communities and subdivisions providing housing for persons who are 55 years o(age or
older may be waived. New Residential Co�struction within communities and
I subdivisions meeting the requirements of 42 U.S.C.§3607 and Florida StaWtes ,,,
` will not be presumed to be waived from paying the School Impact Fee. For the
School Impac[Fee to be waived lhe following is required:
1. The County shall be intormed at ihe time of platting ihat such
community or subdivision is intended to provide housing for persons who are 55
years of age or older. Where platling has occurred prior to the effective dale of
this divi'sion, the County shall be informed at the lime of lhe application for a
Building Permit that the new Residential Construction for which the Building
� Permit is requested and is intended to provide housing for persons who are 55
years of age or older;and
2. CommunilV-wide covenants and reslrictions providinq Ihal no one
under the aoe of 22 is oermitted to permanentiv reside wilhin the community
inust be adooted recorded and submilted to the Countv.
3. Prior to the issuance of a Certificate of Occupancy or, where a
Certificate of Occupancy is not required, prior to final inspection a Restriclive
Covenant limiting the use of the property by providing that no one under lhe age
of 22 is permitted to permanently reside on the property shall be filed with the
deed on the parcel for which the School Impact Fee waiver is sought;and
� 3a. Prior to the issuance of a Certificate of Occupancy,or where a Certificate
of Occupancy is not required, prior to final inspection, a copy of the recorded
Restrictive Covena�t shall be produced to the County in lieu of payment of lhe
School Impact Fee. However,where a breach or dissolution of such Reslrictive
Covenant occurs or lhe communitv that the waived dwellinq units are located
