ORDINANCE NO.: 855-03 <br /> AN ORDINANCE OF THE CITY COUNCIL OF <br /> ZEPHYRHILLS, FLORIDA, A MUNICIPAL <br /> CORPORATION, AMENDING CHAPTER 34, <br /> PERSONNEL POLICIES, OF THE CITY OF <br /> ZEPHYRHILLS, FLORIDA CODE OF <br /> ORDINANCES BY CREATING A NEW <br /> SUBSECTION 34.06 TO CHAPTER 34 ENTITLED <br /> SECURITY AND PUBLIC SAFETY; PROVIDING <br /> FOR FINGERPRINTING AND CRIMINAL <br /> HISTORY RECORD CHECKS FOR CERTAIN <br /> CURRENT AND PROSPECTIVE CITY <br /> EMPLOYEES, APPOINTEES, PRIVATE <br /> CONTRACTORS, EMPLOYEES OF A PRIVATE <br /> CONTRACTOR, VENDORS, REPAIR PERSONS, <br /> OR DELIVERY PERSONS PURSUANT TO <br /> SECTION 166.0442, FLORIDA STATUTES; <br /> PROVIDING PROCEDURES TO CONDUCT <br /> FINGERPRINTING AND CRIMINAL HISTORY <br /> RECORD CHECKS; PROVIDING FOR <br /> CONFIDENTIALITY; PROVIDING FOR THE <br /> DESIGNATION OF CITY OWNED OR OPERATED <br /> FACILITIES AND POSITIONS CRITICAL TO <br /> SECURITY AND PUBLIC SAFETY; PROVIDING <br /> FOR AN EXEMPTION UNDER EMERGENCY <br /> CONDITIONS;PROVIDING FOR ENFORCEMENT <br /> AND PENALTIES; PROVIDING FOR THE <br /> REPEAL OF PRIOR INCONSISTENT <br /> ORDINANCES AND RESOLUTIONS;PROVIDING <br /> FOR INCORPORATION INTO THE CODE; <br /> PROVIDING FOR SEVERABILITY; AND <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS,the City Council of the City ofZephyrhills,Florida is granted the <br /> authority under Article VIII, Section II(b), of the State of Florida Constitution, to <br /> exercise any power for municipal purposes except when expressly prohibited by law; <br /> and <br /> WHEREAS, the City of Zephyrhills, prior to the enactment of Section <br /> 166.0442,Florida Statutes,performed employment background checks and screening <br /> for current and prospective employees and appointees who are required to undergo <br /> background screening as a condition of employment and retention consistent with the <br /> provision set forth in Chapters 112 and 435 of the State of Florida Statutes; and <br /> WHEREAS, Chapters 112 and 435, State of Florida Statutes, limited the <br /> City's ability to consider criminal history record information when qualifying such <br /> person to a position of employment or appointment or the retention thereof; and <br />
