<br /> SOUNDING IN,CONTRACT,TORT,NEGLIGENCE,STRICT LIABILITY,WILLFUL AND WANTON CONDUCT,WARRANTY(EXPRESSED OR IMPLIED),OR OT HERWISE
<br /> ARISING OUT OF,OR RELATING TO,TFIE W ORK AND SERVICES PERFORMED UNDER THIS AGREEMENT,OR OTHERWISE SHALL CONTRACTOR BE LIABLE FOR OR
<br /> OBLIGATED IN ANY MANNER FOR SPECIAL CONSEQUENTIAL,OR INDIRECT DAMAGES,INCLUDING BY WAY OF EXAMPLE BUT NOT BY WAY OF LIMITATION,
<br /> SUCH DAMAGES AS,DAMAGE TO INTERIOR,IASS OF USE,LOSS OF PROFITS,OR SUTTS BY THIItD PARTIES.WARRANTIES ARE ONLY FOR CUSTOMER SPECIFIED

<br /> 6.Conuactor shall not be respons�ble for or liable for any damages to Owner if the Contrac[or is delayed at any time in the progress of tt�e work by any act of neglect of Owner,or by any
<br /> sepazate contrnctor employed by the Owner,or by the changes ordered by Owner in the work, or by labor disputes,fire, unusual delay in transportation,adverse weather conditions,
<br /> unavoidable casualties,or any causes beyond the Contractois connol,or by delay authorized by the Owner.
<br /> 7.Any controversy or claim arising out of or relating to this contract,or the breach thereof,shall be settled by arbitration administered by tbe American Arbitration Association under iu
<br /> Construction Indushy Arbitretion Rules,and judgment on the award rendered by the azbitrntor(s)may be entered in any co¢rthaving jurisdiction thereof.
<br /> 8.Paymenu due and unpaid under the Contract shall beaz interest from the date payment is due at the rate of 18%per annum.If the Owner does not pay the Contrector the payments specified
<br /> under this Conhact,the Contcactor may stop work until payment of the amount owing has been received.In such event,the contract price shall be increased by the amoimt of the Contractor's
<br /> reasonable costs of sbutdown,delay,and start-up.
<br /> 9.It shall be the sole obligation and responsibility of the Owner to determine the existence of any resuictions contained in deeds,subdivision or neighborhood rules and regulations which
<br /> might relate to or restrict the improvements contemplated by this Contract.Contractor shall have no]iabiliry or responsbility for any such nonconformity to or with such restrictions or
<br /> requ'uements.Contractor shall be entitled to payment&om Owner of all sums due hereunder nnhvitt�standing any injunction or prolubition against the work as a result of any violation of such
<br /> restriction or requirements.
<br /> 10.Due to the nature of tbe construction to be done at homeowners request,the Owner takes sole responsibility of any damage done to the driveway at job location.
<br /> I1.All agreements contingent upon strikes,accidents or delays beyond our control.Owner to carry fire,tomado and other necessary insucance.All guarantees/warianties can/will be voided if
<br /> any water penetration enters from outside the work area as described in contract.
<br /> 12. Contrector not responsible for any a'u condition damage or malfunctions. Reasonable caze will be taken in handling the air conditioning equipment.
