S/Community Development/Housing Forms Revised 04127/11 - 3 - ARTICLE 8. -GENERAL RESPONSIBII.ITIES OF THE OWNER: 8.1 The Owner shall permit the Contractor to use, at no extra cost, existing utilities such as light, heat, power, and water necessary for the proper execution and completion of the work. 8.2 The Owner and occupants shaU cooperafe with the Contractor to facilitate the pertor- mance of the wo�lc and are responsible for the remova( ar protec#ion of rugs, fumiture, and clothing, if necessary. 8.3 The Owner and occupants shall be responsible for the proper use and care of the property including all equipment and appliances. 8.4 The Owner shall provide the Contractor with access to the pro#�erty during normal working hours on normal working days. ARTICLE 9. -GENERAL RESPONSIBtLIT1ES OF THE COMMUNtTY DEVELOPMENT DIVtSION: 9.1 The Community Development Division sha(I provide general administration of the contract, but it is understood by all parties that the County is not a par#y to this Contract. 9.2 The Community Development Division shall make frequent inspections of the work while it is in progress to determine if it is proceeding in accordance with the contract docu- ments. 9.3 The Community Development Division shall have the authority to reject work which does not conform to#he contract documents. ARTICLE 10. - CONTRACT DOCUMENTS: This contract consists of the Bid Proposal, the Work Write-Up, including any drawings or plans, the General Bid Specifications, and any insurance policies speci#ied in Article 5 above. ARTICLE 41. - CHANGES IN THE WORK: Except in an emergency endangering life or property, no change in the work shall be made by the Contractor unless he has received a prior writ�en order signed by the Owner and authorized representatives of the Community Development Oivision. The contract sum and the contract fime may be changed only by Change Order. No extra costs will be paid ta the Contractor when he has neglected to properly evaluate the extent of the cons#ruction work. Change orders need to be in line with bidding amounts or pricing. ARTICLE 12. - GUARANTEES AND WARRANTiES: The Con#ractor shall guarantee to correct any work that fails to conform to #he contract documents and shall correct such defects due to faulty materials, equipment, or workmanship which appear during the pragress of the work or within a period of one year from the date of finaf inspection and acceptance or such longer periods of time as may be specified by law or by ' terms of any special guarantees required by the contract documents. The provisions of this Article apply to woric done by subcontractors as well as work done by the Contractor. Furthermore, the Contractor shall furnish the Owner, in care of the Community Development Divisian, with all manufacturers' and suppiiers' written guarantees and warranties covering materials and equipment furnished under the contract. If a warranty item malfunctians or breaks, the Contractor shall contact the Owner within 24 hours to schedule the repair or replacement of the item. S/Communfty DevelopmentlFiousing Forms Revfsed 04l27/t i -4- ARTtCLE 13. - TERMINA'TION OF CONTRACT BY THE OWNER: If the Contractor defaults or neglects to carry out the work in ac�ordance with the contract documents or faifs to pertorm any provisions of the contract, the Community Development Division or the Owner acting through the Community Development Division may, after seven {7) days' written noNce, terminate this contract and finish the work by whatever method he deems expedient. If the unpaid balance of the contract sum exceeds the expense of finishing the work, such excess shafl be paid to the Contractor; but if such expense exceeds such unpaid balance,the Contractor shall pay the difference to the Owner or the Community Development Division. Failure to pay the unpaid balance will result in disbarmenf from bidding on future Community Development Division projects. ARTICLE 14. - TERMINATION OF CONTRACT BY THE CONTRACTOR: If the Owner fails to perform any applicable provisions of the contract, the Contractor may, upon seven (7) days' written notice to the Owner and the Community Develapment Division, terminate the contract, and recover from the Owner payment for all work satisfactorily completed and all other such remedies as are otherwise specified by law ARTICLE 15. -GENERAL CONDITIONS: 15.1 The Wor{c Write-Up shall take precedence over the basic specification artd, when in conflic#, the material, equipment, or workmanship called for in the"Work Write-Up"wifl be required. 15.2 The Drawinas of floor plans are diagrammatic on1y, illustrating the general intention of the Owner; they do not show al! the work required, exact dimensions, or construction details. 15.3 The 2a10 Bid Specifications are detailed in a separa#e booklet availabie to the Owner and the Contractor from the Community Deveiopment Division. 95.4 Workmanship shall be done in accordance with the standards of the several trades known as a "workmanlike manner." 