<br /> Person means any individual, firm, copartnership, corporation, company, association,joint-stock
<br /> association, or body politic, and includes any trustee, receiver, assignee, or other similar
<br /> representative thereof.
<br /> Political Subdivision means the local government of any county, municipality, town, village, or
<br /> other subdivision or agency thereof, or any district or special district, port commission, port
<br /> authority, or other such agency authorized to establish or operate airports in the state.
<br /> Precision Instrument Runway means a runway having an existing instrument approach
<br /> procedure utilizing an instrument landing system (ILS), or a precision approach radar (PAR). It
<br /> also means a runway for which a precision approach system is planned and so indicated by an
<br /> FAA approved airport layout plan or any other FAA planning document.
<br /> Public-Use Airport means an airport,publicly or privately owned, licensed by the state, which is
<br /> open for use by the public.
<br /> Runway means a defined area on an Airport prepared for landing and takeoff of aircraft along its
<br /> length.
<br /> Runway Protection Zone(RPZ)means an area at ground level beyond the runway end to enhance
<br /> the safety and protection of people and property on the ground.
<br /> Structure means any object, constructed, erected, altered or installed, including but not limited
<br /> to: buildings, towers, smoke stacks, utility poles, power generation equipment, and overhead
<br /> transmission lines.
<br /> Substantial Modification mean any repair, reconstruction, rehabilitation, or improvement of a
<br /> structure when the actual cost of the repair, reconstruction, rehabilitation, or improvement of the
<br /> structure equals or exceeds 50 percent of the market value of the structure.
<br /> Object of Natural Growth means any organism of the plant kingdom, including a tree.
<br /> Utility Runway means a runway that is constructed for and intended to be used by propeller-
<br /> driven aircraft of 12,500 pounds maximum gross weight and less.
<br /> Visual Runway means a runway intended solely for the operation of aircraft using visual approach
<br /> procedures with no straight-in instrument approach procedure and no instrument designation
<br /> indicated on a FAA approved Airport Layout Plan, a military service's approved military airport
<br /> layout plan, or by any planning document submitted to the FAA by competent authority.
<br /> SECTION 3. PURPOSE.
<br /> The purpose of this Ordinance is to implement Airport Protection Zoning Regulations which
<br /> provide airspace and land use protection for the existing and expected future operations of the
<br /> Zephyrhills Municipal Airport in order to promote the public interest in safety,health, and general
<br /> welfare. Also,to provide efficient use of the Airport lands, to provide protection for adjacent land
<br /> uses and the residents of Zephyrhills and surrounding areas. The Zephyrhills City Council, as the
<br /> adopting political subdivision, finds that:
<br /> A. The creation or establishment of an airport hazard and incompatible land use reduces the
<br /> navigable airspace available in the region served by the airport;
<br /> B. It is necessary in the interest of the public health,public safety, and general welfare that the
<br /> creation or establishment of airport hazards and land incompatible with airport operations;
<br /> C. The prevention of these airport hazards and incompatible land uses should be accomplished,
<br /> to the extent legally possible, without compensation; and
<br /> D. Preventing the creation or establishment of airport hazards, and the elimination, removal,
<br /> alteration, mitigation, or marking and lighting of existing airport hazards are public purposes
