K. , Dpty Clerk <br /> AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, <br /> APPROVING A SMALL SCALE FUTURE LAND USE MAP <br /> AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING <br /> THE FUTURE LAND USE MAP DESIGNATION FROM COUNTY N/A <br /> TO CITY INDUSTRIAL, AND AMENDING THE ZONING FROM <br /> COUNTY R1 TO CITY L1, FOR PARCEL 19-26-22-0000-00400-0030; <br /> PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br /> Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's territorial <br /> boundaries upon receipt of written consent of the land owners, together with the approval of the <br /> City Council of said Future Land Use Map amendment duly expressed by Ordinance; and <br /> WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br /> Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of <br /> written consent of the land owner, together with the approval of the City Council of said <br /> rezoning duly expressed by Ordinance; and <br /> WHEREAS, due public notice of hearing on the proposed rezoning was given by the City <br /> Council.ex November 27-, 2417 -as required by the Zephyrhills Land Development Code, as <br /> amended, and Chapters 163 and 166, Florida Statutes; and <br /> WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a public <br /> hearing on the 10th day of October, 2017 to consider said proposed rezoning; and <br /> WHEREAS, the Future Land Use Map Amendment meets the criteria of a small-scale Map <br /> amendment for the proposed FLUMA amendment are consistent with the goals, objectives and <br /> policies of the Comprehensive Plan; and <br /> WHEREAS, the City Council has determined that the L1 zoning category would be appropriate, <br /> would promote the general welfare, and encourage proper development within the City. <br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL <br /> OF ZEPHYRHILLS,FLORIDA,AS FOLLOWS: <br /> SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein. <br /> SECTION 2: The following described lands, lying and being situated in Pasco County,to wit: <br /> Parcel Id No. 19-26-22-0000-00400-0030 <br /> Physical Address: N/A <br /> Legal Description: COM AT SW COR OF NW 1/4 OF SECTION 19 TH NOODG 15' 31"E <br /> 764.77 FT TO A POINT ON NORTH RIGHT OF WAY LINE OF ZEPHYRHILLS BYPASS <br /> EAST THN88DEG 25'06"E 579.46 FT TO POINT OF CURVE CONCAVE TO NW RAD <br /> 2804.79 FT TH ON ARC OF SAID CURVE 547.15 FT CHDBRG & DIST N82DEG 49'47"E <br /> 546.28 FTTH NO1DEG 09'00"E 260.00 FT TH N88DEG 51'00"W 60.00 FT FOR POB TH <br /> CONT N88DEG 51'00"W 217.80 FT TH NO1DEG 09'00"E 200.00 FT TH S88DEG <br /> 51'00"E217.80 FT TH SO1DEG 09'00"W 200.00 FT TO POB TOGETHER WITH AN <br /> INGRESS & EGRESS EASEMENT PER OR 2038 PG 955 OR 8806 PG 1539. <br /> 1.00 acres M.O.L. <br /> the Future Land Use Map designation is INDUSTRIAL and is hereby rezoned L1 and included <br /> within the boundaries of the City of Zephyrhills, Florida. <br /> SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to <br /> the extent of such conflict. <br /> PAULA S.O'NEIL,Ph.D.PASCO CLERK 8 COMPTROLLER <br /> Record and Return to: 12/21/2017 9 4am 1 of 2 <br /> City Clerk's Office OR BK 9652 PG 2168 <br /> 5335 8th Street <br /> Zephyrhills, FL 33542 <br />
