• <br /> OR BK 7714 PG 847 <br /> 3 of 19 <br /> Tree means any plant of the vegetable kingdom or any object of natural growth. <br /> Utility Runway means a runway that is constructed for and intended to be used by propeller- <br /> driven aircraft of 12,500 pounds maximum gross weight and less. <br /> Visual Runway means a runway intended solely for the operation of aircraft using visual <br /> approach procedures with no straight-in instrument approach procedure and no instrument <br /> designation indicated on a FAA approved Airport Layout Plan, a military`service's approved <br /> military airport layout plan, or by any planning document submitted to the FAA by competent <br /> authority. <br /> SECTION 3. PURPOSE. <br /> The purpose of this Ordinance is to provide protection for the existing and expected future <br /> operations of the Zephyrhills Municipal Airport, to provide efficient use of the Airport lands, to <br /> provide protection for adjacent land uses and the residents of Zephyrhills and surrounding areas. <br /> SECTION 4. APPLICATION PROCESS. <br /> Prior to applying for a Development Permit under Section 11.01.00 as amended of the <br /> Zephyrhills Land Development Code, applicants must coordinate with the Airport Manager, or <br /> duly appointed representative, to insure that the proposed development is in compliance with the <br /> provisions of the Zephyrhills Municipal Airport Zoning Ordinance. <br /> (a) In order to prevent the Construction of Structures deemed to be dangerous to air <br /> navigation, each person proposing to construct any Structure, which will fall within <br /> one or more of the categories detailed under Sections 5 and 6 of this Ordinance, <br /> should receive written approval from the Airport prior to submitting an application <br /> for Development Permit review. Applicants will be advised at that time if further <br /> coordination with the Federal Aviation Administration and submittal of FAA Form <br /> 7460-1, "FAA Notice of Proposed Construction or Alteration" is required. <br /> Coordination with the FAA typically can take up to 90 days to process. <br /> (b) Applications and submittals for Development Permit review will not be processed <br /> without evidence of Airport approval. The Airport Manager, or duly appointed <br /> representative, will indicate compliance with the height and land use limitations <br /> prescribed by this Ordinance by annotating signature approval on the Development <br /> Permit application. If FAA coordination is required, a copy of the FAA <br /> Determination Letter indicating a Notice of No Hazard to Air Navigation must also <br /> be submitted to the Airport Manager prior to approval. <br /> (c) In the event the Airport denies an application for violating the provisions of this <br /> Ordinance, the proposed Construction shall not be permitted by the City unless a <br /> variance is granted from the requirements of this Ordinance by the Board of <br /> Adjustment. <br /> SECTION 5. NOTICE OF PROPOSED 'CONSTRUCTION OR ALTERATION AND <br /> AERONAUTICAL EVALUATION. <br /> The owner of any proposed construction or alteration of more than 200 feet in height above the <br /> ground level at its site, or any proposed construction or alteration which exceeds a slope of 100 <br /> to 1 extending outward and upward for a horizontal distance of 20,000 feet from the nearest <br /> point of each runway from the Zephyrhills Municipal Airport shall comply with the provision of <br /> 77 CFR Subpart B, by filing a Notice of Construction or Alteration with the Federal Aviation <br /> Administration. Prior to the issuance of any Development Permit or consideration of any request <br /> for a variance to this ordinance the applicant shall submit documentation to the Building <br /> Department showing compliance with the federal requirement for notification of proposed <br /> construction and a valid aeronautical evaluation in accordance with the application process <br /> discussed in Section 4 of this Ordinance. <br /> 3 <br />
