<br /> THE CITY OF ZEPHYRHILLS, FLORIDA,
<br /> ANNEXING ENCLAVES, WHICH ARE
<br /> ADDITIONAL TERRITORIES TO BE INCLUDED
<br /> WITHIN THE BOUNDARIES OF SAID CITY
<br /> PURSUANT TO THAT CERTAIN INTERLOCAL
<br /> AGREEMENT BETWEEN PASCO COUNTY AND
<br /> THE CITY OF ZEPHYRHILLS AND IN
<br /> ACCORDANCE WITH FLORIDA STATUTE

<br /> WHEREAS, COOL STREAM HOLDING TRUST, is the-present owner of the lands
<br /> hereinafter described in Section 1, and
<br /> WHEREAS, the properties described in Section 1 below created an enclave within the
<br /> incorporated boundaries of the City of Zephyrhills,
<br /> WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco
<br /> County have entered into an interlocal agreement to annex said enclaved properties into the City
<br /> limits of the City of Zephyrhills,
<br /> WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills
<br /> on the 8th day of July, A.D., 2002, and the Board of County Commissioners of Pasco County on the
<br /> 15th day of October, A.D., 2002.
<br /> WHEREAS, COOL STREAM HOLDING TRUST was notified of the public hearing for
<br /> annexation by regular mail and registered mail, return receipt of the lands described in Section 1, and
<br /> WHEREAS, the Board of County Commissioners of Pasco County and the City Council of
<br /> the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within
<br /> the corporate limits of said City, • .
<br /> WHEREAS, the Planning Commission has recommended approval of.the=annexation
<br /> NOW, THEREFORE,BE ITENACTEDAND ORDAINED bythe City Council ofthe City
<br /> of Zephyrhills, Florida, as follows: - ' f- ,
<br /> SECTION 1: That the following described enclaved lands, lying and being situate inPasco
<br /> County, Florida, to-wit: ,'-•-' '

<br /> All that part of Tract 81 lying East of the right of way of U.S.Highway#301, in Section 3, Township
<br /> 26 South, Range 21 East, ZEPHYRHILLS COLONY COMPANY LANDS;.accordingto map or
<br /> plat thereof recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida.' .
<br /> Together with that portion of the alley showing on said plat lying East of same;:said alley having been
<br /> closed and vacated by Resolution of the Board of County Commissioners,ofPasco•Co`un`ty,Florida,
<br /> dated April 27, 1971 and recorded in Official Record Book 541,Page 11,8,Public Records--ofPasco
<br /> County, Florida.
<br /> be, and the same are hereby annexed to and included within the boundaries-of the City of
<br /> Zephyrhills, Florida, a municipal corporation.
