Garcia, Dpty Clerk AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED WITHIN THE BOUNDARIES OF SAID CITY DESCRIBED AS PARCEL 03-26-21-0010-12400-0030 LOCATED AT 6023 0 MASSEY ROAD, ZEPHYRHILLS, FLORIDA, IN ACCORDANCE WITH SECTION 171.044,FLORIDA STATUTES,AS AMENDED. N z m OO.F WHEREAS, in 2012 Franklin and Debra Hoffman consented to the annexation by the City of ��o Zephyrhills of the lands herein described in Section 1 below by executing an Agreement Arising I'. N Out of Request for City Services Outside Corporate Limits; and r WHEREAS, the City is authorized by Chapter 171, Florida Statutes, to annex contiguous and (,f' infill areas, and to extend the City limits upon receipt of written consent of the land owners �N o together with the approval of the City Council after notice and public hearing; and CO � r WHEREAS, the City Council has reviewed and evaluated the application'submitted; and has determined that the annexation of said lands into the City is in the, public interest and is consistent with the City's Comprehensive Plan and Land Development Regulations. NOW THEREFORE, BE IT ENACTED, AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS,FLORIDA,AS FOLLOWS: SECTION 1: The following described lands, lying and being situated in Pasco County,-to wit: Parcel I.D.No. 03-26-21-0010-12400-0030 _ Legal Description: ZEPHYRHILLS COLONY COMPANY LANDS PB 1 PG55 BEGIN 15.00 FT WEST & 163.85 FT NORTH OF S1/4 COR SEC 3 TH WEST PARALLEL TO NORTH LINE TRACT 124 100.00 FT TH NORTH PARALLEL TO EAST LINE TRACT 1.24 60.00 FT TH EAST 100.00 FT TH SOUTH 60.00 FT TO POB AKA LOT 3; & BEGIN 15.00'FT WEST & 163.85 FT NORTH OF S1/4 COR SEC 3 TH WEST PARALLEL WITH NORTH LINE TRACT 124 100.00 FT FOR POB TH CONT WEST 28.18 FT TH NORTH PARALLEL WITH WEST LINE OF TRACT 124 60.00 FT TH ELY PARALLEL WITH NORTH LINE OF SAID TRACT 28.33 FT TH SOUTH PARALLEL WITH EAST LINE OF TRACT 124 60.00 FT TO POB OR 4843 PG 1853 .18 acres m.o.l. and the adjacent right-of-way of Marcy Lane from the eastern most point westward to the western most point and southward to the intersection of Geiger Road described as: Parcel I.D.No. 03-26-21-0010-12400-0010 and the adjacent right-of-way of Massey Road from the northern most point southward to the intersection of Geiger Road and the same are hereby annexed to and included within the boundaries of the City of Zephyrhills, Florida, a municipal corporation. SECTION 2: Said lands are contiguous to or are infill of the present City limits of the City of Zephyrhills. That said lands are now unincorporated and lie in the same County as said City, and when annexed would form a compact addition to the incorporated territory of said City. That Record and-Return to: City Clerk's Office 5335 8th Street Zephyrhills, FL 33542 OR BK 8761 PG 349 2 of 2 owners of said lands contained in said area to be annexed have given written consent to have such annexation for said area. SECTION 3: The City of Zephyrhills, Florida is authorized by the legislature of the State of Florida, pursuant to Section 177.044, Florida Statutes, and pursuant to the Charter of the City of Zephyrhills, to annex contiguous and infill areas and to extend the City limits or territorial boundaries upon receipt of a written consent of all owners of land contained in the area to be annexed, together with the approval of the City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4: It is the intention of the City Council of the City of Zephyrhills, Florida to annex the above-described lands to said City within its territorial limits and the boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5: This Ordinance shall become effective December 1;2012.
