Garcia, Dpty Clerk AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA AMENDING SECTION 30.035, "MEMBERSHIP; TERMS OF OFFICE; OFFICERS; QUORUM; MEETINGS; REMOVAL" (MUNICIPAL AIRPORT AUTHORITY), OF THE CITY OF ZEPHYRHILLS CODE OF ORDINANCES; AND . PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the voters of the City of Zephyrhills passed a referendum on April. 9, 2013 extending the terms of the Mayor, and City Council Members; and WHEREAS, the City Council desires to match the terms of the Zephyrhills Municipal Airport Authority Board to their terms; and WHEREAS, the City Council wishes to update the organization of the Zephyrhills Municipal Airport Authority Board to update the appointment process. NOW THEREFORE, BE IT ENACTED, AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS,FLORIDA,THAT: SECTION 1: the City of Zephyrhills Code of Ordinances, Section 30.035, "MEMBERSHIP; TERMS OF OFFICE; OFFICERS; QUORUM; MEETINGS; REMOVAL" shall be amended to read as follows: 30.135 MEMBERSHIP; TERMS OF OFFICE; OFFICERS; QUORUM; MEETINGS; REMOVAL (A) The Airport Authority Board shall consist of a total of seven members ,_five members to be appointed b.,the City Council. Each member shall nominate ., candidate for the Airport , A„thorit„ ,,hose nomination must be approved by a majority of the CCouancil i-addition, onevJ ther member-shall benominated - by Council to the Airport Authority, and one member shall be nominated by the Mayor. The nomination of the additional members must be approved by a majority of the City!'o',, .;1 (B) The terms of office for membership of the Authority Board shall,be ,staggered. The term of office for each member shall be two three.:years_ the—d Ite of appo „t e„t The initial ter.., of office for the two r members shall,'be for -penod_of one year. Thereafter, the term of office for these additio'nl members 1.1'b&'two years for the date of appointment. Five members, seats 1-5, shall be appointed individually by each member of City Council (seats matching) with approval of the.majó'rit of City Council and they shall serve for three year staggered terms. In year one (2013) there shall be initially appointed two members for 1 year (seats 2 and 4); two members for two years (seats 3 and 5); one member for three years (seat 1); In year two'(2014) there shall be appointed one member for two years and one member for three years.(to.match the term length of City Council seats 2 and 4, as determined in.that election p`roces`s). - One additional member (seat 6) shall be appointed and approved by the City Council, and this member shall serve a 3 year staggered term. Initially this seat will be'appointed_for a three year term (seat 6). The remaining member (seat 7) shall be appointed by the Mayor and approved by the City Council and shall serve a three year staggered term. Initially in year one (2013) this member shall serve a one year term: The Airport.Authority Board shall have appointments made prior to the annual installment in June of each year. (C) AChairperson, Vice Chairperson,, and Secretaryshall be chosen by and from the Authority membership. The term of office for the e Vice Chairperson, and Secretary shall be one year, and no member shall hold the same office for more than two consecutive terms.s. Chair; Vice Chair; and Secretary. There shall be a Chair who shall preside at meetings. There shall be a Vice Chair who shall in the absence of the Chair, preside over meetings. The Chair and Vice Chair shall be a regular member of the Airport Authority Board, and shall be elected by the membership each year at the first meeting after the appointment of new members. No member shall hold the office of Chair for more than two consecutive terms. The office of the City Clerk shall keep public record of such meetings. All meetings shall be public under the Government-in-the-Sunshine Laws. (D) A quorum shall consist of four members, but the affirmative vote of not less than four members shall be necessary to take any action except to approve minutes, accept operating or informational reports, and to adjourn. (E) The Authority Board shall meet at least once each month at such times and places as determined by the Authority Board. The agenda for the June meeting shall include the review of the annual duties of the Authority and the election f officers. (F) Any member may removed City Council, but only for grounds, constituting �ui) member be `iv r vu by vary vva.uav , malfeasance, or nonfeasance in office or upon the conviction of a crime. The unexcused failure to attend three consecutive regular meetings shall be deemed nonfeasance, without limiting the meaning of that term. The Chairman of the Airport Authority shall have the authority to approve absences. City Council may remove any member of the Airport Authority Board for just cause after written notice and public hearing before City Council. However, absences from three consecutive regular meetings shall cause a Board member to be automatically removed from their seat, unless such absence is excused by the Chair of the Airport Authority Board during with such excuses duly entered into the minutes. (G) Vacancies in office shall be filled by the City Council for the balance of the term, not later than 30 days after the notice of the vacancy has been given to the City Council. (H) No officer or employee of the city; officer or owner of a flight club based at the airport; officer, owner or employee of any commercial business based at the airport, or flight school with aircraft based at the airport, shall be eligible for membership in on the Authority Board. No member of the Authority Board shall be interested in the profits or emoluments of any contract, work, sale, to or service for the airport, and any such contract in which a member is or may be interested, shall be declared void by the City Council SECTION 2: This Ordinance shall become effective upon passage on the second reading and signing by the VMayor.
