ARTtCLE 3. - TIME OF COMMENCEMENT: N work shall be commenced by the Contrac#or until

Proceed will be issued within thirty (30} days from the da e of the Cantractor signing this Confract, or if it is not,
the Contractor has the option of withdrawing his bid an proposat. Work shali begin no (ater than seven {7)

ARTICLE 4. - PAYMENT: The Gontractor wili b paid according ta the draw schedufe as stated in the
Program Policy Statemen#for the County's rehabi(itatio program after the Cammuni#y Development Division
conducts an inspection certifying that the work has bee comp{eted accarding to the contract. Fina[ payment
due the Contractor wi(i be made after the Contrac#or has furnished the Owner, in care of #he Community
Deveiopment Division, satisfactory reiease af liens or c! ims for liens by subcontractors, Iaborers, and materiai
suppliers for campleted work or installec! materials. Ai such refeases must be notarized. Payments will be
made in accardance with Florida Statutes, Chapter 18.735-74, Locai Government Prompt Payment Act
considered due upon receipt by the Clerk of the Circuit Court and paid upon apprava! by the Board af Gounty
Commissioners. Within thirty (30) days of compietion f the cantract, the contractar shall submit the request
for final payment along with the required documenta#ia for payment. The County shal! not be responsibie for
any requests after the 30 days.
ARTICLE 5. -CONTRACTOR'S I�ISURANCE: The Contractor shail be responsibie for all damages to
persan ar property that occur on #he job site or adj cent thereto as a result of his #ault or neg4igence in
connection with this confract. The Contractor shall, p ior #o cammencing work, furnish evidence of required
comprehensive (iabiiity insurance. The Contractor sha{ also furnish evidence af coverage in accordance with
F[arida Workers' Compensation Laws. Contractar sh 11 furnish CQmmunity Development Division with new,
updated or renewed insurance coverage to continue ta bid on projects. .
ARTlCLE 6. - SUBGtJNTRACTS: All subcon ractors sha{{ be bound by the terms and conditions of
this canfraet insofar as it applies to their work, but this hali not relieve the Contractor from #he responsibiGty to
the Owner for the proper compietion of a1{ work ta b executed under this Gontract, and helshe shall not be
released fram this responsibiiity by any subcontrac#u I agreement he may make with others. The Contractor
shall be required to furnish to the tJwner and Community Development Diuision in writing, a list of the names af
the subcontractars proposed for the principa[ portions af the work at this contract signing. The Contractor sha{{
not emptoy any subcontractor to whom the Owner ar the Comrrtunity Develapment Division may have a

� ARTICLE 7. -GENERAL RESPONSIBILtT1ES O THE CONTRACTOR:

7.4 The Contractor shall be responsibi for the acts and omissions of all his employees, and
all subcontractors, their agent and employees, anti ail other persans perfarming any of
the work.

materials or rubbish caused by thi work.
7.8 The Contractor shall permit the Community Deveiopment Divisian to examine and
inspect the construction work und r th'ss contract at any reasonable time.
7.9 The Contractor shall fumish the wner and the Gommunity Development Division with
the names, addresses, and telep ne numbers of the#irms to be contacted for service to
the various appliances or other equipment that was installed or repaired under this
contract.
7.10 The Contractor shall indemnif and save harmless the County, its agents and
employees, and the Owner from I ability for any injury ar damages to persans or property
resu(ting from the Confractor`s rosecution af wark pursuant ta the provisions of this
contract.
7.11 The cantractor sha11 be responsi le to submit ail requests #or payments, change orders,
re(ease af iiens, subcontractar li t, etc., ott the most current forms obtained from the
Community Devefopment Divisio website#or contractars.
7.12 A!l products and materials used i the rehabilitation of Cammunity Development Division
projects shal! be made by Ame ican manufacturers, if available, and meet the lates#

