If it is I did the final sprinkler system inspection back on 9-30-11. However the underground fire line has not been installed, held up by the Utilities Department. They are in the process of installing that water line to the system "soon". I have s,een that the alley way has been marked with locator paint so that "soon" may actually be soon. WHEREAS, the City Council of the City of Zephyrhills, Florida, sitring in regiilar mecting is desirous of providing incentives to encourage local businesses to install automatic fire sprinkler sY�� �� their new structures and to assist bnsinesses required to comply with current National Fire Protection Association (NFPA) Codes by instaIling an automatic fire sprinicler system in a building s�ucture in order to contribute to the economic growth of tbe city and to ensure the safety of its residents and protsct priwau pmperty; and �Nf�REAS, the City Council of the City of 7xphyrhills has given priority to the need to pian for an incentive package to further the goal of increasing tbe n�unber of s�uctures, located within the city, protected by automatic fire sprinkier systems; and NOW 'iI3ERBFORE, EE TT ORDAINED, by the City Council of thc City of Zephyrhills, as follows: SECTION 1— CRITERIA FOR AUTOMATIC FIRE SPRWI�I,ER INCEN'I'IVES The City Council of the City of Zephyrhills is hereby atrthorizcd to provide incentives for businesses installing automatic fire sprinkler systems in s�ucnues in which the City Council of the City of ZtphyrhilLS determines meets rhe following criteria: - 1. The subjact property mvst be non-residential in character 2. The business must serve a public purpose by advancing the economic prosperity and geaeral welfare of Lhe people with consideration to the overall environment of the City; 3 The proposed business activity is anticipated to generate more in city revenues than it consumes in city services; 4: The b�isiness is appropriate to the needs and circim�stances of and will make a si�ificaat conhibution to the economic gtowth of the City and 5. Specific Minimum Qua�ificahon-Criteria for: new business. building must be less in size ' than 12,OOU square feet; and for expansion of an eaasting buildi.ng: the total square footage shall be no larger than 12,000 sqoa� feet. SECTION 2— APPLICATION FOR AUTOMATIC FIRE SPRINKLER INCENTIVES The City Council of the City of Zephyrhills hereby authorizes that application be made to the Buildiug Departmenz to be reviewed by the staff of Zephyrhills Firc Rescue and the $uilding Departmenc who shall administer the automatic fire spiinkler incentive program with the following stipuiarions: � Company profile an�d background � � Fimction of the firm e Location of project a Total acreage of site a Total squar,e footage of building � Total number of full time employees � N�unber of employees to be added with addition to s�ucture � Annual ciry ad valorem tax bill 0 Estimated city utiliry usage o Estimated city impact fees. Following review by sta$, the $uilding Of�cial shall make a recommendation wit�un four (4) weeks to the City Council. Final approval shall rest with City Council. SECTION 3 — INCENTIVES. In the sole discrction of the City Council of the City of Zephyrhills those developments quali.fying in Section I, above, and submitting an application for Automatic Fire Sprinkler Incenuve Awatd for staff review, the following incentive mechanisms may be made available, singly or packaged, by the terms of this ordinance: � 1 Bvilding Depar�ent Pemzit Fees: � Building, Electricai, Plumbing and Mechanical fees a Public Safety {Fire only) Impact fees 2. Firc Dcparbncnt pcimit fee costs: ° P1an review, automatic fire sprinkler plan review, fire alarm review and undergound review a Automatic fire spriakler, fire alarm, underground and pressure test permits e Automatic fire sprinkler pressure test, automatic fire sprinkler acceptance test, fire alazm acceptance test 3. City properiy (ad valorem) taxes — not to exceed $3,000 per property per annum_ Thc ad valorem tax waiver shali be vatid for only one year. Coliective incentives not to exceed $30,000 per year in a total of a�varded projccts. SECTION 4 — CONTR.ACT REOUIREMENTS Once an incentive package/pmgrain has been approved, the Ciry Council of the Crty of Zephyrhills will authorize the City Attomey to draft a legally enforceable conhact setting out the iacentive or incentive package; specific performance criteria based on investrnent, size of buiIding, public recoiuse for non-performance, annual monitaring me�hanis� and penaltias that will be used and enforced should the business fail to meet its roquircments. Improvements shall be constructed with a certificate of occupancy issued pnor to disbursement/ reimbarsement/waiver of fees aad/or taxcs. SECTION 5 — SEVERABII,ITy If any one or more of the provisions of this Ordinance should be held contrary to any express provision of law or contrary to the policy of express law, though not expressly prohibitcd, or against public pvlicy, or shall for any reason whatsocver bc held invalid, then sueh provisions shall be null and wid and shall be deemed severable from the rcmaining provisions of this Ordinan�e and in no vwdy shali affect the validiry of all othcr pmvisions of this Ordinance. SECTION 6 - REPEAS,ER Upon the effective date of this Ordinance, any other ordinances or resolutions in confIict herewith are hereby repealed in their entirety- SEC'ITON 7. EFFECTIVE DATE This Ordinance shall become effective iznmediately upon passage on the second reading and signing by the Mayor. Correcting these deficiencies will ensure the building is compliant to the Florida Fire Prevention Code and provide the safety you're your occupants need. Each deficiency is listed below along with a time frame it shall be corrected in. Should you or anyone else have any questions associated with this, please do not hesitate to contact me at your earliest convenience. 1. The fire alarm system is currently out of date and possibly not compliant. A certified fire alarm contractor sha11 recertify the system and correct any deficiency found with the system. (within 30 days of the purchase of the property) 2. The stairwell and upstairs corridor shall be rated with a minimum 1 hour rating. Plans will need to be submitted showing how the rating will be achieved. (prior to occupants moving into apartments) 3. A compliant 2" level egress shall be installed in accordance to the code which would also include install a fiill size egress door with panic hardware. Plans sha11 be submitted for approval. (prior to occupants moving into apartments) 4. Exit signs shall be installed upstairs above the exit door and above the stairwell going down. Ensure there is emergency lighting in that comdor as well. (prior to occupants moving into apartments) 5. Ensure there are proper working smoke detectors inside each bedroom and outside each bedroom of each apartment upstairs. Ensure there is a pull sta.tion upstairs with a horn/strobe to notify the occupants of the apartments. (prior to occupants moving into apartments) 6. Install a fire sprinkler system that would protect the propertied doumstairs within the building and the stairwell and corridor upstairs. Fire sprinkler system shall be monitored by the fire alarm system. Pians would need to be submitted for this installation. (plans shall be submitted for permitting within 12 months of the property purchase date and then completed 6 months after) . 2 7. Keys to all properties within the building and for apartments upstairs shall be provided to be placed in the buildings Knox Box. (within 30 days of the purchase of the property) Be advised that copies of past reports can be obtained by filling out a request at City Hall in the City Clerk's office.
