NOW THEREFORE,BE IT ORDAINED by the City Council of the <br /> City of Zephyrhills, Florida, as follows: <br /> SECTION 1: That the following described lands , lying and being <br /> situate in Pasco County, to-wit; <br /> Parcel No.: 34-25-21-0020-00000-00A0 1. <br /> Lot A.Fort King Acres, according to the plat thereof as recorded in Plat <br /> Book 6,Page(s) 109,of the Public Records of Pasco County,Florida. The <br /> above described parcel contains 2.67 acres more or less, <br /> and are herein rezoned to Residential Suburban(RS) <br /> SECTION 2: That said lands are contiguous to the present city limits <br /> of the City of Zephyrhills. That said lands are now unincorporated and lie in <br /> the same county as said city, and when annexed, would form a compact <br /> addition to the incorporated territory of the City of Zephyrhills. That the <br /> owners of said lands contained in said area to be annexed has given written <br /> consent to have such lands annexed and the City Council of the;City of <br /> Zephyrhills does hereby approve the annexation,for said annexation.duly <br /> expressed by Ordinance. <br /> SECTION 3: That the City Council of the City of Zephyrhills,Florida, <br /> has been given authority by legislature of the State of Florida under Chapter <br /> 69-139, Laws of Florida, 1969, to zone territorial boundaries upon'receipt of <br /> a %Titter, cothent of the land owner; together with the apprv''al of the City <br /> Council of the City of Zephyrhills of said zoning duly expressed by Ordinance. <br /> SECTION 4: That the City Council of the City of Zephyrhills is of the <br /> opinion that the Residential Suburban (RS) Future Land Use designation <br /> would promote the general welfare and encourage proper development within <br /> the City, and that said lands shall hence forth have the Future Land Use <br /> designation of Residential Suburban (RS). <br /> SECTION 5: That the City Council of the City of Zephyrhills is of the <br /> opinion that PUD (Planned Unit Development) zoning would promote the <br /> general welfare and encourage proper development within the City;and that <br /> said lands shall henceforth be rezoned from County R-2 to City PUD <br /> (Plannded Unit Development). <br /> SECTION 6: That flue public, notice of hearing on uch proposed <br /> Rezoning was given by the City Council of the City of Zephyrhills on May 1, <br /> 2003 and May 8, 2003, as required by Chapter 166.041, Florida Statutes. <br /> SECTION 7: That a public hearing on this proposed FLUM <br /> Amendment and Rezoning before the Zephyrhills'Planning Commission was <br /> held on February 16, 2003. <br /> SECTION 8: That the Zephyrhills' Planning Commission <br /> recommended approval of said FLUM amendment and rezoning from County <br /> RES-6 to City PUD (Planned Unit Development). <br />