ARTlCLE 9. •GENERAL RESPONSIB[LITtES F THE COMMUNITY DEVELOPMENT DIVIStt�N:
9.1 The Community Deve(opment D vision sha{i pravicie general administration af the
contract, but it is understood by all parties that the Counfy is not a party to titis Contra�t.
9.2 The Community Develapment Divi ion shalfi make#requent inspections of the work whiie
it is in pragress #o determine if it is proceeding in accordance with the cantract docu-
ments.
9.3 The Cammunit}r Development Divi ian shal{ have the authartty to reject wark which does
not conform to the confract docum nts.
� ARTICLE 10. - CONTRACT DOCUMENTS: T is contract cansists of ths Bid Proposa{, the Work
Write-Up, includirtg any drawings or plans, the General id Specifications, and any insurance poiicies specified
in Article 5 above.
ARTICLE 31. - CHANGES !N THE WC1RK: Ex ept in an emergency endangering life or property, no
change in the work shafii be made by the Contractor unl ss he has received a prior written order signed by the
Qwner and autharized representatives of the Commu ity Develapment Division. The contract sum and the
contract #ime may be changed only by Change �rder. No e�ctra costs will be paid to the Contractar when he
has negiected to properly evaivate the e�ctent of the ca struction wark. Change orders need to be in line with
bidding amounts or pricing.
ARTtC4E�12. - GUARANTEES AND WARRA TIES: The Contractar shafl guarantee ta correct any
work that fails to canfarm to the contract documents nd shaD correct such defects due to faulty materials,
equipment, or workmanship which appear during the p agress of the work or wi#hin a period of one year from
the date of final inspection and acceptance or such !o ger periods of tirne as may be specifiied by 1aw ar by
terms of any special guarantees required by the can# ct documents. The provisions of this Article apply to
wark done by su�contractors as weli as work done y the Contractor. Furthermore, the Contractor sha44
furnish #he 4wner, in care of the Gommunity Develo ment Division, with aii manufacturers' and suppliers'
written guarantees and warranties covering material and equipment furnished under the contract. These
documents are to be neatly organized and bound in a ile type foider and su6mitted with the final pay request.
ff a warranty item malfunctions or breaks, the Contra a►-shall contact #he Owner wifhin 24 hours to scheduie
the repair or replacement of the item. The warranty ite should be repaired or replaced w�thin seven {7} days.

�ARTI�:LE 13. - TERMINATION OF CONTRA T BY THE OWNER: If the Contractor defaults or
neglects to carry out the work in accordance with the c ntract doeuments or fails to perform any provisions of
the contract, the Community Development Division or t e Owner acting through the Community Development
Division may, after seven (7) days' written notice, te inate this contract and finish. the work by whatever
method he deems expedient. If the unpaid balance of the contract sum exceeds the expense of finishing the
work, such excess shall be paid to the Contractor; bu if such expense exceeds such unpaid balance, the
Contractor shall pay the difference to the Owner or th Community Development Division. Failure to pay the
unpaid balance will result in disbarment from bidding on future Community Development Division projects.
ARTICLE 14. - TERMINATION OF CONTRA T BY THE CONTRACTOR: If the Owner fails to
perform any applicable provisions of the contract, the ontractor may, upon seven (7) days' written notice to
the Owner and the Community Development Division terminate the contract, and recover from the Owner
payment for all work satisfactorily completed and all oth r such remedies as are otherwise specified by law
ARTICLE 15. -GENERAL CONDITIONS:
15.1 The Work Write-Uq shall take precedence over the basic specification and, when in
conflict, the material, equipmen , or workmanship called for in the "Work Write-Up" will
be required.
15.2 The Drawinqs of floor plans ar diagrammatic only, illustrating the general intention of
the Owner; they do not show II the work required, exact dirnensions, or construction
details.
15.3 The 2010 Bid Specifications ar detailed in a separate booklet available to the Owner
and the Contractor from the Co munity Development Division.
15.4 Workmanship shal( be done i accordance with the standards of the several trades
known as a "workmanlike man er."
15.5 Materials shall be new, in go d condition, and of standard grade unless otherwise
agreed in writing before their d livery to the job.
15.6 Repairs shall be made by the Contractor to all surtaces damaged by the Contractor
resulting from his or his subco tractor's work under this contract at no additional cost
to the Owner. Where "repair o existing work" is called for by the contract, the featur.e
is to be placed in "equal to ew condition" either by patching or replacement; all
damaged, loose, or rotted part shall be removed and replaced, and the finished work
shall match adjacent work in d sign and dimension.
15.7 Bids or Proposals will be sub itted at Bidder's risk and the Owner or the Community
Development Division reserve the right to reject any or all bids or proposals. All bids
or proposals are to be typed - of hand written.
15.8 Buildin� Codes -All work to be done shall be subject to the regulations of local building
codes as interpreted by the pplicable City or County building department/division
whether or not covered by the pecifications and drawings for the work.
15.9 Cleanup and removal from the site of all debris and waste materials resulting from his
work shall be the responsibilit of the Contractor. Materials and equipment that have
been removed and replaced s part of the work shall belong to the Contractor and
shall be removed from the site.

