Rept: 775379 Ree: 109.50 <br /> DS: 0.00 IT: 0.00 <br /> 04/21/04 Dpty Clerk <br /> WHEREAS, the City Council of the City of Zephyrhills ("City Council") previously <br /> adopted definitions, permit procedures, and regulations, relating to the installation, construction, <br /> placement, and erection of signs in Zephyrhills; and <br /> WHEREAS, these sign provisions were codified at Article XIII, Definitions, Article <br /> VIII, Signs of the City of Zephyrhills Land Development Code; and <br /> WHEREAS, the City Council finds and determines that these provisions are in need of <br /> updating and revision, to reflect current law and to better protect the citizens of Zephyrhills from <br /> the impacts of excessive signage; and ( JED PITTMAN PASCO COUNTY CLERK' <br /> 04/21/04 09:01am 1 of 24 <br /> WHEREAS, the City Council finds and determines as follows ' OR BK 5816 PG 1594 <br /> (a) Federal and state courts have recognized that local governments lawfully may <br /> regulate on-site signs to protect and enhance the aesthetics and quality of life in a community <br /> under the police powers of the government. <br /> • <br /> (b) Such courts also have recognized that distance and size limitations on signs may <br /> be imposed in the interests of protecting the aesthetic atmosphere and environment in a <br /> community, as well as protecting against traffic hazards caused by distracting and protruding <br /> signs, among other purposes. <br /> (c) The City Council has determined that the City's sign laws, as modified herein, <br /> properly limit and protect the City against: <br /> (1) The unlimited'proliferation in number and location of on-site signs, including <br /> portable signs; <br /> (2) Construction and placement of overly huge, animated, flashing and other <br /> aesthetically unpleasant signs which dominate and detract from the surrounding visual <br /> environment; <br /> (3) Commercial and other signs being placed in residential neighborhoods which <br /> unpleasantly commercialize and clutter such neighborhoods for residents and travelers, as <br /> well as overly-large signs in zoning districts disproportionate in size for the intensity of <br /> the uses permitted and permissible in such districts; <br /> Record and Return to: - .. <br /> City Clerk's Office < 1 <br /> 5335 8th Street <br /> Zephyrhills, FL 33542 ` <br />
