111111111414111111111111041111 <br /> 2018007497 <br /> ORDINANCE NO. 1356-18 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> ZEPHYRHILLS, FLORIDA AMENDING ORDINANCE NO. 1329-17 TO <br /> CHANGE THE CALENDAR YEAR FOR THE BOARD OF <br /> ADJUSTMENT, CODE ENFORCEMENT, AND APPEALS TO BE <br /> CONSISTENT WITH OTHER CITY OF ZEPHYRHILLS BOARDS AND <br /> COMMISSIONS; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City Council combined the Board of Adjustment and the Code Enforcement <br /> Board into a single board to carry out the duties of both by enacting Ordinance No.: 1329-17; <br /> and <br /> WHEREAS, the City Council desires to amended Ordinance 1329-17 to change the board year <br /> from January through December to July through June of the following year; and <br /> WHEREAS, the alteration of the calendar year for the Board of Adjustment, Code Enforcement <br /> and Appeals is consistent with other City of Zephyrhills Boards and Commissions. <br /> NOW THEREFORE, BE IT ENACTED, AND ORDAINED BY THE CITY COUNCIL <br /> OF THE CITY OF ZEPHYRHILLS,FLORIDA,THAT: <br /> SECTION 1: Section 30.081 of the Code of Ordinance for the City of Zephyrhills as enacted in <br /> Ordinance 1329-17 shall be deleted and replaced as set forth herein: . <br /> Section 30.081 COMPOSITION; OFFICERS <br /> (A) Appointment; membership. <br /> (1) The City Council shall appoint a panel of five members to be known as the Board of <br /> Adjustment, Code Enforcement and Appeals, which board shall whenever possible <br /> consist of the following: <br /> (a) Engineer/architect. <br /> (b) Building contractor. <br /> (c) Electrical contractor. <br /> (d) Home inspector(licensed). <br /> (e) Plumbing contractor/mechanical contractor. <br /> The members, seats 1-5, shall be appointed individually by each member of City Council <br /> (seats matching) with approval of the majority of City Council and they shall serve for <br /> three-year staggered terms. In year one, with term ending June 30, 2018, there shall be <br /> initially appointed two members representing seats 3 and 5; in year two, two members <br /> representing seats 1 and 4 shall serve until June 30, 2019; in year three, one member <br /> representing seat 2, shall serve with an expiration date of June 30, 2020. Thereafter all <br /> appointments will follow the terms of the appointing member of City Council as <br /> determined through the election process. <br /> (2) Chair; Vice Chair; and Secretary. There shall be a Chair who shall preside at <br /> meetings. There shall be a Vice Chair, who shall in the absence of the Chair, preside <br /> over meetings. The Chair and Vice Chair shall be a regular member of the Board, and <br /> shall be elected by the membership each year at the first meeting after the appointment of <br /> new members. A qualified city employee will be assigned the duties of Secretary. The <br /> office of the City Clerk shall keep public record of such meetings. All meetings shall be <br /> public under the Government-in-the-Sunshine Laws. <br /> (3) Removal by Council. City Council may remove any member of the Board of <br /> Adjustment, Code Enforcement, and Appeals for just cause.
