Owner shali make draw payrnents to <br /> contractor within 3 working days after reqnest by contractor, <br /> If payrnent is not received by the Contractor within(5)days after delivery of payment demand for work <br /> satisfactorily completed,contractor shall have the right to stop work or terminate the contract at his <br /> option. Termination by Cantractor under the provisians of this paragraph shall not relieve the Owner af <br /> the obligations of payments to Contractor far that part of the work performed priar to such termination. <br /> Termination by 4wner nnder the pravisions of this paragraph shall not relieve the Owner of the <br /> abligations af payments to Contractar for that part of the work perfarmed prior to such termination. <br /> ARTICLE G. DUTIES O�'T13E CONTRACTOR <br /> 6.1 All work shall be in accordance to the provisions of the plans and specifications. All systems <br /> shall be in good worki�g order. <br /> 6.B All work shall be completed in a workman like manner,and shall comply with all applicable <br /> national,sfate and lacal building codes and laws. <br /> 6.3 Atl work shall he perfarmed by Iicensed individuals to perform their said work,as outlined by <br /> law. <br /> 6.4 Contractox shali obtain aII permits necessary far the work to be colnpleted. <br /> 6,5 Contractor shall remove a11 canstr�ction debris and leave the praject in a broom clean condition. <br /> ARTICLE 7. CIWNER <br /> 7.1 The Owner shall comrnunicate with subcontractars only through the Contractor. <br /> '7.2 The Owner will not assume any liability or responsibility,nor have contral over or charge of <br /> constructio�a rneans,methods,techniques,sequerzces,procedures,ar for safety precautions and pragrams <br /> in connection with the project,since these are solely the Cvntractor's respansibitity. <br /> '7.3 The Owner shall provide access to jab site. <br /> 1.4 Keep small children and Pets clear of work site and alI work areas. <br /> '7.5 Make any and all changes to the original contract in writing and ensure that a Change Order form <br /> is completed,signed and paid for before thase changes are made. This is to insure that any and <br /> all speciat order items are ordered as soon as possible as to lessen the dawn time of job <br /> completion. <br /> 'T.6 The C3wner shall have ali items or ma#erials supplied by the awner at the job site the day of <br /> installation. The owner shall have the responsibility ta ensure that owner-supplied iterns are in a <br /> good and sufficient condition to be installed and that ail necessary parts to install such items are <br /> present(tight bulbs,hardware and etc.} The owner bears all responsibiiities pertainiung to the <br /> condition,perfarmance,and warranties af owner-supplied items. The cantractor shall install <br /> awner-supplied items"as is"and shalt beaa�no responsibility,either explicit or implied for the <br /> item or far its conditian,performance,or warranty. The contractar shall install owner-supplied <br /> items one time, if tl�e item or material has to be reiumed or reptaced it will be returned by the <br /> owner and reinstalled by the contractor with the owner paying for a removal and reinstallation <br /> cost(see change arder)the cost will be given to owner befare the work will be done and only <br /> upon acceptance of the change order by owner. The owner will pay for any additional <br /> subcontractor/cantractor charges that will be incurred if all supplies are not on job and sub has <br /> ta come back because of missing parts or materials supplied by owner. The owner shall not <br /> withoid draw payments due to owner's lack of having correct materials ar items on the job when <br /> specified. <br /> ARTICLE 8. CHANGE ORDERS <br /> 2 Initiated by: Owner Contractor <br />
