Garcia, Dpty Clerk AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, AMENDING ORDINANCE NO. 1165-12, REGARDING WATER, WASTEWATER AND RECLAIMED WATER RATES; PROVIDING FOR SEVERABILITY,REPEALER,AND AN EFFECTIVE DATE. WHEREAS,the City Council received the Final Report for the FY 2012 Water& Wastewater Rate Study by Burton&Associates, which has identified the rates, fees, and charges necessary t g provide a financially sound and self-supporting water utility; and I w m m � WHEREAS,the proposed increases in rates proposed in that study provide the City with the ability to address the waterwater treatment plant debt service, PILOTexpenses,_and provide _ funding for Utility CIP improvements; and II- 0 ~ n WHEREAS,the City Council desires to add definitions and clarify water usage and water/sewer " o, base rate customer types; and .IN~� I0 WHEREAS,the City Council adopted ordinance 1165-12 amending the rate structure for the I� o billing of water and sewer utilities; and m WHEREAS,this ordinance does not enact rate increases and only clarifies categories for implementation by staff for new connections. NOW, THEREFORE, BE IT ORDAINED,by the City Council of the City of Zephyrhills, Florida, as follows: Section 1. The City Council does hereby find that the revised water and wastewater rates represent fair and reasonable sums assessed to provide for the use or reasonable availability for use, of the services and facilities of the City of Zephyrhills Water System, by each user receiving wato r service. Section 2. The City Council does hereby fmd that the revenues generated by the rates and charges established for the water system are sufficient to cause the water system to be financially self supporting water utility. Section 3 !. Section 51.075 of the Code of Ordinances of the City of Zephyrhills, Florida shall be amended to read as follows: SECTION 51.075 Water and Sewer Service Rates: The rates for water and sewer services shall be as follows: (A) Water Usage,Charges: Rate per 1,000 gallons of metered water. 1. For the purpose of this section((D).1 and.(D).2), "Lot" shall also include each individual lot in a mobile home park and each individual lot in a RV park; and "Unit" shall include each individual bed in a nursing home or assisted living OR BK 8821 PG 2610 5 of 5 facility. For motels, hotels and commercial buildings the base rates shall be as in D.1.a) and D.2.a) in accordance with the meter size for that establishment regardless of the amount of individual units. and each individual unit of a motel, hotel or apartment. The base amount shall be in addition to any charge for actual use. Section 4. Repealer. Any ordinance and/or resolution, or part of any ordinance and/or resolution, in conflict herewith is hereby repealed to the extent of any conflict. Section 5. Severability. It is declared,to be the intent of the City Council of the City of Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid,the remainder of this Ordinance shall be construed as not having contained said section, subsection, sentence, clause, or provision and shall not be affected by such holding. Section 6. Inclusion in Code. The provisions of this Ordinance shall become and be made a part of the Land Development Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-lettered and the word "ordinance"may be changed to "section", "article" or such other appropriate word or phrase in order to accomplish such. Section 7. Effective Date. This Ordinance shall become effective on January 1, 2013 for FY 2013, and October 1, 2013 for FY 2014; the rates for all subsequent years shall become effective on October 1 of said fiscal year.
