this investigation were used
to provide Atwell, LLC with information regarding the potential for asbestos containing materials
within the building. The sampling results and observations are necessarily limited to the conditions
observed at the time of the investigation. The report and results reported herein are also limited to the
information available at the time it was prepared and investigated. This report and findings was
prepared on the behalf of and exclusively for the use of Atwell, LLC. This report and the fmdings
contained herein shall not, in whole or in part, be disseminated or conveyed to any other party or be
used or relied upon by any other party without the written consent from Atwell, LLC or its
designee(s).
