ORDINANCE NO. 1198-13
AN, ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA ESTABLISHING A.3 MONTH EXTENSION
OF A.12 MONTH MORATORIUM ON RECEIVING AND PROCESSING
PERMIT APPLICATIONS FOR INTERNET CAFES AND ON INTERNET X

WHEREAS, Internet Sweepstakes.Cafes are a new type of business that is currently not v w
addressed in the City of Zephyrhills Land Development Code and the Code of Ordinances; and
WHEREAS, some communities have had difficulty with these, businesses, especially since a m e
their codes did not take into consideration all the effect they may have on surrounding properties
both commercial and residential; and

WHEREAS, the City does not currently have an application for such businesses, but anticipate
this new business may choose to locate here in the near future; and
WHEREAS, the, City Council desires to establish a moratorium for a period of 12 months so
that a study can be done to determine the effects this type of business would have on other
adjacent land uses in the City.
WHEREAS, City Council passed Ordinance 1080-12 to protect the .general welfare of our
businesses and residents by*allowing the city to study and adequately amend the City Code to
address internet cafes and internet sweepstake cafes; and ®D
WHEREAS, the City has completed its study and needs additional time to prepare legislation � m
for consideration of the Planning Commission and.the City Council.

NOW THEREFORE BE IT ORDAINED THAT: U1

SECTION 1. There is hereby approved a 3 month extension to the original 12 month
moratorium (approved by Ordinance #1080-12) on receiving and processing'applications for

building permits, conditional use permits, zoning permits and any otherpermit under the City of N
o
Zephyrhills Land Development Code or the City of Zephyrhills Code of Ordinances regarding 3
the establishment, development or expansion of internet cafes or sweepstake internet cafes.

SECTION 2. City Staff is hereby directed to present research and the impacts of internet cafes
and internet sweepstake cafes on neighboring land uses and the community at large so that
appropriate revisions to the Land Development Code and/or the City Code of Ordinances may be
recommended by staff and adopted by City Council.
SEVERABILITY: It is declared to be the intent of the City Council of the City of
Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of this
Ordinance shall be declared invalid, the remainder of this Ordinance shall be construed as not
having contained said section, subsection, sentence, clause, or provision and shall not be affected
by such holding.