15.5 Mate�ials shall be new, in good condition, and of standard grade unless otherwise agreed in writing b�fore their delivery to the job. 15.6 Repairs shall be made by the Contractor fo all surfaces damaged by the Contractor resulting from his or his subcontrac#or's work under this contract at no additional cos# to the Owner. S/Communfty Development/Housing Fortns Revised 04/27/11 -8- OWNER — OCCU�PIED REHABILITATION ASSISTANCE AGREEMENT FOR GENERAL CONTRACTORS HOME INVESTIUIENT PARTNERSHtPS PR�GRAM (Only if appiicable if assistance funded with HOME Funds) THiS AGREEMENT is entered into this 21 day of November 2013, by and between the Pasco County Board of County Commissioners (Community Development Division), (hereinafter referred to as the"County"}, and Covenant Communities. Inc. (hereinafter referred to as the"Contractor"). THIS AGREEMENT 1S ENTERED INTO BASED ON THE FOLLOWING FACTS: A. WHEREAS, Pasco County has been designateti by the United States Department of Housing and Urban Development as a participating jurisdiction for the receipt and use of funds as provided by the HOME Investment Partnerships Program ("HOME Program") as provided in 24 CFR Part 92; and B. WHEREAS, the County has agreed to use the HOME funds to finance a Homeowner program that meets the requirement as set forth in 24 CFR Part 92 as amendecf by the United States Housing and Urban Development Department(HUD). C. WHEREAS, the Contractor has agreed to rehabilitate the follawing property: 21�St. ZeQhvrhills. FL 33542 NOW, THEREFORE, the County and the Contractor do mutually agree as follows: {1) Housing Quality Standards. Once rehabilitation is completed, the property will meet the property standards (HQS} as outlined in 24 CFR Part 92.251 and the County will ensure that the property will meet the requirements of its written standards, applicable local codes, rehabilitation standards, ordinances and zoning ordinances. Homes that are non-conforming but have been a(lowed to continue by the County or applicab(e city shall be aflowed to participate in the program. (2) Rehabllitation Work. The work that will be done on the house shall be in accorclance with the proposal, attached as an exhibit to this agreement. Additional work shall be approved by using a change order fonn. Change order forms must be signed by the contractor and the Homeowner, and approved by the County. It is estirnated that the work will be completed according to the following schedule: Confract Signing: November 21. 2013 50°/a Completion 03/05/14 100% Compietion 05/19/14 The budget for this project is estimated as fallows: Titie Costs 500.00 Rehab Work $120.900.00 Total $121,400.00 The original contract calls for the work to be completed in 150 days. Not applicable due to the Contractor not being a subrecipient or state recipient. e. Labor. Not applicable due to HOME funds being used to rehabilitate one single family house. f. Lead-based paint. If the house was built by and before 1978, a lead based paint assessment was compfeted, and that is attached to this agreement .If lead paint is present abatemenU and/or removal shal! be part of the propasal. g. Conflict of Interest. In accordance with 24 CFR Part 92.356, the Contractor certifies that he/she has not been in a position (as an employee, agent, consuitant, officer, or an elected or appointed afficial of a particEpating jurisdiction, state recipient, or subrecipient which received HOME funds)to exercise any functions or responsibilities with respect to activities assisfed with HOME funds or has not been in a position tfl participate in the decision making process or gain inside information with regard to the disbursement of HOME funds. The County certifies that it has no knowledge of the Contractor having any conflict. h. Debarment and Suspension. fn accordance with 24 CFR Part 92.357,the Contractor certifies that he/she is not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in receiving any HOME or other Federal Funds. The County certifies that it shalf check on every vendor that it is associated with this project that it is not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily exciuded from participation in receiving any HOME or other Federal Funds. I. Flood Insurance. All Federa! Emergency Management Agency rules shall be follawed j. Executive Order 12372. Nat appiicable since the HOME funds are not competitive. (4j Records and Reports. The County agrees to complete aN applicable reports and maintain documentation in accordance with HUD guidelines for a period of five years after the loan has been paid-off. (5)Term.The term of this agreement shall be for one year after the final building inspection, which is schedufed for 05/19/15. (6) Lobbying. The Contractor and#he County certify that no Federal appropriated funds have been paid by or on behalf of it to any person for influencing ar attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee of Congress, or an emplayee of a member of Congress in connection with the awarding of this ar any contract; the making of any Federal grant; the making of any Federal loan; the entering into of any cooperative agreement; and the extension, continuation, renewal, amendment, or modificatian of any Federal contract, grant, loan, ar cooperative agreement.
