1 111111 11111 1 1111111 11 11111 11111 1011 11111 1 1 1 1 1 11111 111111 II <br /> 2018036574 <br /> ORDINANCE NO. 1351-18 <br /> AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, <br /> APPROVING A LARGE SCALE FUTURE LAND USE MAP <br /> AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING <br /> THE FUTURE LAND USE MAP DESIGNATION FROM COUNTY IL TO <br /> CITY INDUSTRIAL, AND AMENDING THE ZONING FROM COUNTY <br /> I1 TO CITY LI, FOR PARCEL 06-26-22-0000-01500-0020 PROVIDING <br /> FOR CODIFICATION,SEVERABILITY,AND AN EFFECTIVE DATE. <br /> WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br /> Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's territorial <br /> boundaries upon receipt of written consent of the land owners, together with the approval of the <br /> City Council of said Future Land Use Map amendment duly expressed by Ordinance; and <br /> WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br /> Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of <br /> written consent of the land owner, together with the approval of the City Council of said <br /> rezoning duly expressed by Ordinance; and <br /> WHEREAS, due public notice of hearing on the proposed rezoning was given by the City <br /> Council on November 27, 2017, as required by the Zephyrhills Land Development Code; as <br /> amended, and Chapters 163 and 166, Florida Statutes; and <br /> WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a public <br /> hearing on the 10th day of October 2017 to consider said proposed rezoning; and <br /> WHEREAS, the Future Land Use Map Amendment meets the criteria of a small-scale Map <br /> amendment for the proposed FLUMA amendment are consistent with the goals, objectives and <br /> policies of the Comprehensive Plan; and <br /> WHEREAS, the City Council has determined that the LI zoning category would be appropriate, <br /> would promote the general welfare, and encourage proper development within the City. <br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL <br /> OF ZEPHYRHILLS, FLORIDA,AS FOLLOWS: <br /> SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein. <br /> SECTION 2: The following described lands, lying and being situated in Pasco County,to wit: <br /> Parcel Id No. 06-26-22-0000-01500-0020 <br /> Physical Address: 40119 COUNTY ROAD 54, ZEPHYRHILLS, FL 33540-7953 <br /> Legal Description: Section 06, Township 26 South, Range 22 East of Pasco County, Florida. <br /> COM SE COR OF SW1/4 OF NW1/4 OF SEC 6 TH NOODEG34'16"E ALG EAST BDY OF <br /> SW1/4 OF NW1/4 OF SEC 53.20 FT FOR POB TH S89DEG56'01"W ALG SAID R/W353.61 <br /> FT TH S89DEG59'56"W ALG SAID R/W 275.63 FT TH NOODEG34'16"E 937.06 FT TO <br /> NORTH BDY OF SOUTH 3/4 OF SW 1/4 OF NW1/4 OF SEC THS89DEG55'32"E 629.23 FT <br /> TO EAST BDY OF SW1/4 OF NW1/4 TH SOODEG34'16"W 935.82 FT TO POB SUBJ TO <br /> PERPETUAL EASEMENT PER OR 7064 PG 20OR 6041 PG 20. <br /> 13.51 acres M.O.L. <br /> the Future Land Use Map designation is INDUSTRIAL and is hereby rezoned LI and included <br /> within the boundaries of the City of Zephyrhills, Florida. <br /> SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to <br /> the extent of such conflict.
