AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, AMENDING SECTION 6 OF ORDINANCE NO. 1003-08;
PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

WHEREAS, the City Council of the City of Zephyrhills, Florida haslirevio'usly found W w o
and determined it to be in the best interest of the safety, health, and welfare o 'the citizens of the-

WHEREAS, pursuant to Section 6 of Ordinance No. 1003-08, Term' j. Review, e
City Council has conducted a full evaluation of the components of the transportation itn'p'acf fee; X
and

WHEREAS, the City has retained Kimley-Horn and Associates, Inc. (Kimley-Horn) tq,t
conduct a periodic reassessment of the City's transportation impact fees and to prepare a report
on the appropriateness of the City's current impact fees; and
WHEREAS, Kimley-Horn has prepared a report titled "Transportation Impact Fee,
Update"dated September 25, 2015; and t,s
WHEREAS, this Ordinance is enacted pursuant to the Florida Municipal Home Rule,.
Powers Act, Chapter, Florida Statutes, the City of Zephyrhills Comprehensive Plan, and tither
applicable law authorizing a municipality to set rates, fees, and charges for new development;
and
WHEREAS, it is in the best interests of the public health, safety, and welfare of the
citizens of Zephyrhills to amend the City's Transportation impact fees.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS
HEREBY ORDAINS,AS FOLLOWS:
Section 1. Amending Ordinance 1003-08, Section 6, Adoption of Impact Fee Study, and
the same is hereby, amended to read as follows:
The Council hereby adopts and incorporates by reference the following Impact Fee Update
Study:

City of Zephyrhills, Florida, Transportation Impact Fee Update, dated September 10,
2015,prepared by Kimley-Horn and Associates, Inc., hereto attached.
Section 2. REPEALER.
Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent of
any conflict.
Section 3. SEVERABILITY.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause, or provision and shall not be affected by such holding.
Section 4. INCLUSION IN CODE.
The provisions of this Ordinance shall become and be made part of the Code of the City of
Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-lettered and the
word "ordinance" may be changed to "section", "article" or such other appropriate word or
phrase in order to accomplish such.

SECTION 5. EFFECTIVE DATE.
This Ordinance shall become effective upon passage on the second reading and signing by the
Mayor.
