OR BK 591° pG 1449 2 of 25 The City Council of the City of Zephyrhills hereby adopts the amendments to the Comprehensive Plan attached hereto as Exhibits "A", "B" and "C" and incorporated herein. Should the FDCA find these amendments not in compliance, the applicants agree to defend the City and pay all fees and costs associated with the defense thereof, including the retention of attorneys and experts. SECTION 2. Repealer. All provisions of the City of Zephyrhills Comprehensive Plan as amended, in conflict herewith are hereby repealed. SECTION 3. Severability. If any section, subsection, sentence, clause, or provision of this Ordinance is held invalid or unconstitutional by a court of competent jurisdiction, then the said holding shall in no way affect the validity of the remaining portions of this Ordinance having contained such section, subsection, sentence, clause, or provision, and shall not be affected by such holding. SECTION 4. Effective Date. A certified copy of this Ordinance shall become effective within twenty-one (21) days if no appeal is filed. No development orders, development permits, or land uses dependent on this amendment may be issued or commenced before it has become effective. If a final order of noncompliance is issued by the Administrative Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status. A copy of such resolution shall be sent to the Florida Department of Community Affairs, Bureau of Local Planning, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100.