ARTlC�E 16, - ARBiTRAT10N: The Contra tor and Owner agree, that in cases of apparent
' irreconcilable differences arising in connectian with ca tract perFormance or terms of the contract during the
! progress of the construction, to submit the matter t the Community Developrnent Division for binding
� arbitration.
ARTICLE 17. - UEN WAIVERS:. Contractor ag ees to protect, defend, and indemnify the Gammunity
Development Divisian and #he Owner from any c[aim for unpaid work, labor, or materials with respect to
Contractar's performance. Final payment shall nat be ue until the Contractor has delivered to the Owner, in
care of Gommunity Develapment Division, comp(ete elease of afi liens fnr work completed arising out of
Cantractor's perfarmance or a receipt in fu!! covering al labor and materiais for which a iien could b� ftled or a
bontl satisfactary to the Owner indemnifying him again t any lien. All notice to awners must have a release of
lien for fina! payment. (Form Enclosed in Contract).
ARTICLE 18. - PRt1HtBITiON OF KICKBAC S: The Cantractor nor any of its officers, partrters,
awners, agents, representatives, employees, or pa ies in interest has in any way coiiuded, canspired,
connived, or agreed, directly or indirectly with any oth r Bidder, firm, or person to submit a coliusive or sha(I
Bid in connection with the Contractor for which the att ched Bid has been submitted or to refrain fram bidding
in connectian with such contract, or has in any manne , directly or indirectiy, sought by contract or coiiusion or
communication or conference with any other Bidder, fi , ar person ta fix any overhead, profit, or cost element
of the Sid price or the Bid price of any other Bid er, or to secure through any coilusion, conspiracy,
connivance, or uniawfui cantract, any advantage agai st the Pasco County Community Develapment Division,
or any persan interested in the proposed contract; and,

TRAIdSPORTATION IMPACTIUTILITIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands
that Transportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings, change of
use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89-07 and
90-07,.as amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of
permitting. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receiving a "certificate of occupancy" or final power release. If the project does not involve a certificate of occupancy or
final power release, the fees must be paid prior to permit issuance. Furthermore, if Pasco County Water/Sewer Impact
fees are due, they must be paid prior to permit issuance in accordance with applicabie Pasco County ordinances.
CONSTRUCTION LIEN LAW(Chapter 713, Florida Statutes, as amended): If valuation of work is $2,500.00 or more, I
certify that I, the applicant, have been provided, with a copy of the °Florida Construction Lien Law—Homeowner's
Protection Guide" prepared by the Florida Department of Agriculture and Consumer Affairs. !f the applicant is someone
other than the"owner", I certify that I have obtained a copy of the above described document and promise in good faith to
deliver it to the"owner"prior to commencement. '
CONTRACTOR'SIOWNER'S AFFIDAVIT: I certify that all the information in this application is accurate and that all work
will�be done in compliance with all applicable laws regulating construction, zoning and land development. Application is
hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has
commenced prior to issuance of a permit and that all work will be performed to meet standards of all laws regulating
construction, County and City codes, zoning regulations; and land development regulations in the jurisdiction. f also
certify that I understand that the regulations of other government agencies may apply to the intended work, and that it is
my responsibility to identify what actions I must take to be in compliance. Such agencies include but are not limited to:
- Department of Environmental Protection-Cypress Bayheads, Wetland Areas and Environmentally Sensitive
Lands, Water/Wastewater Treatment.
- Southwest Florida Water Management District-Wells, Cypress Bayheads, Wetland Areas, Altering
Watercourses.
- Army Corps of Engineers-Seawalls, Docks, Navigable Waterways.
- Department of Health & Rehabilitative Services/Environmental Health Unit-Wells, Wastewater Treatment,

I understand that the following restrictions apply to the use of fill:� -
- Use of fill is not allowed in Flood Zone"V�unless expressly permitted.
- If the fill material is to be used in Flood Zone "A", it is understood that a drainage plan addressing a
ucompensating volume" will be submitted at.time of permitting which is prepared by a professional engineer
licensed by the State of Florida.
- If the fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall
construction, I certify that fill will be used only to fill the area within the stem wall.
- If fill material is to be used in any area, I certify "that use� of such fill will not adversely affect adjacent
properties. If use of fill is found to adversely affect adjacent:properties, the owner may be cited for violating
the conditions of the building permit issued under the attached permit application, for lots less than one (1)
acre which are elevafed by fill, an engineered drainage plan is required.
If I am the AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in
this affidavit prior to commencing construction. I understand that a separate permit may be required for electrical work,
plumbing, signs, wells, pools, air conditioning, gas, or other installations not specifically included in the application. A
permit issued shall be construed to be a license to proceed with the work and not as authority to violate, cancel, alter, or
set aside any provisions of the technical codes, nor shall issuance of a permit prevent the Building Official from thereafter
requiring a correction of errors in plans, construction or violations of any codes. Every permit issued shall become invalid
unless the work authorized by such permit is commenced within six months of permit issuance, or if work authorized by
the permit is suspended or abandoned for a period of six(6) months after the time the work is commenced. An extension
may be requested, in writing, from the Building Official for a period not to exceed ninety (90) days and will demonstrate
justifiable cause for the extension. If work ceases for ninety(90)consecutive days,the job is considered abandoned.
