<br /> This writing consritutes the entire agreement. A1 material is guaranteed as specified. All work shal]be completed in a workmanlike manner �
<br /> according to standard practices and att local building codes. The fotlowing additional provisions are expressly incorporated into this contract.
<br /> i. I.ICENSES,PERMITS,SAFETY I2ULES,$UILDING COT}ES,ZONIiVG,COlYiPANY IlYSURAIYCE AND OTHEI2 LAWS.
<br /> SPC shall be liabla to custorner for obtaining building pertnits and inspections.SPC shall,be responsible to Homeowner/Customar for the
<br /> compliance of safety rutes and existing buitding codes,zaning ordinances and others taws. SPC shatt comply with all laws relating to Workers
<br /> Compensation and carry Public Liabitity and Properiy damage standard form insurance. If a changa occnrs to any applicabie safely nzle,
<br /> building code,zoning and other ordinance which requires additional goods and installation sarvices to perform tha contract,the customer '
<br /> agrees to pay the contractor the cost and reasonable profit for such goods and services.
<br /> 2. DEED RESTRICTIONS. It is ihe sole obligation of the custamer to determine tha existence of xestrictions contained in deeds,subdivisiot
<br /> or neighborhaod reguladons which might relate to or restrict the improvements undar this contract. Contractor shall have no liability or
<br /> respansibi3ity far any such non-conformity with such restrictions/requirements. Contractor shail be entitled to be paid by Customer of ail sums
<br /> due hereunder not withstanding any injunctionlprohibiiion against the wark as a result of any violation of such restrict9onlrequirement.
<br /> ' 3. SCHEDULING. The start date discussed or assigned is an anficipated date,this date is subject to change due to weathar canditions,delays
<br /> �i in material,required permztting,govemment,labor,vehicte breakdowns,sickness and any other conditions beyond the Contractor's control.
<br /> 4. CHANGE ORDERS. Should Customez,or any govemment a$ency require any modification io ihe work cavered vnder this contract,any
<br /> cost incurred by Contractor shall be added to the contract prica for extra work and Customer agrees to pay SPC his normal selling price for
<br /> such work. A3i change ordars must be fallowed with a written request and shall become a part o£this contract and shall be incorporated herein
<br /> 5. DELAY. The SPC or its insurance carriers sha11 not be held responsible for any damages occasioned by delays. If Contractor is delayed ai
<br /> anytime by any act or neglect pf the customer or their representatives or any contractor employed by Customer or any changes ordered in tha
<br /> work,the contractor shall be raimburse8 or paid for the additiona]exp�se or damage. Ttris shall inctude loss of equipment or rentaI caused by
<br /> said delay, In all cases invnlving work stoppage,extra work,changes or cancellatians,it is agreed that tha customer wifl pay the contractor for
<br /> its fuil cost of labor and materials pIus 30%overhead,plus 30%profits.SPC shal]not be held]iable for any damage or delay beyond the SPC
<br /> control. SPC is not responsible for price infTation and or increase due ta national disasters,shortage of materiaEs,increase in fuel/crude oil
<br /> costs,hurricane,tomadoes and other acts of God.
<br /> 6. ADVERTISING.Customer hereby grants SPC the right to display signs and advertise at the job site until payment in full has been mada.
<br /> Customer granis SPC the right to publish the project street address an a`4eferences"list,which may be given to prospective customers.
<br /> '7 GUTTERS. We recommend that gutters may be remaved and re-installed by the gutter company although we cannot guazantee against
<br /> incidentai damages. To avoid any damage to existing gutters,the homeowner should contact their gutter company to remove the gutters for
<br /> the�ew roof instailation to be perfarmed and have gutters reinstalled aSer new roof is completed.
<br /> , $. TERMITES,PESTS&HAZARDOUS SUBSTANCES. SPC is not qualified or licensed as an inspector or abatement contractor for
<br /> hazardous materials o£for pests(inctuding but not limited to termites). Should any hazardous substances or pests be suspected to be present
<br /> , on tha premises,ii is the Customer's responsibility to arrange and pay for inspectian and treatment. SPC cannot certify or warrant your
<br /> � building free of hazardous materials or pests. SPC and insurance carrier shall not be held liable for any damage due ta termites,wood boazs,o�
<br /> any wood destroying arganisms after the work has been completed. SPC discIaims aIl iiability for all claims,disputes,rights,losses,damages,
<br /> Icauses of action or controversies(claims)pertaining to Moid or mildew including ciaims arising out or relation to detection,removal,d'asgasai
<br /> or remediation of Mold or Mildew,whether those claims arise in law,equity,contract,warranty,tort ar federal or state statutory claims,and
<br /> , whether those ctaims are based on the acts or omissians af SPC or individuals or entities under Conaactor's contral. The Customer is solety
<br /> liable and responsible for all damages actual or consequential caused by mold or mildew.
