<br /> AN ORDINANCE OF THE CITY COUNCIL OF
<br /> THE CITY OF ZEPHYRHILLS, FLORIDA,
<br /> ANNEXING ENCLAVES, WHICH ARE
<br /> ADDITIONAL TERRITORIES TO BE INCLUDED
<br /> WITHIN THE BOUNDARIES OF SAID CITY
<br /> PURSUANT TO THAT CERTAIN INTERLOCAL
<br /> AGREEMENT BETWEEN PASCO COUNTY AND
<br /> THE CITY OF ZEPHYRHILLS AND IN
<br /> ACCORDANCE WITH FLORIDA STATUTE

<br /> WHEREAS, SUBURBAN PROPANE,L.P., is the present owner of the lands hereinafter
<br /> described in Section 1, and
<br /> WHEREAS, the properties described in Section 1 below created an enclave within the
<br /> incorporated boundaries of the City of Zephyrhills,
<br /> WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco
<br /> County have entered into an interlocal agreement to annex said enclaved properties into the City
<br /> limits of the City of Zephyrhills,
<br /> WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills
<br /> on the 8th day of July, A.D., 2002, and the Board of County Commissioners of Pasco County on the
<br /> 15th day of October, A.D., 2002.
<br /> WHEREAS, SUBURBAN PROPANE, L.P., was notified of the public hearing for
<br /> annexation by regular mail and registered mail, return receipt of the lands described in Section 1, and
<br /> WHEREAS, the Board of County Commissioners of Pasco County and the City_Council of
<br /> the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within
<br /> the corporate limits of said City,
<br /> WHEREAS, the Planning Commission.has recommended approval of the annexation.
<br /> NOW, THEREFORE,BEITENACTEDAND ORDAINED bythe City Council'ofthe City
<br /> of Zephyrhills, Florida, as follows:
<br /> SECTION 1: That the following described enclaved lands, lying and being situate in Pasco
<br /> County, Florida, to-wit:
<br /> 02-26-21-0010-02400-0010 - .
<br /> The North 2/5 of Tract 24 of ZEPHYRHILLS COLONY COMPANY,lying in Section 2,Township
<br /> 26 South, Range 21 East, and recorded in Plat Book 1, page 55, Public Records of Pasco County.
<br /> LESS and EXCEPT road Right-of-Way for State Road 54.
<br /> be, and the same are hereby annexed to and included within the boundaries of'the City of
<br /> ✓ ,
<br /> Zephyrhills, Florida, a municipal corporation.
<br /> SECTION 2: Said lands are contiguous to the present city limits of the City of Zephyrhills.

<br /> That said lands are now unincorporated and lie in the same county as said City, and when annexed
<br /> would form a compact addition to the incorporated territory of said City. That the City of Zephyrhills
