<br /> may be substituted for equivalent products due to availability,All excess materials remain the property of Company.
<br />' S. Access fo Property. The prices and terms of Corupany's estunate and this Agreement aze based upon access to the property and
<br /> Customer agrees to pro��ide reasonable access. Cs�mpany shall not be res�crnsible for damages arism�&om delay due to inclein�nt
<br /> weather,strikes,fires,accidents,delays in shipme�nts or delivery of matenals;or any causes beyond G�ompany's reasonable contz•ol.
<br /> Company shall not be xesponsible for protect�on af Customer s property, e:zcept to provide that pr�:�tLctions which is specifically
<br /> called for under the specification provided by thzs Agreement. G�stomer also agrees to remove, store and/or protect personal
<br /> property duruig Com�any's work. Customer will manage and be responsi.ble for protection of vehicles and property expos�d to
<br /> damage by Company s s�•ork.
<br /> 4�. Job Completion. Job cc�mpletion shall be the datr,on which Company's wor.k is substantially complete or the date of Company's
<br /> last item of work at the property,whichever is enrGer. Customer's failure tcs make prompt payment shall entitle Company,on the
<br /> forty-eight(48)hours'tiv�Ytten nohce,to stop wor.k.The Agreed Price shall be inereased by Company's reasonable costs to stop the
<br /> proJect and/or resume�vork. In the event Customer chooses not to pay fox•a part of the work, an individual line item; or a trade,
<br /> Customer releases Company of its obligations fc:�r the performance of the component with regard to the itttegrity of the building
<br /> System as a whole.
<br />' S. Past Due Amounts. Custoiner agrees to pay a sen%ice charge of 18%on ali i�alances 30 days or more past due.Customer also a�,rees
<br /> to pay for all collectiori costs, mcluding emQloy�e: time and expense and all attomeys' fees and costs Company incurs in eidier
<br /> collechon of and/or protection of its interests in Customer's past due aceow�it or performance of this Ag;reement.
<br /> 6. Hazardous Materials. I�fothing contained in this A�eement shall be constnied to require Company to detemune the presence or
<br /> absenee of any hazardc>us materials or asbestos-��untaining materials affecting the property or to rc:qi.ure Company to remo�•e or
<br /> protect such materials.
<br /> 1 Liabihty.Company is not responsible for damage or loss caused in whole o.r in part by:the acts or onussions of other parties,tracies
<br />, or contractors;lightening,gale force winds(+50 m.p.h.),hailstorms,ice da�:nage,ice damns(caused by thawing and&eezin�oi'ice,
<br /> water or snow), hurricxnes, tornadoes, floods, earthquakes or other unusual phenomena of the elements; structural set ement;
<br /> failure,movement,cracking or excess deflection a�f the roof deck;defects or:failure of materials used as a roof substrate over��hich
<br /> Company's roofing material is apphed; faulty c�:�ndition of parapet walls; copings, chimneys, skylLghts, vents, supports or esther
<br /> parts of the building;vai��or condensation beneath the roof;penetrations for pitch boxes; erosion, crac;king and porosity of mortar
<br /> and brick; dry rot; stoppage of roof drains and gutters; penetration of tlie roof fmm beneath by rising fasteners of any rype;
<br /> inadec�uate drainage,slope or other conditions be�c�ond the control of Com��aily which cause ponding or standing water;termita:s or
<br /> other uisects;rodents or uther animals; fire; or hnrmful chemicals,oils, ac�.ds and the like that come into contact with Custo�ier's
<br /> roof and cause a leak or otherwise damage Customer's roof. If Customer's r�of fails to maintain a vratertight condition becau:;e of
<br /> daznage by reason of anv of the foregoing,Comp�ny's wananty shall imm�::diately become null and void for the balance of its term
<br /> unless such damage is 6.,r Company at the expense of Customer. Company accepts no liability to indemnif� or hold Custc�nler
<br /> harmless for claims or clamages to persons or pmperty, except to the exient that such damage occurs dunng performance of
<br /> Company's work and are the direct result of Conipany's enor or omission,Notwithstanding the foregoing, Company shall n��t be
<br /> responsible for damages to any area of the property upon wluch Compana's work has not been campleted, nor is the Company
<br /> responsible for damage• to flowers or landscapin�, or minor broken bralic•hes on trees, plants or shrubbery. In no event shall
<br /> Company be responsibl.e for any.type of damage r.,sulting form vibrations; :including,but not limited to,intenor drywall damage,
<br /> nail pops or disconnection of chunneys, flues, air ducts,ventilarion shafts, exhaust vents,fumace v�r.its or sewer vents. Custumer
<br /> understands and agrees ihat Company shall have no responsibility for damages of any kind to person or property occurring after 1ob
<br /> completion.
<br /> Ft. Hold Harmless. Custorn�r agrees to hold Compan}� harmless in connectian with the work described herein and that Customer's
<br /> maximum recourse shall be, and Company's ma:�:imum hability under this Agreement shall be limited to, the amount Com��any
<br /> Uilled to Customer.,Castomer understands and acknowledges that Company does not wanant or gu;arantee previous worlananship
<br /> or pre-existing materia7s; not any material or labor not onginally providEd by Company. Company shall not be responsible for
<br /> latent defects m materials and accessories supplied.Company shall not be responsible for rework required as a result of the acts or
<br /> eirors of others.