<br /> 9 AADITI4NAL WORIC. This proposal does not cover the furnishing or erectian of any wood work,painting,cutting,patching,electrical
<br /> or etc that might be required for ihe erection of the work covered in this contract unless specifically mentionad above. Additional tayers or
<br /> roofing under the ariginal roof wi]]be$25.00 per squaze per layer and is not part of the original contract.SPC has the discretion to take the
<br /> necessary precaution to the flashing or skylight raplacement to ensure a complete watertight roof system. Tha customar agrees to pay the SPC
<br /> for his normat fees for skylighi replacernent. SPC will nat be responsible for debris falling inside from skylight during the install,it is the
<br /> Customers responsibility to cover fumishing,and eta SPC is not responsible for skylights that need to be repiaced or for skylights that are not

<br /> 10. MANUFACTURER LIABILITY. SPC shall nat be held responsible for any product manufacturing defects or product availability.
<br /> 11. UNSEEN OR HIDDEN PROBLEMS. It is not the Contractar's responsibility for bowad wood or dips in the decking. Should concealec
<br /> ar unlmown cond'rtions in an existing structure be at a variance with conditions indicated in the description of the work to be performed from
<br /> those ordinarily encauntered and genera3ly recagnized as inherent in work of the chazacter provided for in this agreement.?'he agreement price
<br /> shall be equitably adjusted upon notice thereof from the SPC to the Customer If there is an increase in 14e price of_the products charged
<br /> by the Contractor in excess of 5%subsequent to making this proposallcontract,the price set forth in this proposaUcontract shall be increased
<br /> � without the need for a written change order ar amendment to the contract to reflect the price increase and addationa]direct cost to the
<br /> Contractor Contractor will submit written documentation of the increased chazges to the Customer
<br /> �, i2. CLEAN UP. SPC wiIl Ieave premises on a neat,broom clean condition. Any debris consisting of dust,dirt,asphalt or small bits or
<br /> � materiais that settia into attics,garage area ar any other area being worked over with opening beams ceiling or attic,is unavoidable and SPC
<br /> is nat responsible for this cleanup.
<br /> II 23. MATERIALS. Customer and SPC mutuaily agree that any colar,makes,written on the contract are chosen by the Customer. If the
<br /> Imateriais chosen aze not available,the Custamer and SPC wiil mutualiy agree on a substitution. Prices in all matezia]ased for the project are
<br /> subject to change,due to an inerease in costs of goods or services resulting.from circumstances beyond the Contractors control such as federal
<br /> mandates,embargoes.ecanomic turrnoil,mititary conflict,strikes,war(declared or undeciared)riots,delays by carriers,shipment or receipt of
<br /> materials from supplier,shortage of materials delayed productian or increase in fueilcrude oi!costs.
<br /> 14. CONTRACTOR LIABILITY. SPC or its insurance carriers shall not be responsible for conditions which depart from conventional
<br /> building designs,inetuding but not fimited to damaged decking,insuIation,trusses,watls,siding foundations,driveways,sidewalks,ceilings,
<br /> skylights,plumbing,electrical,air conditioning or lines,drains and other roaf rnaunted aquSpment. SPC and its insurance carriers shail not
<br /> be held responsible for any damages that may occur during construction project:damaged,cracked,or broken driveway or sidawalks,lawns,
<br /> gardens,damage to p3ants,floral or scrubs,garage doors,foundations,other structures,buildings or portions thereof,sprinkler systems,wetis,
<br /> or any damage to septic tanks or drain fields. The Customer shall grovide access for heavy equipment. Magnats will be use�around the
<br /> properry,during the roofing praject and after the completion of the roof,but due to the nature of the industry,some fasteners/nails may remain
<br /> trapped in the grass or bushes. SPC,suppliers and insurance carriers shalt not be responsible for the damage to the interior of buiidings due to
<br /> normal vibraYion associated with the roafing process. Items not securely fastened on any interior or exterior walls or ceiling should be
<br /> removed. SPC,suppliers,and insurance carriers shail npt be responsible for the any loss or use af any facility or any interior or exterior
