ORDINANCE NO 1204-13 06/26/13 K. Garcia, Dpty Clerk
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA AMENDING SECTION 30.132,
"COMPOSITION" (PLANNING COMMISSION), OF THE CITY OF
ZEPHYRHILLS CODE OF ORDINANCES, ; AND AMENDING SECTION
30.133, "MEMBERSHIP; TERMS; REMOVAL" (PLANNING
COMMISSION); AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the voters of the City of Zephyrhills passed a referendum on April 9, 2013
extending the terms of the Mayor, and City Council Members; and
WHEREAS, the City Council desires to match the terms of the Planning Commission to their
terms; and

WHEREAS, the City Council wishes to update the organization of the'Planning Commission to
update the appointment process and to name the Mayor as it's designated Chair. .
NOW THEREFORE, BE IT ENACTED, AND ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ZEPHYRHILLS,FLORIDA, THAT:
SECTION 1: the City of Zephyrhills Code of Ordinances, Section 3.132, "COMPOSITION"
shall be amended to read as follows:
30.132 COMPOSITION; APPOINTMENT AND TERMS
(A) Members appointed by City Council. City Council, as empowered by Florida
Statute Chapter 163.3174, has established a pPlanning eCommission and appointed
members thereto.
(B) Membership: Mayor to serve. The Planning Commission,shall b
comprised of
five members. Three citizens of the city will be appointed by the coiincil from the
community at large and one members hall be appointed Opm the city., staff from a
planning related department. The Mayor also shall serve up.dn the Planning COmmission.
There shall be seven planning commission members on this commission, a majority of
which shall be residents of the City of Zephyrhills. Five members, seats 1-5, shall be
appointed individually y each member of City Council (seats matching) with approval
of the majority of City Council and they shall serve for three year staggered terms. In
year one (2013) there shall be initially ppointed two members for 1 year (seats 2 and 4);
two members for two years (seats 3 and 5); one member for three e�(seat 1); In year
two (2014) there shall be appointed one member for two years and one member for three
years (to match the term length of City Council seats 2 and 4, as determined in that
election process). One additional member (seat 6) shall be appointed and approved by
the City Council, and this member shall serve a 3 year term. Initially this seat
will be appointed for a three year term (seat 6). The-Mayor shall serve a three year
staggered term which will run concurrent with his term as Mayor (seat 7). Initially in
year one (2013) the Mayor will,serve a one year term. The Planning Commission shall
have appointments made prior to the annual installment in June of each.
(C) Alternates; powers; terms. In additional the City Council may appoint a first and
second alternate member to the Planning Commission. Such alternates may participate in
all authorized function of the Planning Commission; provided , however, such alternates
shall have no vote in the administrative or quasi-jurisdictional judicial determinations of
the Planning Commission, except in the temporary absence or disability of a regular
member or members, or when such regular member or members shall be disqualified
from voting in any particular case or cases. The te-..,, of an.aerate will be for a two year
period provided that the second alternate shall be for a one year period for the first year.
One alte tive shall be from cites one shall be a non staff person. Initially one
alternate shall be appointed by City Council for two years and one alternate shall be
appointed for three years. The Planning Commission alternates shall be appointed prior
to the annual installment in June at the beginning of the term.

2 SECTION 2: the City of Zephyrhills Code of Ordinances, Section 3.133, "MEMBERSHIP;
TERMS; REMOVAL" shall be amended to read as follows:
30.133 MEMBERSHIP;OFFICERS AND REMOVAL
(A) Terms. Members of the Planning Commission shall be appointed for staggered
terms of twe years. Three of the original appointees shall serve for onlyto
establish the staggered te,....,
(A) (B-)Removal by eCouncil. City Council may remove any member of the Planning
Commission for just cause including, but not limited to, absence without valid excuse of
more than three meetings annually after written notice and public hearing before City
Council. However, absences from three consecutive regular meetings shall cause a Board
member or alternate to be automatically removed from their seat, unless such absence is
excused by the majority vote of the Planning Commission with such excuses duly entered
into the minutes.
(B) Chairperson; Nice eChairperson; sSecretary. The Planning Commission shall
elect a chairperson and vice-chairperson from it's members. A alified city employee
shall serve as secretary. There shall be a Chair who shall preside at meetings. The
Mayor is hereby designated as Chair. There shall be a Vice Chair who shall in the
absence of the Chair, preside over meetings. The Vice Chair shall be a regular member
of the Planning Commission, and shall be elected by the membership each year at the
first meeting after the appointment of new members. A qualified City employee will be
assigned the duties of Secretary. The office of the City Clerk shall keep public record of
such meetings. All meetings shall be public under the Government-in-the-Sunshine
Laws.
SECTION 3: :This Ordinance shall become effective upon passage on the second reading and
signing:by theMayor.\
